BALTIMORE — A prisoner sharing a police transport van with Freddie Gray told investigators that he could hear Gray “banging against the walls” of the vehicle and believed that he “was intentionally trying to injure himself,” according to a police document obtained by The Washington Post.

HOUSTON (AP) — Former Florida Gov. Jeb Bush declared Wednesday that 11 million immigrants in the country illegally should have an opportunity to stay, wading yet again into his party’s contentious immigrant debate.
In tone and substance, Bush stands out among the many Republicans lining up for the GOP’s next presidential primary, where conservatives who oppose an immigration overhaul often hold outsized influence. As he moves toward a presidential campaign, the brother and son of former presidents has not backed away from his defense of immigrants in the country illegally and a policy that would allow them to attain legal status under certain conditions.
“We’re a nation of immigrants,” Bush said at the National Christian Hispanic Leadership Conference that brought several hundred Hispanic evangelical leaders to Houston this week. “This is not the time to abandon something that makes us special and unique.”
The thing is, it costs Jeb nothing to make statements like this, and may win him some votes from the Latino community, who are overwhelmingly opposed to most Republicans. (At least, from those Latinos naïve enough to believe Jeb is being sincere.) But Bush is pandering, pure and simple, and if he were to become president nothing would change in the GOP’s stance toward immigration reform.

GOP unveils budget deal that seeks repeal of ObamaCare
House and Senate Republicans on Wednesday unveiled a budget deal that aims to torpedo ObamaCare while balancing the federal books within 10 years.
The deal would approve more than $5 trillion in spending cuts over a decade, and seeks to use the budget procedure known as reconciliation to send a repeal of the healthcare law to President Obama’s desk.
The budget also sticks to the $1.017 trillion sequestration budget ceiling for 2016, and boosts military spending through an infusion of cash to the war fund.
Sen. Bob Corker (R-Tenn.) had delayed the release of the deal since Monday because of provisions he described as “gimmicks” that deal with changes in mandatory programs. Herelented on Wednesday and signed the agreement.
The deal reconciles the rival budget blueprints passed by the House and Senate, and will not require a signature from President Obama. If adopted, it will be the first Republican budget agreement in a decade.
…Republicans have remained united behind the push to repeal ObamaCare through reconciliation, something that conservatives began to demand after the GOP won control of Congress last year.
While the reconciliation process is difficult, legislation produced under the process cannot be filibustered in the Senate, effectively removing the power of Democrats to block it…

Mind-Boggling Budget

The bad news is that House and Senate Republican negotiators have reached agreement on the outlines of a FY 2016 budget resolution that would include $5 trillion in spending cuts over ten years—just what our fragile economic recovery needs—though some defense spending cuts would be rescinded through the back door of emergency or contingency funds. Since the resolution does not include a House-passed Medicare voucher proposal long supported by Paul Ryan, that $5 trillion would almost have to cut means-tested entitlements and domestic discretionary programs by some just unimaginable amounts.
The good news is that this is simply a resolution, and that any subsequent reconciliation bill to implement it could and would be vetoed by the president.
I’m guessing that most news coverage of this development will focus on the least relevant aspect of this resolution—yet another statement of intent to repeal and replace the Affordable Care Act. (It’s unclear from The Hill’s description if there’s any evidence of a contingency funding of health care purchasing subsidies if SCOTUS decides for the plaintiffs in Burwell v. King).
But before you brush the whole thing off as a nothing-burger, remember that this bill is a pretty good example of what we can expect to actually happen if Republicans hang onto control of Congress and win the White House next year. Reconciliation bills cannot be filibustered, and a whole lot can happen really fast.

Clinton eyes the end of ‘the era of mass incarceration’

We’ve grown quite accustomed to thinking about Hillary Clinton’s presidential campaign, but the truth is she’s only been an official candidate for about two weeks. In that time, the Democrat has begun to sketch out some policy goals and priorities, but the former Secretary of State hasn’t spoken to the media much and she hasn’t given any major speeches on any subject.
That changed today, when the Democratic frontrunner tackled one of the nation’s most pressing challenges. Alex Seitz-Wald reported this morning on Clinton’s remarks at a policy forum at Columbia University, where she “made it clear that criminal justice reform will be a priority of her campaign.”
Clinton began by addressing the violence in the streets of Baltimore this week following the funeral of Freddie Gray, a 25-year-old black man who died from injuries sustained while in police custody. The “violence has to stop,” she said, but Clinton also acknowledged that it came in response to legitimate grievances.
Ticking off the names of African Americans who have been killed by police in the past year, Clinton said the “patterns have become unmistakable and undeniable.”
And citing statistics illuminating the disproportionate policing burden borne by black men, she said something is “profoundly wrong” with our criminal justice system. “Everyone in every community benefits when there is respect for the law and when everyone in every community is respected by the law,” she continued.
Noting a familiar statistic – the United States has nearly 25% of the world’s prison population, but only 5% of the world’s overall population – Clinton said this morning, “It’s time to change our approach. It’s time to end the era of mass incarceration. We don’t want to create another incarceration generation.”

Late last year, Pope Francis said he intended to invest considerable energy in 2015 urging Catholics around the globe to help combat climate change. He wasn’t kidding.
The pope, joined by U.N. Secretary-General Ban Ki-moon, hosted a summit on the issue yesterday, and the name of the gathering was itself intended to get attention: “Protect the Earth, Dignify Humanity: The Moral Dimensions of Climate Change and Sustainable Development.” The event organized panels on relevant “scientific, moral and economic issues” surrounding global warming.
All of this is designed to coincide with ongoing international talks, but also the summer release of Francis’ encyclical on the climate crisis. The New York Times reported yesterday that the pope’s activism is “alarming some conservatives in the United States who are loath to see the Catholic Church reposition itself as a mighty voice in a cause they do not believe in.”
In the United States, the encyclical will be accompanied by a 12-week campaign, now being prepared with the participation of some Catholic bishops, to raise the issue of climate change and environmental stewardship in sermons, homilies, news media interviews and letters to newspaper editors, said Dan Misleh, executive director of the Catholic Climate Covenant in Washington.
But the effort is already angering a number of American conservatives, among them members of the Heartland Institute, a libertarian group partly funded by the Charles G. Koch Foundation, run by the billionaire industrialist Koch brothers, who oppose climate policy.
While Koch-financed operations usually aren’t shy about taking the offensive against perceived opponents, the far-right Heartland Institute seems to realize attacking the pope is a little more complicated.
In a statement, the group’s president said he fears the “Holy Father is being misled,” despite Francis’ heart being “in the right place.”
Yes, the politics of climate denial are getting a little tricky. In a few months, this will get a little more complicated.
In September, at the invitation of House Speaker John Boehner (R-Ohio), the pope will deliver an address to a joint session of Congress. How likely is it that Francis will address the climate crisis Boehner and his caucus choose to ignore? The odds are about 100%.
“I think Boehner was out of his mind to invite the pope to speak to Congress,” the Rev. Thomas Reese, an analyst at the National Catholic Reporter, told the Times. “Can you imagine what the Republicans will do when he says, ‘You’ve got to do something about global warming’?”
As for the Koch-backed groups and others in the oil industry, Rebecca Leber explained this week that their goal, at least for now, is trying to argue that they, and not the pope, are truly committed to helping the world’s downtrodden.

Robin Buck remembers how excited he was when he was first approved for a state grant to fix his flooded, Long Branch, NJ, home.
“It’s like hitting the lottery!” he said. “I was telling everybody. It was the best thing that ever happened to me, and that’s the truth. They were going to lift my home, and they’re paying me to do so? That is great!”
After spending $43,000 on repairs to make his house livable, he signed his grant paperwork last fall, then disconnected the utilities, handed over his keys and moved out in early November so his state-appointed contractor could raise his home to protect it from future storms. The whole process, he was told, would take less than 90 days.
After Thanksgiving, as temperatures began to drop, Buck made several phone calls and sent emails to his caseworker to ask who would be responsible for winterizing his home.
“They were like, ‘Oh yeah. We’re going to come right out. I’ll have a guy out there Friday. Don’t worry about nothing,’” he recalled. “So I never paid no mind to it. I thought everything was taken care of.”

In theory, Florida Gov. Rick Scott (R) finds himself in a pretty good position. He somehow won a second term last fall, and the far-right Republican governor is governing alongside a state legislature run by his own party. Putting aside whether his agenda has merit, Scott should find it easy to do as he pleases.
It’s just not working out that way.
Florida’s Legislature collapsed into chaos Tuesday as the House unilaterally ended the annual session with more than three days left, leaving dozens of major bills dead and escalating tensions between the House and Senate over their healthcare stalemate. […] It marked the first time in Florida’s modern history that one chamber shut down and went home on a different day than the other in a regular session.
At the heart of the dispute is, of all things, the Affordable Care Act. The Republican-run state Senate wants to accept Medicaid expansion, bolster state finances, extend coverage to 850,000 low-income Floridians, and clear the way for another tax cut. The Republican-run state House, meanwhile, wants to oppose “Obamacare” because, well, it’s “Obamacare.”
It sounds like the sort of thing some gubernatorial leadership might help resolve, but Rick Scott’s attention yesterday wasn’t on the legislature, per se. Rather, the governor had the courts on his mind.
Gov. Rick Scott followed through Tuesday on his promised lawsuit against the federal government over its threat to withhold hospital charity-care funding if Florida doesn’t expand Medicaid. […] His office announced the filing shortly after the Florida House of Representatives adjourned its legislative session ahead of schedule, amid its budget stalemate with the Senate over healthcare.
Jonathan Cohn recently described the ridiculous lawsuit as a “tantrum,” and it’s worth understanding why.
As we discussed when the governor first announced his plan to file the case, back in 2006, the Bush/Cheney administration created a Medicaid pilot project intended to provide funds to help hospitals treat the uninsured. The policy was called “Low Income Pools” (LIP) and Florida received some money through the initiative.

Jordan Davis Documentary Gets New Title, New Poster 2 New Clips + Theatrical Release Dates Set

HBO took U.S. television rights to director Marc Silver’s “3 1/2 Minutes,” after its premiere in documentary competition at the Sundance Film Festival this year. And now Participant Media has announced a limited theatrical release of the acclaimed and timely feature documentary, which is now going to be titled “3 1/2 Minutes, Ten Bullets,” opening on June 19th, 2015 in New York, and then on June 26th, 2015 in Los Angeles.
The film chronicles the story of Jordan Davis, the unarmed black 17-year-old, who was shot to death at a Florida gas station by a white fellow customer, Michael David Dunn. “3 1/2 Minutes” explores the aftermath of Jordan’s tragic death, the latent and often unseen effects of racism, and the contradictions of the American criminal justice system.
HBO will air the film in the fall, after its theatrical run.

Wendell Pierce Will Play Clarence Thomas Opposite Kerry Washington’s Anita Hill in HBO’s ‘Confirmation,’ Directed by Rick Famuyiwa

Announced early last month, Kerry Washington will star in a scripted movie based on the Anita Hill/Clarence Thomas Supreme Court hearings, titled “Confirmation,” which is set up at HBO.
Washington is of course going to play Anita Hill, as well as executive produce the telepic, which will be penned by Academy Award nominated writer Susannah Grant (“Erin Brockovich”), and will be produced by Groundswell Productions in association with ABC Signature Studios.
As for who will direct, Rick Famuyiwa, fresh off his hit Sundance movie “Dope,” who was previously in contention for the job, has now officially signed on, and will indeed direct the film for HBO.
As for the actor who will play Clarence Thomas, The Hollywood Reporter says that it’ll be Wendell Pierce – whose name some of you mentioned as a candidate, in previous posts on how the project would/should be cast.

NFL to give up tax-exempt status

The multi-billion dollar National Football League has enjoyed tax-exempt status – as a trade organization – for decades, which has occasionally drawn scrutiny from federal officials. But six months ago, in the wake of player arrests and allegations of league indifference, pressure on the NFL reached new levels of intensity in D.C.
As it turns out, federal action won’t be necessary after all.
In a dramatic move long called for by critics of professional football, NFL Commissioner Roger Goodell announced Tuesday that the league was giving up the tax exempt status it has enjoyed since 1942.
All 32 NFL teams currently pay their own taxes as privately owned businesses. Goodell called the league’s exemption a “distraction” and notified all the teams in a letter that the NFL would file a return as a taxable entity in the 2015 fiscal year.
It’s worth clarifying that professional football has never been an entirely tax-exempt enterprise, but the NFL itself has been organized as a 501(c)(6) tax-exempt organization. which in turn has allowed the league “to avoid owing taxes on certain activities.”
It’s this tax benefit many have hoped to change. Sen. Maria Cantwell (D-Wash.) unveiled a proposal last year to strip the NFL of its tax-exempt status at least in part because of the Washington team’s offensive mascot name. Soon after, Sen. Cory Booker (D-N.J.) and others targeted the NFL’s tax status in the wake of domestic-violence scandals and the league’s often-ridiculous handling of the incidents.

Supreme Court sounds skeptical note on marriage equality

Experienced court watchers tend to agree: predicting the outcome of Supreme Court cases based solely on oral arguments is problematic. Justices often play devil’s advocate; they think out loud from the bench; and they challenge attorneys on points they already find persuasive, just to see how they’ll respond.
That said, many who heard this morning’s arguments in Obergefell v. Hodges came away with the impression that the high court’s conservatives were skeptical of marriage equality. NBC News’ Pete Williams reported:
The conservatives were joined by Justice Anthony Kennedy, considered a swing vote, who asked whether the public and scholars need more time to debate changes to a practice that has been understood as between a man and a woman for centuries.
“It’s very difficult for the court to say, ‘We know better,’” Kennedy told Mary Bonauto, a lawyer representing same-sex couples, according to The Associated Press.
This is no small detail. Kennedy, considered the key swing justice in this case, reportedly emphasized historical norms, suggesting that proponents of marriage equality want to change an institution that has lasted for a “millennia.”
Chief Justice John Roberts, whom progressives also hoped to persuade, stressed a similar point, reportedly telling supporters of equal-marriage rights, “If you succeed, [the traditional definition of marriage] will not be operable. You are not seeking to join the institution. You are seeking to change the institution.” He added, “[I]f you prevail here, there will be no more debate. The debate will close minds, and it will have consequence on how this new institution is accepted.”
