SANFORD — A hearing Tuesday will likely lead to a decision over whether the George Zimmerman trial will be delayed.
George Zimmerman is accused of killing Trayvon Martin a year ago. Zimmerman claims he shot him in self-defense.
Last week, Zimmerman’s defense team filed a motion to delay the trial saying it was out of money, and they needed more time to deal with the state’s evidence and witnesses information.
State prosecutors, however, say the defense is its own worst enemy. They say Zimmerman’s attorneys are falling behind on discovery because they spend too much time talking to the media.
A judge will hear arguments at the hearing Tuesday at 9 a.m.

No different from the concept of the angry black woman and those who push the meme that black women aren’t entitled to the same respect, courtesy, protections afforded and accorded the more “delicate” others.

Writing about the ‘rabid’ hate aimed at Trayvon Martin seems only to generate more hate. The view that the unarmed 17-year-old killed by George Zimmerman nearly a year ago was a thug who deserved to die is as strong as ever.
Many folks took issue with the picture I used yesterday and again today — that of a smiling, fresh-faced Trayvon wearing a red T-shirt from Hollister, the mass clothier of adolescence. Some think he’s as young as 11 years old or as old as 14 in that snapshot. Martin family attorney Benjamin Crump told me this afternoon that the slain teenager was 16 when that photo was taken in August 2011. Folks forget that, when he was killed, Trayvon had turned 17 just three weeks earlier. Trayvon would have been 18 years old yesterday. The most recent photo released by the family was of him on a horse wearing an orange T-shirt that was taken about a week before he was killed.
But one reader sent me an e-mail last night that was beyond ridiculous. “Why didn’t you show the up-to-date picture of Trayvon Martin as below instead of the one where he is much younger?” he asked. “I don’t take either side because I just don’t know all the facts, but what I do know is you can’t beat honest reporting.” Below is the “up-to-date picture of Trayvon Martin” he attached.

On Feb. 5, Trayvon Martin would have turned 18. Instead of being a cause for celebration, it was a harsh reminder of a tragic milestone.
In honor of the teen who was shot to death nearly a year ago, Florida Rep. Frederica Wilson on Tuesday introduced a congressional resolution honoring him. It also calls for the repeal of Stand Your Ground laws and asks the U.S. government to address racial profiling.
“We all know the circumstances surrounding his murder: Trayvon was racially profiled, chased, made to fight for his life and ultimately murdered. Yet we as a nation have yet to take substantive action to stop such a heartbreaking incident from happening again,” Wilson said in a statement. “Enough is enough. We as a nation have buried too many young Black boys. Let’s set Congress on course to address the underlying causes behind the crisis that Trayvon’s death symbolizes. Let’s take action to stop racial profiling and give our people a chance to succeed.”
On Tuesday, a judge denied a request by defendant George Zimmerman to delay the trial for five months. Zimmerman’s lawyer said more time was needed to raise money and lay the groundwork for the trial, but Judge Debra Nelson said that the issues were not insurmountable.
The trial is set to begin in June.

On February 5, Florida Congresswoman Frederica Wilson issued a press release announcing that she is introducing a Congressional Resolution to Honor Trayvon Martin and Seek End to Racial Profiling. The resolution urges the repeal of Stand Your Ground laws.
Congresswoman Wilson made the following statement:
“Today, Trayvon Martin would have celebrated his 18th birthday. We all know the tragic circumstances surrounding his murder: Trayvon was racially profiled, chased, made to fight for his life, and ultimately murdered. Yet we as a nation have yet to take substantive action to stop such a heartbreaking incident from happening again.”
Congresswoman Wilson is wrong for several reasons:
1. There is no evidence that George Zimmerman racially profiled Trayvon Martin. Considering many aspects of George’s life, not of least of which his mixed ethnic background, the racial diversity that was part of his upbringing, and the advocacy work he did as an adult, the claim that George Zimmerman is a racist is absurd, unfounded, and irresponsible. Moreover, all the information released from the FBI — which conducted a civil rights investigation on this matter — demonstrate no evidence of racism at all on the part of George. Rather, it documents the opposite.
2. George has a very strong self-defense case, and we are confident that in Court, George will be found not guilty of murder. As a sitting congresswoman, Representative Wilson should know that in the United States, citizens are constitutionally entitled to a fair trial, and that defendants are presumed innocent until proven guilty. They are not to be convicted by biased innuendo based upon an intentional ignorance of the facts, tossed about in a pandering way. For a person in a leadership role to ignore these significant principles denigrates the process and the Constitution she swore to uphold.
3. The Zimmerman case is not a “Stand Your Ground” case, it is a straight-forward self-defense case. The controversial part of the so-called “Stand Your Ground” law is the inclusion of language that removes the duty to retreat before using deadly force. George Zimmerman was on his back suffering blows from Trayvon Martin when he fired his weapon in self-defense. George had no opportunity to retreat, and you cannot stand your ground when you are on your back. No one who has taken the time to read and understand this statute would suggest that the facts of this case fit that limited portion of the statute.
Congresswoman Wilson’s statement is wildly inappropriate. She must know that her position as a distinguished representative in Congress gives her words weight and credibility, and she should not be promoting such unmeasured bias on a pending, undecided legal case.

I do not agree.
I do not believe Dee Dee had listened to the NEN call before Ben Crump interviewed her. IIRC, it was not released to the public until much later. The SPD had a lot of investigative work to do interviewing witnesses and processing the crime scene. If they even thought about it, checking the phone log probably would have been a low priority item on the to-do list, until after Ben Crump revealed that Dee Dee had been talking to Trayvon when the defendant stalked and assaulted him.
While it’s theoretically possible that the GPS data for the day of the murder might help the defense, I doubt that it does because we would have seen the defense lawyers congratulating their client and we would have seen him smiling or smirking at the news.
Instead, we saw gloom, doom, resignation, desperation and a visible dislike for the client that is more consistent with bad news for the defense. I cannot imagine that MOM would have failed to mention that the GPS data exculpated the defendant, given his propensity to try the case in the court of public opinion. He would have mentioned it in support of his argument for a continuance, if it existed, instead of waving around an insignificant bar-chart during an extemporaneous and rambling plea for a continuance.
He did not give a coherent answer when she put him on the spot and asked him to provide a specific reason why he needed a continuance. The best he could do was to squeak about not having any experts even though the defense team’s mismanagement of funds is the reason why it has no money to hire experts.
If the GPS data did not exist, or if it were uninterpretable, I think BDLR would have disclosed that in open court to Judge Nelson, defense counsel and the public. He did not do that. Instead, he graciously offered “to connect the dots” for the defense, but they did not rise to the bait.
That tells me the GPS data hurts the defense, badly.
The only reason that I can think of to explain why no one touched this issue and the body language of the defense team, including the lawyers turning their backs on the defendant and leaving him behind sitting forlornly at counsel table as they left the courtroom, is that the evidence devastates his story.

Please do not offer George Zimmerman any plea deals. I want to see this menace to society tried and convicted of 2nd degree murder. You cannot have a loose cannon on the streets snapping in a moment’s notice and killing innocent kids because of his drummed up assumptions.

MELBOURNE, Fla. — A vigil in Palm Bay to mark the life of Trayvon Martin was canceled Tuesday because of safety concerns just hours before it was scheduled to start.
According to a statement from event sponsor Fathers Stand Up, concerns that the event might have been taken out of context by the community were part of the reason for canceling the vigil.
Event organizer John P. Francois, founder of Fathers Stand Up, said there was “a lot of stuff that I heard that might occur” during the vigil, which was set for 6:15 p.m. Tuesday at Palm Bay City Hall. He said he canceled because, “I don’t want to see anybody get hurt on my watch.”
Martin, 17, was shot and killed by George Zimmerman in a Sanford, Fla., neighborhood on Feb. 26, 2012. Zimmerman was not immediately charged, but later was accused of second-degree murder in a case that has received intense media coverage and public interest.
Martin would have turned 18 on Tuesday.
Francois declined to give more details of the alleged statements that led him to stop the event, but he said they came from three different sources. He said he did not consider them threats and did not plan to get police involved, but he went ahead and canceled anyway.

An Academy Award-winning actor and a famed stand up comedian will attend a weekend event in Miami in remembrance of Trayvon Martin, a law firm representing the slain teen’s family has announced.
The Tallahassee-based Parks & Crump firm announced that Jamie Foxx and Cedric the Entertainer will attend the “Day of Remembrance Community Peace Walk and Forum,” which is being hosted by foundation created by the teen’s parents.
The event, which starts 10 a.m. Saturday at Ives Estate Park in Miami, will focus on “motivating youth on peaceful conflict resolutions instead of gun violence,” the firm said in a statement. The following evening, the foundation plans to hold a remembrance dinner at the DoubleTree Miami Airport Hotel’s convention center.
Great news; this event needs all the media coverage it can get.

About 70 people, mostly residents and civil-rights leaders, took to the streets of Goldsboro, a historically black Sanford neighborhood, to rally for peace this afternoon and call for an end to gun violence.
The event, called Band Together for Peace Against Gun Violence, also was a way to mark the birthday of Trayvon Martin, who would have turned 18 today.
Organizers of the event said the group gathered to celebrate Trayvon’s life, not mourn his death.

Instead, lawyers for George Zimmerman, the man accused of murdering the teen, and prosecutors were back in court where a judge denied a motion to delay the June 10 trial date and heard arguments about evidence.
Meanwhile, Trayvon’s family and local leaders have planned community healing and memorial events this week in honor of the teen whose shooting death last year sparked national debates about race, gun laws, and the meaning of self-defense.
Zimmerman, a neighborhood watch volunteer, is facing a second-degree murder charge in the Feb. 26 shooting of the 17-year-old in a gated Sanford, Fla., community. Zimmerman is claiming self-defense. Trayvon’s family argues the young man was profiled, pursued, and murdered.
In court Tuesday, Judge Debra Nelson denied a motion by Zimmerman lawyer Mark O’Mara to delay the trial date. O’Mara argued that the prosecution has been slow to turn over evidence and that he does not have enough time to prepare his case.
“We’re four months away from trial,” Nelson said. “The court has no reason to continue the case.”
Earlier, Assistant State Attorney Bernie de la Rionda and O’Mara traded arguments.
“The state has been trying to try this case in the courtroom,” de la Rionda said at one point. “I don’t know if that’s true of the defense.”
O’Mara, however, continued to press the importance of the Internet. “I spend virtually no time on Twitter and the website because it doesn’t matter that much,” he said. “But we cannot ignore the avalanche of information that is flowing through the blogosphere.”
In addition to the trial date, several other issues came before the court.
Nelson approved a motion by Zimmerman’s lawyer to subpoena credit card sales records from the 7-Eleven Trayvon visited the night he was killed. She also ordered de la Rionda reveal tests performed on the phone that investigators sent to California to get unlocked.
Lawyers also had lengthy arguments about Witness 8, a young lady who claims she was on the phone with Trayvon as the confrontation between him and Zimmerman started.
Nelson ruled that Witness 8 can be asked about her Twitter handle before she is deposed by the defense but that any other questions must be posed during her deposition.
Best birthday present the justice system could have given Trayvon, save Trayvon being here to enjoy reaching “his majority” as my grandparents would say.
I understand Zimmerman wanted the delay because he doesn’t have any money for a defense. Well, what about his pappy’s alleged “pull” he supposed to have as a magistrate? Guess they got tired of him pulling and decided his boy needed to go ahead and stand trial. If Zimmerman were a real man, he’d own up and ask for a plea deal which would include segregation within the general population.

A candlelight vigil and prayer service is set for Tuesday in Palm Bay to remember the life of Trayvon Martin, a teenager shot and killed last year in Sanford.
Fathers Stand Up Corporation, which is seeking a nonprofit designation from the IRS, is planning the event on the day that would have been the teen’s 18th birthday.
“In memory and respect, those across Brevard who were touched by the tragedy of his death will join the community of Palm Bay to remember him, his family and friends in a special prayer and showing of community strength and understanding,” a press release from the organization reads.
Martin, 17, was shot and killed on Feb. 26, 2012 in a Sanford neighborhood. The accused shooter, George Zimmerman, is charged with second-degree murder.
People are invited to gather as early as 5:30 p.m. Tuesday at Palm Bay City Hall, 120 Malabar Road SE. The brief vigil will begin about 6:15 p.m.

The ‘rabid’ hate aimed at Trayvon Martin

Eighteen years ago today, Trayvon Benjamin Martin was born to Sabrina Fulton and Tracy Martin. Nearly a year ago, their son was killed by George Zimmerman, a neighborhood watch volunteer in a gated community in Sanford, Fla., who viewed Trayvon as “a real suspicious guy.” Instead, the unarmed teenager was found with a bag of Skittles and an iced tea from 7-Eleven and a bullet hole in his chest from Zimmerman’s Kel-Tec 9 mm PF-9.
Zimmerman now awaits trial for second-degree murder. A trial that his attorney is trying to delay. But he will have his day in court. Meanwhile, the court of public opinion is working overtime. Depending on whom you talk to, Zimmerman is an unrepentant murderer and Trayvon had it coming.
That Trayvon brings out the worst in people is well known. What continues to shock me isn’t so much how widely held the negative view of him is, it is how openly people express their racism. Thanks to Wonkette, we know about Todd Kincannon. He is the former general counsel and executive director of the South Carolina Republican Party who felt compelled to mention Trayvon in a raunchy tweet about the Super Bowl. After reading his obnoxious Twitter feed, feel free to reach for the Purell. As if Kincannon’s first Trayvon tweet weren’t bad enough, the filterless fellow went even farther in another shameful tweet.
