MADRID (AP) — A 10-year-old girl has given birth in southern Spain and authorities are evaluating whether to let her and her family retain custody of the baby, an official said Tuesday.
The baby was born last week in the city of Jerez de la Frontera, said Micaela Navarro, the Andalusia region’s social affairs minister.
Navarro told reporters the father of the baby is also a minor, and both the mother and the baby were in good health. Her department declined to give details, including the sex of the baby, but said authorities do not consider this a case of rape and that no criminal investigation is under way.
Under Spanish law, having consensual sex with someone under age 13 is classified as child abuse, an official with the Spanish Justice Ministry in Madrid said. But this particular case is complicated by the fact that the father of the baby is also a minor and it is not clear if he could be charged, the official said.
Spanish newspapers said the mother is of Romanian origin.
The daily Diario de Jerez reported the girl was already pregnant when she arrived in Spain, but did not say when she came to this country. It is not clear if the father is in Spain.
Medical experts warn that because young girls are still growing, they are at higher risk during pregnancy. Studies have shown that teenage girls are more likely to give birth to premature babies and their infants have a higher chance of dying by age one.

Exit polls are being conducted in 26 states today but the results will be quarantined until at least 5:30 pm ET.
Anything you might hear before then is based on uninformed speculation. Of course, much of what you hear after that time might be as well.
Charlie Cook says there’s too much focus on poll closing times for tonight’s results, times when no election results are actually available. Instead, the focus should be on the times at which meaningful levels of results are in.
He sends over a useful table showing the states in chronological order by when 50% of the 2008 vote had been counted, along with some key races worth following.

A star lineup of Dems led by Vice President Joseph Biden yesterday hit Quincy to make a last-ditch pitch for the open 10th Congressional District seat.
“Get up, folks. Get up and go out and get these folks to vote. Do not take this lightly,” a vehement Biden urged a crowd of several hundred at a rally for Norfolk District Attorney William R. Keating, who is running in a close race against Republican Jeff Perry.
The campaign stump in Quincy comes as prominent Democrats make last-minute pitches across the country amid fears the party will lose control of Congress. President Barack Obama campaigned in Philadelphia yesterday.

While our forecast and a good deal of polling data suggest that the Republicans may win the House of Representatives on Tuesday, perhaps all is not lost for the Democrats. Here’s one possible scenario for how things might not end up as expected.
It was hard to pinpoint exactly when in the night things started to go wrong. But at some point, a trash can was knocked over in John A. Boehner’s office in the Longworth House Office Building. A half-hour later, a hole was punched in the wall at the Republican National Committee’s headquarters.
Republicans didn’t really have much reason to be upset. They were going to pick up somewhere between 29 and 34 House seats from Democrats, pending the outcome of a recount or two and the receipt of mail ballots in some Western states. They gained five Senate seats from Democrats, and won the governorships in Michigan, Wisconsin, Pennsylvania, Texas, and Florida, among many other states. It had been a wave election, indeed — but a wave on the magnitude of 2006, rather than 1994.

Morgan Freeman in middle of campaign ad controversy

(CNN) – North Carolina Republican congressional candidate B.J. Lawson’s campaign said it was “tricked” by a production company after it was revealed that actor Morgan Freeman was not the narrator in Lawson’s latest ad, as the campaign had previously claimed.
“We’re apologizing to Congressman Price, to the voters, and most of all to Morgan Freeman because this is not the campaign we wanted to run, and not the campaign we have run,” Lawson campaign spokesman Martin Avila told CNN.
The narrator’s familiar voice immediately raised eyebrows when the ad launched on Friday. Lawson’s campaign initially confirmed that the voice was Freeman’s on Facebook and on its website on Monday.
But the Oscar-winning actor issued a statement soon after denying any involvement with the campaign.
