On ABC’s “This Week” today, Mayor Rahm Emanuel discussed Mitt Romney’s attempts to evade responsibility for the outsourcing, job losses, and bankruptcies at Bain Capital. Mayor Emanuel said that as President, you can’t have a sign on your desk that says, “gone fishing.”

Appearing on MSNBC’s “Up With Chris Hayes,” Romney’s former partner at Bain Capital Edward Conard made the case for outsourcing jobs, which he argues in his book, “Unintended Consequence”:
CONARD: I think the problem with defending it, for Mitt, I’m not speaking for Mitt […] people look very close at the micro, get their nose close to the paper and say, ah-ha there is a job that was lost and went overseas, and we can speak about Bain. On a macro level we can see 20 million immigrants came into our country, there’s net insourcing, not net outsourcing. We were growing the economy fast enough that we were pulling the employees into the country, more than sending out of the country. Of the 40 million jobs created, 50 percent were created at the highest end of the wage scale, 40 percent of the jobs in the 1980s were at the highest end of the wage scale, so, there was a disproportionate increase at the high end of the wage scale over that, over that period.

Mitt Romney’s Candidacy is Turning into The Republican Party’s Worst Nightmare

The hits just keep coming for Mitt Romney. This a another defining moment for the Romney campaign, and shows the fissure between Romney’s business experience and the political realm. But it also shows that Mitt Romney’s financial issues — from Bain to his secret taxes to his hidden off-shore money — make him the poster boy for the 2%. The more Americans learn about how privileged Mitt Romney is, the more aware they’ll be that they are being royally screwed by the privileged. This is a conversation topic that the 2% do not want Americans to be engaged in.
This morning’s discussion on ABC This Week is a strong indicator that even Republicans don’t like the direction Mitt Romney’s campaign is going and can’t support Romney’s arrogance in not releasing his tax returns and information about his offshore accounts.

RETROACTIVELY, RETROACTIVITY – Generally refer to laws or court decisions which affect already existing rights, obligations and duties, or attach new conditions in respect to transactions or events already past.
Retroactivity depends on whether the new provision attaches new legal consequences to events completed before its enactment. Landgraf v. USI Film Prods., 114 S. Ct. 1483, 1499 & n.3 (1994). “The conclusion that a particular rule operates `retroactively’ comes at the end of a process of judgment concerning the nature and extent of the change in the law and the degree of connection between the operation of the new rule and a relevant past event.” Id. at 1499.
Harper v. Virginia Dep’t of Taxation, 113 S. Ct. 2510, 2517 (1993) holds that no court may refuse to apply rule of federal law retroactively once the Court applies it to the parties before it.
A statute passed by a legislature usually states that it shall only apply after a certain date. Occasionally, though, laws are made retroactive–that is, they apply to events that happened before the law was passed. (Criminal laws are never retroactive–the legislature cannot make a past act a crime.) If the statute itself doesn’t indicate the date it is to become effective, courts normally interpret it to have future effect only.
Example: Assume that the Minnesota legislature passes a law requiring a couple to undergo a blood test as a requirement of being married. The legislature intends that it apply to couples both planning to marry and already married. (Currently, Minnesota does not require blood tests before marriage.) Applying the law to already married couples is a retroactive application of the law. A married Minnesotan might challenge the law arguing that applying it to her is unconstitutional because she had no expectation of ever having to undergo a blood test as a requirement of being married in Minnesota.
