Affordable Care Act survives Supreme Court challenge. A divided Supreme Court ruled all qualified Americans may receive subsidies that make insurance affordable, regardless of where they live. The Supreme Court held in a 6-3 decision that the Affordable Care Act authorized federal tax credits for eligible Americans living not only in states with their own exchanges but also in the 34 states with federal exchanges. The ruling is a major win for the Obama administration.

Justices agree with Obama administration; subsidies should be available to all

By a 6-3 vote, a divided court affirmed an Internal Revenue Service ruling that the subsidies should be available not only in states that have set up their own health insurance exchanges, but also in states where consumers rely on the federal government exchange.

    About an hour after the Supreme Court agreed with him on the Affordable Care Act, President Obama appeared in the Rose Garden to briefly address the ruling. As msnbc’s David Taintor reported, the president made clear that the health care reform law is “here to stay.”

    “The point is, this is not an abstract thing anymore,” Obama said in a statement from the White House’s Rose Garden. “This is not a set of political talking points. This is reality. We can see how it is working. This law is working exactly as its supposed to. In many ways, this law is working better than we expected it to.” […]

    “This was a good day for America,” he concluded. “Let’s get back to work.”
    If you watch the video, note the pause between those last two phrases. I got the sense “Let’s get back to work” was a phrase that wasn’t in the prepared text – it was, in effect, Obama’s way of saying policymakers should move past the cheap shots and pointless charades, and instead engage in some actual, constructive work.

    Also note the degree to which the president’s remarks seemed understated. Those who expected Obama to spike the football or come out and do mic-drop might have been disappointed – it was almost as if he assumed consumers would win the case, so there wasn’t any point to over-the-top celebration.

    I was also struck by the president’s emphasis on the real winners today: it’s just not his administration that prevailed; it’s “a victory for hardworking Americans all across this country whose lives will continue to become more secure in a changing economy because of this law.”

    …But today’s victory may have been even more decisive than it looks at first glance.

    It isn’t just that the Court ruled six-to-three in favor of the government’s position, with John Roberts and Anthony Kennedy joining the Court’s liberals in support of a single, non-splintered decision, though that’s important.

    It’s also that Roberts’ opinion may have precluded any future efforts by a Republican president to use executive discretion to cancel the subsidies for the millions of people on the federal exchange. This option might have been left open if the ruling had been written differently.

    Such good news today. The affirmation on the ACA has a very personal meaning for our family. Our precious grandson, Eric, was born with a condition called macrodactylism….he had two big toes. The regular big toe, and the second one. As you can imagine, this is a condition that needs to be corrected. Fortunately, they live in Texas, so they were eligible for totally FREE surgery at the Scottish Rite orthopedic hospital.

    Eric had this surgery when he was 15 months old. He was in a cast from his toe to his hip for six weeks. When the cast was taken off, his leg and foot were beautiful and straight, with four toes on his left foot.

    This is what would have been a preexisting condition that would have prevented him from getting health insurance the rest of his life, if not for the ACA. I finally wrote President Obama today and thanked him for fighting for this and told him about Eric. One of the commentators on MSNBC said not everyone is affected by this, so not everyone is cognizant of its benefits. Well, every woman knows, everyone with a preexisting condition knows……again, he’s talking about privileged white males who are not aware of the benefits. But, oh well…..

    Also so glad for the ruling on housing in Texas, and the passage of the TAA…….will these people never stop declaring PBO dead???!!!!

    They won’t admit it, but Republicans dodged a healthcare bullet

    They would never admit it. Ask any Republican in Washington – or in any gubernatorial office, for that matter – and they’ll express on-the-record disappointment that President Obama won big today at the U.S. Supreme Court.

    But let’s be clear about the broader dynamic: Democrats aren’t the only ones breathing a sigh of relief this morning.

    Heading into this morning, some basic policy truths were clear. We knew, for example, that congressional Republicans have made no progress in creating an alternative to the Affordable Care Act – despite more than five years of broken promises – and in all likelihood, they never would.

    We also knew that most of those who would suffer from a plaintiff victory in King v. Burwell would be middle-income families in red states who would naturally look to their GOP representatives for help. Those same representatives would face enormous pressure from right-wing institutions to let the American health care system burn and treat affected families like collateral damage in a political war.

    And then there were the Republican governors – some of whom also happen to be presidential candidates – who would have been under pressure to create exchange marketplaces in their states to prevent constituents from suffering. Of course, those same governors would have simultaneously faced equal pressure from partisans and ideologues to do exactly nothing.

    After Supreme Court Chief Justice John Roberts upheld the constitutionality of “Obamacare” three years ago, many conservatives deemed him a “traitor” to his ostensible Republican allies, and I suspect there will be plenty of similar rhetoric today. But the truth remains that Roberts just did the GOP an enormous favor – had the court created systemic chaos, and scrapped benefits for millions of red-state families, Republicans would have confronted an incredible mess they were woefully unprepared to clean up. Worse, there’s a big election coming up, and the GOP was poised to be on the hook for hurting a lot of people out of nothing but spite.

    Justice Thomas defends racist housing practices by pointing out the NBA is mostly black

    The Supreme Court on Thursday saved the Fair Housing Act of 1968’s protections against housing discrimination based on race, color, religion, sex, or national origin. But not every justice was happy with the decision. Take, for example, Justice Clarence Thomas’s dissent, in which he defended racist housing practices by pointing out that the National Basketball Association (NBA) is mostly black:

    Racial imbalances do not always disfavor minorities.… And in our own country, for roughly a quarter-century now, over 70 percent of National Basketball Association players have been black.

    Supreme Court upholds Affordable Care Act

    The U.S. Supreme Court ruled in the Obama administration’s favor this morning in a 6-3 ruling. Chief Justice John Roberts wrote the ruling for the majority, and was joined by Justices Kennedy, Ginsburg, Breyer, Sotomayor, and Kagan.

    This post will be updated shortly (and repeatedly).

    First Update: The full ruling is available online here.

    Second Update: Justices Scalia, Alito, and Thomas were in the minority. Scalia, apparently annoyed that both Republican challenges to the Affordable Care Act have now failed, wrote in the dissent that he’s inclined to start calling the law “SCOTUScare.”

    Third Update: Note, Roberts wrote the ruling in June 2012 – exactly three years ago tomorrow, in fact – that upheld the constitutionality of the health care reform law. In today’s decision, the Chief Justice noted, accurately, ”Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them.”

    Fourth Update: In the majority ruling, Roberts acknowledges the ambiguity of the offending phrase, but wrote, “In this instance, the context and structure of the Act compel us to depart from what would otherwise be the most natural reading of the pertinent statutory phrase.” This is, of course, how American jurisprudence is supposed to work – the idea of gutting a massive law by examining half a sentence out of context is absurd.

    President Barack Obama recalled all the hurdles the Affordable Care Act has cleared in order to survive as he praised the Supreme Court’s decision today to uphold the subsidies in his signature health care law.

    “The Affordable Care Act is here to stay,” Obama said from the White House.

    “Americans would have gone backwards and that’s not what we do, that’s not what America does, we move forward.”

    When I heard about this, all I could say is, “God is good!” over and over again. I can’t help but notice that although GOP/TPers constantly talk about God, it seems he favors PBO more than he does them. They’re breathing a huge sigh of relief today because they didn’t have a viable Plan B. Ron Johnson was floating a temporary extension of the subsidies until 2017, which was meant to “see” the GOP/TPers through the November 2016 elections. Everything the GOP/TP critters in Congress do is meant to serve their own political purpose(s.) They’re some of the most immature, selfish b*st*rds I’ve ever seen.

    Just wanted to leave this hear too.

    Thanks for the positive thoughts, folks.

    I’m fully employed now and I’m thankful.

    But, that time when I wasn’t working, one of the things constantly on the mind was healthcare. Living in that state of uncertainty….your mind can never be settled.

      Rikyrah, the anxiety, the uncertainty you expressed is very real. me and my husband have been there. You do everything possible to get a job, take care of you & your family.

      This is about having backup, savings, family, compassion, until we get back on our feet.
      You pay taxes, there is no crime in accepting government assistance when needed.

      You have earned it!

      PBO knows this, FLOTUS knows this. They have lived the life of uncertainty in which you speak. Nothing was handed to them. That bootstrap bullshit the GOP & other wingers spew is filled with selfishness & greed. These folks came from wealth or have accumulated wealth by clawing, kicking, and stealing from the very system they detest.

      That’s why I’m glad Elena Kagan stopped recusing herself from certain cases. It was ridiculous that while she tried to adhere to the conflict of interest rules because of her stint as Solicitor General, Clarence Thomas refused to, and instead kept running a hustle with his wife Ginny. Ginny brought home millions in lobby dollars, Clarence sat on the Supreme court ruling in favor of his wife’s clients.
