Witness #10: Lawrence O’Donnell destroys Bob McCulloch’s key witness

Bob McCulloch25Prosecutor Robert McCulloch singled out Witness #10’s testimony as the only witness to corroborate Darren Wilson’s defense claims that Michael Brown charged him and therefore he had no other choice but to kill him. But Witness #10 clearly changes his/her account of what he/she saw once inside the Grand Jury room. Why did he/she change their original statement? Was he/she offered any favors for their testimony? 16 people testified, under oath, Michael Brown had his hands up when fired upon. And witness #10 is Bob McCulloch’s key witness? I smell fish and it ain’t Friday!

Suspect testimony with witness #10 and a prosecutor with bias = a travesty. Charge Bob McCulloch with bias. This farce of a Grand Jury decision cannot be allowed to stand.

    For a week, the airwaves have been filled with news of the decision by the Ferguson grand jury not to indict Darren Wilson. Prosecutor Bob McCulloch gave a dramatic press conference. Wilson hit the interview circuit. Protesters filled the streets of West Florissant Avenue.

    But legally speaking, nothing has happened. We are in exactly the same legal position as before the prosecutors made their (extremely unusual) presentation to the grand jury.

    If McCulloch wanted to, he could present evidence in the case to a new grand jury and seek an indictment of Wilson. Although a constitutional protection known as “double jeopardy” says you can’t be charged with the same crime twice, the provision has not yet been triggered since Wilson was never charged.

    Of course, McCulloch would never pursue new charges because — as he made clear in his press conference — he vehemently believes Wilson is innocent. It is McCulloch’s vocal allegiance to the defendant that has cause many legal experts to question the process.

    So in order for the evidence to be presented to a new grand jury, a new prosecutor would have to be appointed. Missouri Governor Jay Nixon has the power to appoint a special prosecutor for the case. But Nixon, through a spokesman, said he would not appoint one. Most people have treated this as the end of the story.

    It’s not.

    There is a provision of Missouri Law — MO Rev Stat § 56.110 — that empowers “the court having criminal jurisdiction” to “appoint some other attorney to prosecute” if the prosecuting attorney “be interested.” (The term “be interested” is an awkward legal way to refer to conflict-of-interest or bias. The statute dates from the turn of the 20th century.)

    The court with jurisdiction over Darren Wilson’s case is the 21st Judicial Circuit Court of Missouri. That means the power to appoint a special prosecutor is held by Maura McShane, the Presiding Judge of the 21st Circuit.

    It has been one week since a St. Louis County grand jury failed to indict Officer Darren Wilson for shooting Michal Brown, an unarmed teenager, six times in the head, chest and arms. Communities nationwide have responded to the miscarriage of justice by carrying out more than 150 sustained, coordinated and intense protest actions that show no signs of letting up. Primarily led by young people of color, the continued sit-ins, highway shutdowns and walkouts have commanded the White House’s attention.

    Today President Barack Obama, Vice President Joe Biden and Attorney General Eric Holder met with seven Black and Latino organizers – from Ferguson, Mo.; Columbus, Ohio; Miami, Florida; and New York City – who have been leading some of the ongoing actions to disrupt a status quo that is intolerable.

    “The president requested this meeting because this is a movement that cannot be ignored,” said Ashley Yates, a co-founder of the St. Louis-based organization, Millennial Activists United. “We have two sets of laws in America – one for young Black and Brown people, and one for the police. We are sick and tired of our lives not mattering, and our organized movement will not relent until we see justice.”

    The young leaders conveyed the experience of a traumatized community in Ferguson, where police have terrorized peaceful protesters with pointed guns, rubber bullets, chemical agents, bean bags and menacing threats. They further discussed the routine harassment and violence that many police departments inflict on countless communities of color across America, and their demands for the federal government to hold police departments that use excessive force accountable.

      Finally, a good decision from the NFL.

      The St. Louis Police Officer’s Association might take a look at the demographics of the Rams’ roster the next time they make such a request. Or the roster of any NFL team.

      Cop organizations think they are all-powerful, that they have influence that far exceeds what they really have, and that they deserve all kinds of respect they haven’t earned. It takes a lot of nerve to make this request of the NFL, in my opinion.

        I read that the civil lawsuit will be filed very soon and I’ll look for the link. He’ll lose that one. His comments about Mike being a demon won’t sit with anyone on a jury. AND all the witnesses and evidence get in. Since it’s a preponderance of the evidence and not a reasonable doubt, he’s done.
