Calif. court rules teacher tenure creates unequal conditions

A Los Angeles Superior Court judge ruled Tuesday that tenure, seniority and other job protections for teachers have created unequal conditions in public schools and deprive poor children of the best teachers.
In a case that could have national implications for the future of teacher tenure, Judge Rolf Treu sided with a Silicon Valley mogul against some of the most powerful labor unions in the country.
In a 16-page ruling, in the case of Vergara v. California, Treu struck down three state laws as unconstitutional. The laws grant tenure to teachers after two years, require layoffs by seniority, and call for a complex and lengthy process before a teacher can be fired.
David F. Welch, founder of an optical telecommunications manufacturing firm, charged that job protections allow the state’s worst educators to continue teaching and that those ineffective teachers are concentrated in high-poverty, minority schools, amounting to a civil rights violation.
Welch’s case was argued by a team of prominent attorneys, including former U.S. solicitor general Ted Olson and Theodore Boutrous, who most recently paired to win a U.S. Supreme Court decision that struck down California’s prohibition against same-sex marriage.
The defendants in the case, which include Gov. Jerry Brown (D) and other state officials, have been joined by the California Teachers Association and the California Federation of Teachers.
The ruling was a setback for the labor unions, which represent about 400,000 educators in California and whose core mission is to protect teachers’ jobs.
They are likely to appeal the lower court decision, and a final resolution could take years.
In many ways, the case was a proxy fight for some of the national conflicts over the teaching profession.

George Will went and blamed the victims—and Twitter responded with a round smackdown.
In the 1970s, feminists held “consciousness-raising” groups, where women got together and told their stories, helping each other understand that the constant drip-drip of condescension, sexual abuse and even violence they were experiencing at the hands of so many men was not a personal problem, but a political one. In the 21st century, feminists are using Twitter to do the same thing, but on a wider scale, building a picture of the obstacles women still face, one personal tweet at a time.
Washington Post columnist George Will kicked off another round of Twitter activism this week with one of the most overtly victim-blaming and shaming articles to have appeared in mainstream media in recent years. Will objected to the White House claiming that one in five women will be sexually assaulted in their college years, on the grounds that, to be blunt, he just didn’t want to believe the number could be that high. He ignores the fact that the number reflects the kind of high rates that similar surveys have produced. It was reactionary politics in its purest form: He doesn’t want to believe it’s true, and presto! That means it can’t be.
Of course, the problem with waving the number off is that it’s not pulled out of thin air, but comes from women actually reporting non-consensual sexual encounters. They only way to make it work, of course, is to argue that women are simply lying about their experiences and reclassifying consensual encounters as rape after the fact.
Most rape apologists prefer to argue that women lie about being rape to cover up their supposed shame at being slutty enough to consent or to punish men for not calling in the morning. (How answering “yes” to the question of whether or not you were forced to have sex against your will on an anonymous survey achieves either goal is never explained, of course.)
But Will took a novel approach, arguing instead that colleges have made “victimhood a coveted status that confers privileges” and therefore “victims proliferate.”
Will never bothered to enumerate any of the privileges that being a rape victim confers, nor did he explain how filling out an anonymous survey in secret—which, again, is where these statistics come from—gets you all these unnamed goodies. He didn’t bother to ask any experts who work with rape victims if their experiences suggest that life is roses and wine for victims after the fact. He certainly didn’t ask any actual victims if being raped was really the turning point in which their lives got super awesome, either.
Of course, if he had bothered to do a bit of research, he would have found out that, shockingly, being a rape victim is the exact opposite of a privileged position in this world. In fact, social scientists have found that victims are so terrified of being labeled “rape victims” that they often resist calling their experience “rape,” even when it’s blatantly obvious that’s what happened to them. That’s why surveys tend to avoid the word “rape” and instead ask about specific instances of sex where the respondent did not consent.

Claiming to be acting under the bloody “banner of Liberty and Truth,” Jerad Miller and his wife Amanda, entered CiCi’s Pizza in Las Vegas on Sunday right before noon and executed two local policemen on their lunch break. Authorities say Jerad approached one officer while he was refilling his soda cup and shot him in the head from behind, before he and Amanda opened fire on his partner.
While patrons scrambled to safety, one of the shooters reportedly shouted that the “revolution” had begun. The duo then stripped the officers of their weapons and ammunition and badges, and covered them with cloth that featured the “Don’t tread on me” Gadsden flag, which has recently been adopted as a symbol of the tea party movement. The couple also left a swastika on one of the officers.

Primetime hosts Bill O’Reilly and Sean Hannity both ignored the shocking cop-killer story last night, while Megyn Kelly devoted four sentences to it. (By contrast, the story covered extensively during CNN and MSNBC’s primetime.) Fox talkers on Monday were still far more interested in debating the prisoner swap of Bowe Bergdahl than they were examining the political ambush in Las Vegas.
For Fox News, the Las Vegas killing spree represents a toxic mix of guns, far-right insurrectionism, tea party implications, and the Cliven Bundy ranch standoff. For Fox News, the story about right-wing gun violence and the seeds of a bloody political revolution present all kinds of problems for the channel and its outspoken hosts, some of whom have previously championed limitless gun rights, insurrectionism, the Tea Party, and racist rancher Bundy.
In the 36 hours after the shooting, Fox News tread lightly around the Las Vegas story, producing regular news updates about the crime spree. But Fox provided almost no commentary, no context, and certainly no collective blame for the executions.
Why should fox cover killings they helped create and stir up. We reap the devastation of the fallout, not the hate machines that are fox and the NRA.

The Wrong $25 Million?

The United Negro College Fund, the primary fund-raising organization for private, historically black colleges, is a revered institution for many African Americans. Its successes are points of pride to many, and are vital to many black colleges.
When the UNCF announced one of its largest gifts ever on Friday, several took to Twitter to express shock and anger. One person wrote: “#UNCF Literally Sells Their ‘Souls To The Devil’ Accepting Checks From The #KochBrothers W/Out Knowing Their Evil History. Craziness.” Another tweet: “#Koch donation to @UNCF tells children everywhere that money is first and integrity is unnecessary. Sends the wrong damn message. Period.”
Others praised the gift: “Conservatism demands charity, where possible, assist the poor when government can’t. I applaud Charles and David Koch’s UNCF donation.”
Why this reaction and debate, to a gift of $25 million that will help the UNCF, its member colleges and scholarship recipients at those colleges? The dispute has to do with the source of the funds (the Koch brothers), questions about whether the scholarships being created will favor people who share the Kochs’ ideology, and concerns that Koch associates will play a direct role in selecting scholarship recipients through two of the five spots on the scholarship selection committee.
The funds are coming from Koch Industries and the Charles Koch Foundation, with Charles (one of the Koch brothers who own the family business with their name; the other is David), and major backers of conservative and libertarian politicians, think tanks and other organizations. The brothers have spent scores of millions of dollars backing candidates who advocate sharp reductions in federal spending and who campaign against just about every initiative of the Obama administration.
Groups supported by the brothers have also worked with “voter security” efforts by conservatives in a number of states — efforts that proponents say are designed to prevent fraudulent voting, but critics say are designed to limit the turnout of low-income and minority voters. (Koch groups have maintained that they support the right of everyone who is legally entitled to vote to do so, and said that this isn’t one of their issues.)
Koch grants to higher education — typically linked to free enterprise economics — have also been controversial. At Florida State University, some faculty members questioned whether Koch associates were given too much academic influence in return for a grant. A faculty review found numerous instances in which the language in the agreement left the university vulnerable to “undue outside influence.” In many cases, however, universities have welcomed Koch funds. When Roman Catholic theologians criticized Catholic University of America for accepting Koch funds, the president of the university blasted the critics.
In the case of the gift to UNCF, $18.5 million will be used to create the UNCF/Koch Scholars Program, which will provide funds to “exemplary students with demonstrated financial need and an interest in the study of how entrepreneurship, economics, and innovation contribute to well-being for individuals, communities, and society.” An additional $6.5 million will provide support for the UNCF and for its member colleges, with $4 million of those funds reserved to help the 37 UNCF member institutions help students who have been hurt by the denial of PLUS loans (a parent loan program). The shifts in PLUS eligibility standards have resulted in many parents of students at black colleges having their loan applications denied, and those denials have been cited as the reason many students have dropped out.
The agreement between the UNCF and the Koch organizations specifies that, for the scholarships, “an advisory board consisting of two UNCF representatives, two Koch representatives, and one faculty member from an existing school will be created to review scholarship applications and select recipients. Recipients will be selected based on their academic achievements as well as their interest in the program’s fields of study.”

Trading postal funds for highway funds

President Obama recently gave a big speech on infrastructure, making the case that making investments in roads, bridges, and rail would boost the economy, create jobs, and keep the nation more competitive. Of particular interest, Obama also reminded Congress that the nation’s Highway Trust Fund, which finances nearly all federally-supported transportation infrastructure in the United States, will run out of money entirely this summer unless Congress acts.
“It’s a crisis, it is,” Rep. Reid Ribble (R-Wis.), a member of the Transportation and Infrastructure Committee, recently said. “The Highway Trust Fund goes insolvent in July or sometime around there, and so we’ve got to figure out how we’re going to fund it.”
House Majority Leader Eric Cantor (R-Va.) believes he’s figured it out: cut money from the Postal Service and redirect those funds to transportation.
Republican leaders in the House last week announced plans to use about $15 billion they said could be saved from ending Saturday letter deliveries by the Post Office to pay for at least one year’s worth of transportation projects.
Advocates for both the Postal Service and increased transportation funding have objected to the plan because they argue that the two separate funding issues should not be combined.
In a memo to his members, released late last week, Cantor agreed that the Highway Trust Fund “will require an additional transfer of funds” prior to Congress taking August off. The Virginia Republican said he and the rest of the GOP leadership “firmly believe that this is the best way to ensure continued funding.”
And that’s where this gets a little tricky.
The Highway Trust Fund is generally supposed to be financed by a federal gas tax, which hasn’t been raised in over two decades. Republicans won’t allow an increase, and so transportation financing has become far more challenging.
GOP lawmakers could also consider deficit financing – that’s still their policy of choice when it comes to tax cuts – but House Republicans have ruled this out as a possibility, too. Why can the cost of tax breaks be borrowed, but the cost of infrastructure investments not? Because GOP leaders say so.

Alabama Debating Guns in Polling Places

Montgomery, Ala. Alabama officials have mere weeks to sort out whether gun-toting voters should be allowed in polling places under a new state law.
Differing interpretations of the new law became a problem in Tuesday’s primary after men showed up with guns in at least two precincts near Birmingham. Also, an east Alabama county first banned guns from polling places only to change the policy.
A law enforcement leader in Shelby County says someone needs to sort out the confusion before the runoff election on July 15. Two armed voters tried to cast ballots there.
But neither the secretary of state’s office nor the attorney general’s office is commenting publicly on whether armed voters should be allowed. A meeting on the issue is expected to be scheduled in Montgomery.

Republicans take photo ID laws beyond voting

For Republicans, requiring photo ID isn’t just for voting anymore. They like the concept so much they’re now expanding it to cover government benefits that low-income Americans rely on.
In a growing number of states, and even in Washington, the GOP, citing fraud, is pushing laws that could deny needed benefits to those who are struggling, simply because they lack ID.
Studies suggest around 11% of Americans—including one in four African-Americans—don’t have a photo ID. Among those who receive government benefits, that number is almost certainly higher.
North Carolina’s GOP-controlled legislature—which last year passed a voter ID requirement as part of the nation’s most restrictive voting law— advanced a bill Thursday that would make recipients of jobless benefits also show a photo ID. It’s expected to pass next week.
Since March, people getting unemployment insurance in the Tar Heel State have been required to come into a state job center to meet with a job placement counselor within four weeks of getting aid. At that meeting, they’ve also had to show photo ID. Now lawmakers are set to make the ID requirement official.
Helping lead the push for the law is Thom Tillis, the Speaker of the North Carolina House, who is challenging U.S. Sen. Kay Hagan, a Democrat, in a race that could determine control of the Chamber this fall. Tillis also was a key backer of the state’s voter ID measure.
Imposing an ID requirement is just the latest stage in North Carolina’s effort to restrict jobless benefits. Last summer, the state cut off unemployment insurance for nearly 70,000 people, knowingly rejecting over $700 million in federal money that was meant to be used to extend benefits. Thanks to that rejection, another 100,000 lost benefits at the start of this year.

As part of a broader voter-suppression campaign, Republican policymakers in many states now require voters to show a photo ID in order to cast an election ballot. This step, ostensibly intended to combat voter fraud that doesn’t exist, is a hurdle that’s never been necessary before, and which studies show disproportionately affect Democratic constituencies. There’s ample evidence of registered voters already being blocked from voting because of these measures.
But as my msnbc colleague Zack Roth reports, “For Republicans, requiring photo ID isn’t just for voting anymore.” It’s now being applied to recipients of government benefits.
Given all of these efforts, one might assume that fraud is rampant and that ID requirements would save money while preventing illegal schemes.
Except, that’s not quite right.
As Zack’s report made clear, fraud does exist when it comes to the distribution of government benefits, but most of the wrongdoing is the result of “concealed-earnings fraud,” which refers to people who have financial resources they mask in order to remain eligible for benefits, cheating the system.
How would forcing these people to show ID prevent this fraud? It wouldn’t.
For that matter, because food-stamp benefits are distributed by way of Electronic Benefits Transfer cards through the Supplemental Nutrition Assistance Program, ID requirements wouldn’t reduce fraud here, either.
So what’s the point? Proponents will have to answer these questions themselves, though Zack’s report added a key detail: ”Studies suggest around 11% of Americans – including one in four African-Americans – don’t have a photo ID. Among those who receive government benefits, that number is almost certainly higher.”

A congressional candidate named Evan Jenkins, currently a state senator, launched an interesting campaign ad yesterday, which perhaps inadvertently told us something important about the state of the debate over health care.
For those who can’t watch clips online, here’s a transcript of the spot
At first blush, this probably seems like an ad from a Democrat, boasting about taking on the insurance industry, using the power of government to help a family receive affordable medical care.
But it’s not. As David Nir explained, Evan Jenkins is a conservative Republican, running for Congress against a Democratic incumbent in West Virginia. In fact, Jenkins is running in a district that Mitt Romney won with 65% of the vote.
This context matters quite a bit. For all the rhetoric from the right about allowing “free-market principles” to guide the health care system, and how the public doesn’t want Big Government interfering with how Americans receive care, the truth is, even some red-state Republicans have decided the key to electoral victory is to reassure voters: they’ll use government to extend health care access, just like Democrats.

She’s entitled to her opinion but it doesn’t give the impression that Hillary has gravitas, only that she is petty, egotistical and entitled. Question: if she was truly Oval Office material why hasn’t she shared her vision of how she would govern and solve the problems we’re facing? I haven’t read not one interview where she delves into policy. Why is that? All the glowing articles, pithy comments about PBO, and so-called “zingers” about members of the GOP can’t disguise the fact that she’s not ready for prime time–she wasn’t then and she isn’t now. McAllister admits to casting vote for money

Congressman Vance McAllister admitted Thursday to voting against legislation in the U.S. House anticipating he would get a political contribution for his vote.A Republican from Swartz, McAllister spoke about the matter as an example of how “money controls Washington” and how work on Capitol Hill is a “steady cycle of voting for fundraising and money instead of voting for what is right.”
McAllister made the remarks during a Northeast Chapter of Louisiana CPAs gathering at the University of Louisiana-Monroe’s Alumni Center.
McAllister said he voted “no” on legislation related to the Bureau of Land Management though he did not identify the bill. McAllister said a colleague on the House floor told him that he would receive a $1,200 contribution from Heritage Foundation if he voted against the bill. He would not name his colleague since he “did not want to put their business out on the street.”

Truck-driving safeguards come into sharper focus

A deadly highway accident over the weekend left one person dead and actor Tracy Morgan critically injured, after a truck driver “failed to observe the slow-moving traffic ahead of him” in time to avoid a collision. The driver of a Wal-Mart truck reported swerved, but it was too late.
Though the crash is still being investigated and we don’t yet have all the relevant details, the awful accident coincides with a related policy debate underway on Capitol Hill over federal rules on truck safety.
As Melissa Jeltsen reported, “[T]he tragedy is likely to highlight a move by the Senate Appropriations Committee last week to undermine a federal regulation mandating truck driver rest.”
Last week, the committee passed an amendment that would suspend a requirement that truck drivers rest for at least 34 consecutive hours – including two nights from 1 a.m. to 5 a.m. – before beginning their next work week.
The so-called “restart” regulation was among a number of changes that took effect last summer with the aim of reducing driver fatigue.
The new rules also limit the maximum average work week for truck drivers to 70 hours, a decrease from the previous maximum of 82 hours, and require drivers to take a 30-minute break during the first eight hours of a shift.

For the sake of argument, let’s say that Mr. Sterling wins in court. What then? Things go back to normal? This isn’t even a battle worth winning. If Donald Sterling is the owner of the L.A. Clippers, the star players will leave, they’ll never sign another worthwhile free agent, the sponsors will flee, and the fans will boycott the team both at home and on the road.
But the crazy old man doesn’t care. He just wants to make this transition as miserable as possible…for everyone.

George Will: Focus On Rape Has Made ‘Victimhood A Coveted Status’

George Will on Friday became the latest conservative pundit to attempt to debunk sexual assault statistics, arguing that universities’ efforts to address campus rape have made “victimhood a coveted status.”
In a column for the Washington Post, Will argues that universities are basing their definition of sexual assault on a “Washington” education, which is leading to inflated statistics.
“They are learning that when they say campus victimizations are ubiquitous (‘micro-aggressions,’ often not discernible to the untutored eye, are everywhere), and that when they make victimhood a coveted status that confers privileges, victims proliferate,” he wrote.
Will offers an anecdote from a student at Swarthmore College, in which a woman reported a rape after a former sexual partner wouldn’t take no for an answer. Will implies that because the incident occurred “with a guy with whom she’d been hooking up for three months,” she wasn’t sexually assaulted.
“I just kind of laid there and didn’t do anything — I had already said no. I was just tired and wanted to go to bed. I let him finish. I pulled my panties back on and went to sleep,” the woman wrote about the encounter.
“Six weeks later, the woman reported that she had been raped,” Will wrote about the Swarthmore student. “Now the Obama administration is riding to the rescue of ‘sexual assault’ victims. It vows to excavate equities from the ambiguities of the hookup culture, this cocktail of hormones, alcohol and the faux sophistication of today’s prolonged adolescence of especially privileged young adults.”

Our capitalist class may be becoming an absolute danger to ordinary Americans. By promoting a doctrine of absolute right to gun ownership (which rather helps gun manufacturers) and at the same time encouraging people to hate the Federal government and resent paying taxes, they are creating a whole class of alienated far right shooters.
The American far Right, with its white supremacism, fascination with guns and explosives, profound hatred for the Federal government, poses the biggest terrorism threat in the country by far. Worse, they receive support from right wing media in the US because they hate taxes just the way the ultra-conservative media moguls doe. Although their attacks are ideological, directed at civilian victims and violent, they are seldom categorized as ‘terrorists.’ Rather what they do is “mass shootings.” In the meantime, plots hatched by Muslims in the US during the past few years appear almost always to be a form of entrapment by the FBI.
The right wing noise machine has even deflected blame from itself for whipping up anti-government sentiment by falsely alleging that most mass shooters are Democrats!
The Cliven Bundy stand-off with the Bureau of Land Management, in which Sean Hannity and other Fox luminaries strongly took Bundy’s side, brought out the crazies. At least one of the mass shootings in recent days has a connection to the Bundy incident and possibly more (Dennis Marx, like many militiamen who came to support Bundy, was a so-called ‘Sovereign Citizen.”

Obama administration to make push on American Indian voting rights
(Reuters) – Concerned that American Indians are being unfairly kept out of the voting process, the Obama administration is considering a proposal that would require voting districts with tribal land to have at least one polling site in a location chosen by the tribe’s government, U.S. Attorney General Eric Holder announced on Monday.
Holder said the Justice Department would begin consulting tribal authorities on whether it should suggest that Congress pass a law that would apply to state and local administrators whose territory includes tribal lands.

Associate Attorney General Tony West on Monday will expand upon Holder’s announcement in Anchorage, Alaska, where he will address a conference held by the National Congress of American Indians.
“Our proposal would give American Indian and Alaska Native voters a right that most other citizens take for granted: a polling place in their community where they can cast a ballot and receive voter assistance to make sure their vote will be counted,” West is expected to say, according a statement from the Justice Department.

Halle Berry reaches settlement on child support

LOS ANGELES (AP) — A judge has approved a settlement between Halle Berry and her ex-boyfriend over child support payments for their 6-year-old daughter.
The agreement approved by Superior Court Judge Scott Gordon on May 30 calls for Berry to pay ex-boyfriend Gabriel Aubry $16,000 a month or nearly $200,000 a year to support their daughter. The Oscar-winning actress will also pay for their daughter’s tuition, but the former couple will split health care expenses.
The order also calls for Berry to pay her ex-boyfriend a retroactive payment of $115,000 and $300,000 to his attorneys to cover the costs of their custody dispute.
