Rockin’ Around the Christmas Tree is a Christmas song written by Johnny Marks and recorded by Brenda Lee in 1958 on Decca 9-30776.
Although Decca released it in both 1958 and again in 1959, it did not sell well until Lee became a popular star in 1960; that Christmas season, it hit #14 on the Billboard pop chart and turned into a perennial holiday favorite. It continued to sell well during the holiday season, hitting #5 on the Christmas chart as late as 1984. Brenda Lee’s recording still receives a great deal of airplay. Despite the song’s title, its instrumentation also fits the Country genre which Brenda Lee more fully embraced as her career evolved. Nigeria to Charge Dick Cheney in Pipeline Bribery Case

Dec. 1 (Bloomberg) — Nigeria will file charges against former U.S. Vice President Dick Cheney and officials from five foreign companies including Halliburton Co. over a $180 million bribery scandal, a prosecutor at the anti-graft agency said.
Indictments will be lodged in a Nigerian court “in the next three days,” Godwin Obla, prosecuting counsel at the Economic and Financial Crimes Commission, said in an interview today at his office in Abuja, the capital. An arrest warrant for Cheney “will be issued and transmitted through Interpol,” the world’s biggest international police organization, he said.
Peter Long, Cheney’s spokesman, said he couldn’t immediately comment when contacted today and said he would respond later to an e-mailed request for comment.
Obla said charges will be filed against current and former chief executive officers of Halliburton, including Cheney, who was CEO from 1995 to 2000, and its former unit KBR Inc., based in Houston, Texas; Technip SA, Europe’s second-largest oilfield- services provider; Eni SpA, Italy’s biggest oil company; and Saipem Construction Co., a unit of Eni. Obla didn’t identify the former officials whom he said held office when the alleged bribes were paid.
Last week, Nigeria arrested at least 23 officials from companies including Halliburton, Saipem, Technip and a former subsidiary of Panalpina Welttransport Holding AG in connection with alleged illegal payments to Nigerian officials. Those detained were all freed on bail on Nov. 29.

Supreme Court: Government Is ‘Torturing FOIA’ To Keep Docs Secret

WASHINGTON — The Supreme Court on Wednesday questioned the government’s broad use of an exemption in the federal Freedom of Information Act to withhold documents from the public.
The justices heard argument in an appeal from Glen Milner, a Washington state resident who sued under FOIA for maps showing the extent of damage expected from an explosion at the Navy’s main West Coast ammunition dump on an island near Port Townsend in western Washington.
The Obama administration is defending the decision to deny Milner the maps under a provision of FOIA that exempts from disclosure documents “related solely to the internal personnel rules and practices of an agency.”
Chief Justice John Roberts said the administration was asking the court “to torture the language in FOIA” to keep the documents from being made public. Roberts also noted the public’s frustration with FOIA, even when the government is willing to turn over material. “It takes forever to get the documents,” he said.
Several other justices indicated that they also thought the government and several appeals courts that have dealt with FOIA lawsuits have interpreted the exception too broadly.

Death Penalty May Be Ruled Unconstitutional In Texas

WASHINGTON — At a hearing scheduled for Monday, December 6, a district court in Texas will decide whether the death penalty is unconstitutional in the state based on the disproportionately high risk of wrongful convictions in Texas. This is the first time in the state’s history that a court will examine the problem of innocent people being executed in a Texas capital trial.
John Edward Green, Jr., the defendant in Texas v. Green, is charged in the fatal shooting of a 34-year-old Houston woman during a 2008 robbery. According to legal documents obtained by HuffPost, Green’s defense attorneys will be arguing on Monday that a number of factors in Texas’s legal system increase the risk of wrongful executions there, including a lack of safeguards to protect against mistaken eyewitness identification, faulty forensic evidence, incompetent lawyers at the appellate level, failures to guard against false confessions and a history of racial discrimination in jury selection.
The death penalty in Texas came under fire earlier this month when a DNA test conducted on a single hair undermined the evidence that convicted a Texas man of capital murder over ten years ago. The hair had been the only piece of evidence linking Claude Jones to the crime scene, but the new test results revealed that the hair likely belonged to the murder victim instead of Jones.

How did Bristol Palin end up on ‘Dancing With the Stars’? Sarah once said that the show’s producers’ first choice was Todd but they took Bristol instead–and now Bristol’s fellow contestant Margaret Cho says Sarah forced her daughter to do the show as payback for her ill-timed pregnancy.

I heard from someone who really should know (really should seriously know the dirt really really) that the only reason Bristol was on the show was because Sarah Palin forced her to do it. Sarah supposedly blames Bristol harshly and openly (in the circles that I heard it from) for not winning the election, and so she told Bristol she “owed” it to her to do DWTS so that “America would fall in love with her again” and make it possible for Sarah Palin to run in 2012 with America behind her all the way. Instead of being supposedly “handicapped” by the presence of her teen mom daughter, now Bristol is going to be an “asset” – a celebrity beloved for her dancing. I am sure the show wasn’t in on this (but who knows anything really).

Record-Breaking Cyber Monday Surpasses $1 Billion In U.S. Online Spending
Online retailers rejoice! According to comScore’s latest stats, U.S. online spending surpassed $1 billion on CyberMonday (the Monday after Thanksgiving and Black Friday), up 16 percent versus year ago. The day also marked the the heaviest online spending day in history and the first day to surpass a billion dollars in spending.
As comScore reported over the weekend, U.S. online shoppers spent $648 million in online sales on Black Friday, which was a 9 percent increase from last year and also set records for the heaviest spending day in e-commerce history. For the holiday season-to-date, the company reports that $13.55 billion has been spent online, which is a 13 percent increase comapared to the same period last year.
comScore chairman Gian Fulgoni said in a statement that the “early strength in consumer spending is almost certainly the result of retailers’ heavier-than-normal promotional and discounting activity at this early point in the season.” It should be interesting to see of retailers continue to promote discounts and sales as we near the holidays.
The record-breaking billion dollar day was primarily attributed to an increase in the average spending per buyer (up 12 percent) as opposed to the number of buyers which only grew by 4 percent to 9 million. The average spending per transaction grew 10 percent to $60.05, while the total number of transactions increased 6 percent to 17.1 million.

Obama’s bad poker

On page 116 of “The Promise,” Jonathan Alter describes President Obama’s approach to the stimulus as “bad poker.” “Instead of holding his cards close, and then sweetening the pot for Republicans with tax cuts in the final negotiations, [Obama] offered nearly $300 billion in tax cuts at the front-end of the process. … It was a big bargaining chip left off the table.”
Obama has since admitted as much. “It might have been better for us not to include tax cuts in the original package, let the Republicans insist on the tax cuts, and then say, O.K., you know, we’ll compromise and give you your tax cuts,” he told Peter Baker. So why does he keep including the tax cuts?
Annoyed congressional staffers and baffled strategists rattle the list of concessions the White House has unilaterally made to Republicans from memory. There were the $300 billion in tax cuts, of course. The non-security discretionary spending freeze, a longtime Republican demand that the Obama administration simply announced during the 2010 State of the Union (Republicans responded by demanding discretionary spending cuts back to 2008 levels). During the climate-change debate, the administration gave away an expansion of offshore drilling, loan guarantees for nuclear power plants and delay of EPA regulations until 2011 — all Republican demands that Lindsey Graham, John Kerry and Joe Lieberman were hoping to trade for GOP support. “Obama had served the dessert before the children even promised to eat their spinach,” reported Ryan Lizza. “Graham was the only Republican negotiating on the climate bill, and now he had virtually nothing left to take to his Republican colleagues.” And most recently, there’s the two-year freeze in federal pay.
Different parts of the White House give different answers when asked about this strategy. Some argue that these decisions were simply good policy, and the president is right not to treat them as bargaining chips. The whole theory of legislative politics as some sort of negotiation is wrong, they say. The Republicans were never going to negotiate, and so holding these as chips would’ve simply meant never doing them. Better to do them unilaterally and get the credit. Some will defend certain policies but not others. The tax cuts were done unilaterally because the administration was committed to a particular design that it thought would do more for the economy, though this doesn’t get mentioned much because it makes them look less bipartisan. And some staffers just laugh ruefully when you use the word “strategy.”
“The best negotiator I ever came across was [former Reagan and Bush chief of staff] Jim Baker,” says Paul Begala, who served as an adviser to President Clinton. “He began every negotiation with this sentence: ‘Nothing is agreed to till everything is agreed to.’ So no one can pocket anything, and no one suffers for making the first move.” To many Democrats, Republicans have simply proven the wisdom of Baker’s strategy: They keep pocketing these gains without giving the White House any credit, while both the Democrats and Obama take lashings from their base for being insufficiently principled and tactically incompetent.
“You don’t go out and say you’re going to freeze federal pay on your own,” says one angry Hill staffer. “You go sit across a table from someone, say, ‘I’m willing to do this, but this is what you’ve got to give me.’ That’s how this works.”
The going theory — which you hear both inside and outside the White House — is that this is what happens when a president who wants to be bipartisan gets stuck in a partisan moment. Obama remains intent on proving his interest in working across the aisle but impatient with negotiations that will go nowhere and produce nothing. It’s worth sitting down with drug companies because concessions might buy their support. It’s not worth doing it with Republicans because concessions don’t attract their support, as the Gang of Six, among other negotiations, proved.
But the White House’s critics think the proof is in the election. Democrats just got “shellacked.” Obama gained absolutely nothing by seeming more reasonable than his opponents. In fact, the Republicans ran some notably unreasonable candidates and still won the election. The question, they say, isn’t why Obama wants this strategy to work. It’s when he’ll admit that it’s failed.

Dick Cheney and other GOP heavyweights are setting up a fundraiser for Maria Cino, a former Bush Commerce Department official and Deputy Transportation Secretary who may soon be announcing her intent to challenge Michael Steele for the RNC chair position.
According to CNN the event will be held at GOP strategist Mary Matalin’s Virginia home and feature guests such as Ed Gillespie, former New York Rep. Bill Paxon and former Bush aides Melissa Bennett and Emily Lampkin. It is reportedly designed to channel donations into Cino’s recently created 527 group.

But as the fundraiser makes clear, Cino is all but certain to jump in the race and could formally announce her bid at the end of next week. She is slated to participate in a closed-door interview session Thursday with the bloc of RNC conservatives.
The lining up of powerful Bush-era officials, including the administration’s vice president, against Michael Steele is the latest sign of bad news for the RNC Chairman, who was recently hit with a poll that suggested Republican voters were strongly supportive of his departure. And that was before he was tripped up yet again by news that he’d allegedly showered large amounts of RNC money on a longtime aide.
Saul Anuzis, former GOP chairman of Michigan, has already officially announced his plans to take on Steele for the RNC leadership role, as has former Luxembourg ambassador Anne Wagner. More challengers are still expected to throw their hats into the ring in the lead-up to the mid-January selection process.

CNN’s Anderson Cooper came prepared Monday to an interview with a Republican Texas state representative who questions President Barack Obama’s citizenship.
Rep. Leo Berman has introduced a bill that would require any candidate for president or vice president of the United States to provide his or her birth certificate to the Texas secretary of state.
“This bill is necessary because we have a president whom the American people don’t know whether he was born in Kenya or some other place,” Leo Berman, who has represented the 6th District of Texas since 1999, told the Lubbock Avalanche-Journal.
“I don’t know anything about President Obama,” Berman told Cooper Monday.
“There’s a certificate of live birth, which is what the state of Hawaii sends out,” Cooper explained. “Why isn’t that good enough?”
“Well, because it’s not an original birth certificate. It doesn’t show the parents’ place of birth. And, also, we know for certain that President Obama’s father was born in Kenya. Since he was born in Kenya, in — that was a British protectorate. President Obama was born in 1961. And with his father being a British citizen, at least, President Obama, we think, holds dual citizenship,” Berman replied.

Obama administration officials will announce this afternoon that they will not allow offshore oil drilling in the eastern Gulf of Mexico or off the Atlantic and Pacific coasts as part of the next five-year drilling plan, according to sources briefed on the plan, reversing two key policy changes President Obama announced in late March. During that announcement — less than a month before the BP oil spill — Obama and Interior Secretary Ken Salazar said they would open up the eastern Gulf and parts of the Atlantic, including off the coast of Virginia, to offshore oil and gas exploration.

But the proposal would allow broadband providers to charge consumers different rates for different levels of service, according to a text of the speech provided to The New York Times.

Eliot Spitzer’s TV sidekick is so fed up with playing second fiddle to the hooker-loving ex-gov that she’s threatening to walk, sources told The Post yesterday.
Washington Post columnist Kathleen Parker actually stormed off the set of the “Parker Spitzer” show during a pre-taping a few weeks ago — furious that her co-host is continually allowed to take charge of their nightly CNN chat-fest, the insiders said.
Although still fuming, Parker did return to wrap up the segment, they said.
But she’s angry that the show’s producers are allegedly doing nothing to play up her strengths on the ailing show, the sources said.
Some staffers said Spitzer — the hard-charging, former state attorney general who resigned as governor in 2008 after admitting to patronizing prostitutes — thrust himself up front and center right out of the gate, leaving Parker without a chance.
But other insiders said the Pulitzer Prize-winning Parker has only herself to blame.

She called POTUS a wuss and basically said he should man up! So, she needs to grow a pair and quit whinning…everybody and their mother knows that Spitzer is a womanizer! It was front page news that he treats women as a sperm receptacle commodity he is willing to pay for. What about that didn’t Parker understand?

Senate GOP letter calls for blocking most bills

Senate Republicans intend to block action on virtually all Democratic-backed legislation unrelated to tax cuts and government spending in the current postelection session of Congress, officials said Tuesday, adding that the leadership has quietly collected signatures on a letter pledging to carry out the strategy.
If carried out, it would doom Democratic-backed attempts to end the Pentagon’s practice of discharging openly gay members of the military service and give legal status to young illegal immigrants who join the military or attend college.
Senate Majority Leader Harry Reid has made both measures a priority as Democrats attempt to enact legislation long sought by groups that supported them in the recent midterm elections.
A nuclear arms treaty with Russia that President Barack Obama wants ratified would not be affected, since any debate would take place under different rules than those that apply to legislation. Even so, its passage is not assured as Republicans are seeking concessions from the White House.
