    NORTH CAROLINA-(BASN) – In the midst of Jordan Davis murder case, where a 47 year old white male named Michael Dunn fired shots into a car killing a Black teenager allegedly over loud music in Jacksonville, Florida in broad daylight at a gas station in November 2012., I find it quite odd, especially with the anniversary OF Trayvon Martin’s death approaching, which his murderer George Zimmerman walked away a free man and was scheduled to fight in a celebrity boxing match with DMX, which was cancelled, that we could even debate why Oklahoma State’s Michael Smart would be shoving a Texas Tech fan, who allegedly called him a “Nigger,” “told him to go by to Africa, or even called him a ”piece of crap,” which he was suspended for three games.

    Josh Israel: Florida County Eliminates Minority-Heavy Polling Places

    On a party-line vote, a Florida county’s Republican majority Board of County Commissioners voted Tuesday to eliminate almost one-third of Manatee County’s voting sites. The board accepted a proposal by Supervisor of Elections Mike Bennett (R) by a 6-1 vote to trim the number of precincts, despite unanimous public testimony against the move — and complaints by the lone Democratic Commissioner that it would eliminate half of the polling places in his heavily minority District 2.

    Bennett, in his first term as elections supervisor, proposed reducing the number of Manatee County precincts from 99 to 69. In 2011, while serving in the Florida Senate, he endorsed making it hard to vote: “I wouldn’t have any problem making it harder. I would want them to vote as badly as I want to vote. I want the people of the state of Florida to want to vote as bad as that person in Africa who’s willing to walk 200 miles…This should not be easy.”

    Those who didn’t watch the trial might not know that Dunn’s testimony was that he had a verbal altercation with Jordan and “thought” he saw a weapon. In response, he started shooting. As the car Jordan was in tried to flee, Dunn got out of his car and continued shooting at it, narrowly missing killing the driver. It was this latter shooting that the jury agreed was attempted murder.

    I join those who suggest that Dunn’s account of what happened between he and Jordan is simply not credible. Police found no gun in the car, no one but Dunn heard any threats from Jordan, Dunn fled the scene without calling the police and he didn’t say anything to his fiance about a gun over the next 24 hours as he tried to reassure her. But as I understand the law, the prosecutors had to prove – beyond a reasonable doubt – that Jordan did NOT have a gun. It is almost impossible to prove a negative. That, my friends, is the result of the odious and racist Stand Your Ground law

    Happy Birthday, Jordan.

    I remember being 19. I was a freshman in college at Florida State University. Jordan wanted to join the military, and that is where he would be now, serving his country. Trayvon wanted a career in aviation and he would have been a freshman in college this year, perhaps at one of the state universities in southern Florida, close to home.

    The loss is so great that it cannot even be measured, it can only be imagined.

    God help us.

    Sadly, you were born into a society that

    Still required your parents to give you “the Talk.”
    Still had too many people consider Black skin a crime.
    Still had LE and private citizens stereotyping and profiling Blacks.
    Still found store security following and keeping an eye on Blacks.
    Still stopped and frisked Blacks.
    Still handed down unequal justice for Blacks.
    Still tried to suppress the vote of Blacks.
    Still was full of hateful racists and White Supremacists.
    Still discriminated against Blacks in the workplace.
    Still had institutional racism present.
    Still had some LE who treated Blacks brutally.
    Still had Whites showing their fear of Blacks from clutching purses to complete avoidance.
    Still had racist hatred directed at Blacks.

    It is heartbreaking to know that in this atmosphere, you became one of the Black victims who have lost their lives.

    May you rest in peace and be in His loving arms.

    Tuesday morning, the lawyer for Michael Dunn starts the first full day of his defense in the murder trial for his fatal shooting of 17-year-old Jordan Davis, in what is likely the most prominent Florida Stand Your Ground case since Trayvon Martin. But while Dunn and his lawyer are invoking the language of the Stand Your Ground law to argue that he shot the seemingly unarmed teen in self-defense, a state Senate panel will take up a bill Tuesday morning to expand Florida’s already-expansive self-defense law.

    Florida’s Stand Your Ground law grants immunity from both criminal and civil charges to those who use deadly force anywhere they have a legal right to be without any duty to first attempt retreat, if they can show that they had a reasonable fear of imminent bodily harm or death. The law has been cited by many defendants who appear to have been exercising vigilantism — turning to their guns before first attempting to call the police or walk away. In Florida alone, at least 26 children and teens and 134 individuals overall have died in Stand Your Ground cases since the law’s passage. While moves to repeal failed in November, another bill to instead expand the law is advancing rapidly.
    The new bill has been dubbed a “warning shot” bill, and now a “threatened force” bill, and it would extend Stand Your Ground-like immunity from both criminal and civil charges to those who point a gun at an attacker or fire a gun as a self-defense threat or warning. The provision easily cleared a House committee in November, and will go before the Senate Judiciary Committee Tuesday morning.

    In anticipation of the vote, the Sarasota Herald-Tribune’s “The Gun Writer” blog posted an item Tuesday that, verbatim, published a National Rifle Association press release on the bill and accompanying op-ed. The National Rifle Association and Republicans backing the bill are capitalizing on provisions that roll back the state’s mandatory minimum sentencing scheme, known as “10-20-life” to garner support. “People make mistakes and do irrational things when in fear of death or injury. That doesn’t mean they should go to prison for 20 years when there was no injury or harm done,” reads the re-posted op-ed by past NRA President Marion P. Hammer.

    What the NRA’s press release and op-ed don’t mention is that the bill doesn’t just remove mandatory minimum sentences for those who would be convicted of gun and violence-related crimes; it also removes all criminal and civil liability for those who successfully invoke the defense in as vague and sweeping a manner as the original Stand Your Ground law, potentially opening the door for more judicial rulings of the sort we have already seen that excuse fatal shootings of unarmed victims.
