    A Black Lives Matter group in Minneapolis said Monday it will not be intimidated by a lawsuit filed by the Mall of America against their activists ahead of a planned protest that could disrupt the busiest shopping day of the holiday season in the nation’s largest shopping mall. Members of the group, which planned to rally at the mall Wednesday to protest the death of Jamar Clark, a 24-year-old black man shot by Minneapolis police last month, received letters last Friday warning them that they could face arrest and other legal action if they proceeded with the demonstration, the Minneapolis Star Tribune reported.

    The Mall of America in Bloomington, Minnesota, which boasts 2.5 million square foot of retail space and sees approximately 42 million visitors annually, sought a temporary restraining order against the activists to prevent Black Lives Matter from protesting. Mall officials also said they want activists to post a message on social media declaring the protest canceled, according to the lawsuit.

    Clifford Cain Jr., a retired electrician in Baltimore, was used to living on a tight budget, carefully apportioning his Social Security and pension benefits to cover his rent and medication for multiple sclerosis.

    So Mr. Cain was puzzled when he suddenly could not make ends meet. Months later, he discovered why: A debt collector had garnished his bank account after suing him for about $4,500 the company said he owed on an old debt.

    Mr. Cain said he never knew the lawsuit had been brought against him until the money was gone. Neither did other Baltimore residents who were among the hundreds of people sued by the collector, Midland Funding, a unit of the Encore Capital Group, in Maryland State Court. Some of them said they did not even owe any money, or their debt had long expired and was not legally collectible, according to a review of court records.

    In any case, the Encore subsidiary was not licensed to collect debt in Maryland.

    Yet when Mr. Cain brought a class action in 2013 against Midland Funding, the company successfully fought to have the lawsuit dismissed.

    If the plaintiffs wanted to try to recover their money, they would have to do so in private arbitration. And because class actions are banned in arbitration, Mr. Cain and the others would have to fight the unit of Encore — one of the largest debt buyers in the country with vast legal resources — one by one.

    “I can’t for the life of me understand how this is allowed to happen,” said Mr. Cain, who could not afford to pursue his case alone in arbitration.

    In short, Encore and rival debt buyers are using the courts to sue consumers and collect debt, then preventing those same consumers from using the courts to challenge the companies’ tactics. Consumer lawyers said this strategy was the legal equivalent of debt collectors having their cake and eating it, too.

    The use of arbitration by the companies is the latest frontier in a legal strategy orchestrated by corporations in recent years. By inserting arbitration clauses into the fine print of consumer contracts, they have found a way to block access to the courts and ban class-action lawsuits, the only realistic way to bring a case against a deep-pocketed corporation.

    Their strategy traces to a pair of Supreme Court decisions in 2011 and 2013 that enshrined the use of class-action bans in arbitration clauses.

    Presidential scholars have a term to describe the typical experience of a chief executive who wins re-election to the White House. It’s called the “second-term curse.” There’s evidence for it. Midway through their second terms, George W. Bush suffered Hurricane Katrina and the Iraqi quagmire, Bill Clinton was impeached, Ronald Reagan was staggered by the Iran-contra scandal, and Richard Nixon was run out of town.

    At the risk of jinxing our current president with one year left to go, he appears to have broken the curse.

    Not everything has been smooth sailing. His party lost the Senate in the 2014 midterms. He failed to pass gun control despite a series of tragic shootings. His immigration executive actions are tied up in court. He has yet to arrest the threat of ISIS or resolve the underlying crisis of the Syrian civil war.

    But Obama, unlike all of his second-term predecessors in the last 40 years, has not been knocked off course by scandal. Even if something truly awful happens in his last year, he has already been able to pocket several significant wins that will burnish his legacy.

    The Establishment Needs to Get Its Act Together

    The fate of nations ultimately rests of the quality of their political establishment, and it often matters more, in the end, what a Talleyrand or Kissinger actually does than even what a monarch or dictator or president might think at any given time. The character of a people probably matters less than the leadership they produce, and since the leadership’s control of information makes them largely responsible for the opinions and passions of the people, what they choose to “teach” the people is largely determinative of the people’s character.

    Representative government is less some magic way of overcoming these dynamics than a way for there to be some accountability and self-correction in the system. It’s also much easier to govern when the governed consent to be governed, and the more consent you can generate, the more freedom, rights and security the establishment can provide. In any nation or political society, there is a system of laws and norms that more or less perfectly provide for freedom, rights, and security, and when the system malfunctions, the consent begins to disappear. When dissent arises, security is diminished and it becomes necessary to chip away at rights and freedoms to restore it, if possible. In an extreme case, civil war is required to restore consent and therefore security and thereby freedoms and rights. In less extreme cases, a goodly dose of repression and brutality and terror can manufacture consent, but it does so by giving up on providing freedom, rights, or the true security that comes with the ability to express your real conscience.

    We used to see the latter situations in places like Libya, Iraq, and Syria, and now we see the former.

    Keep this in mind when reading Jeff Greenfield’s piece in Politico about the Republican establishment bolting the party if Donald Trump is the nominee to back a third-party candidate. Greenfield has talked to many people who are accustomed to providing leadership to the nation not through any formal arrangement whereby the people selected them as representatives, but more as individuals with the money and connections that confers actual power. These aren’t just kingmakers in the traditional sense, and their predicament is partly that they seem to have lost their kingmaking ability. More importantly, they are part of a class of people whose opinions shape what actually happens when the government has to make big decisions. We might wish that these people didn’t exist, but they always do, in every society. And, if they’re a rotten lot of selfish short-sighted bastards, national ruin is likely to follow in short order. If, on the other hand, they have wisdom and generosity of heart, they are likely to steady the ship of state.

    On the right, the establishment in this country is trying to come to terms with the fact that the Republican Party seems increasingly poised to nominate someone who it would simply be irresponsible to make president of the United States. And, as greedy and short-sighted as they may be, and as much responsibility for their own predicament as they may have, they aren’t prepared to argue that Donald Trump would be an acceptable leader.

    As Greenfield points out, Trump’s Republican opponents have called him everything from “unhinged” to a “drunk driver” to “a cancer on conservatism.” The word “fascist” is being used to describe Trumpism with increasingly frequency, and just as often on the right as on the left.

    A would-be assassin attempted to gun down a witness who agreed to testify against police officers in Detroit, a report revealed this week.

    The Detroit News obtained court records on Monday that indicated the lives of several witnesses had been threatened days after they agreed to testify against Detroit narcotics officers Lt. David “Hater” Hansberry and Bryan “Bullet” Watson.

    Hansberry and Watson have been accused of using fake traffic stops to steal drugs, money and other property. Prosecutors said that the officers distributed stolen cocaine to known drug dealers who then agreed to split the profits with them.

    A new web series on Vimeo has been launched this month called “The New Stereotype: The Reclaim” which aims to change the perception of black men in the media.

    Conceived by Harlem based Marquelle Turner-Gilchrist, who is an assistant buyer for a luxury fashion company, he says that he came up with the idea for the series to “show the diversity and strength of black males”.

    He then reached out to friends and others willing participants through social media to be a part of the project, and created it to be all inclusive, taking into account skin tones, fashion styles, careers and backgrounds from all over the world, such as Ghana, the Virgin Islands, North Carolina, Brooklyn, New Jersey, and Georgia.

    The result is basically a fashion show for young, successful, upwardly mobile brothers (or “dandies” as I call them) who are eager to show a different image from the sagging pants and gold teeth that the media offers too often..

    To be titled “Shuffle Along, or, the Making of the Musical Sensation of 1921 and All That Followed,” the show will have a story by George C. Wolfe, who will also direct, with choreography by Savion Glover, who last worked together with Wolfe on the 1996 hit “Bring in ‘da Noise, Bring in ‘da Funk.”

The drama is based on a true story that revolves around a black father whose wife suffers from a crack cocaine addiction, and his efforts to protect his 10-year old daughter from having to experience life as the child of a drug addicted mother, while also trying to help her (the mother/his wife) become clean again. Set in Philadelphia, at the very onset of the crack epidemic, the drama stars Hill Harper, Sharon Leal, Bokeem Woodbine, Lala Anthony, Quinton Aaron, with Wayne Brady and Ruby Dee.     During Saturday night’s Democratic debate, Sec. Hillary Clinton at one point alleged,
    “And we also need to make sure that the really discriminatory messages that Trump is sending around the world don’t fall on receptive ears. He is becoming ISIS’s best recruiter. They are going to people showing videos of Donald Trump insulting Islam and Muslims in order to recruit more radical jihadists. So I want to explain why this is not in America’s interest to react with this kind of fear and respond to this sort of bigotry.”
    Trump on Sunday denied that any such Daesh (ISIS, ISIL) video exists, and said of Clinton, “she lies like crazy.”
    But Sec. Clinton did not say that Daesh had made videos featuring Trump. She said that they were simply showing people Islamophobic Trump videos.
    That is, Sec. Clinton is maintaining that the Trump campaign videos or his appearances on television reproduced at YouTube are so offensive to Muslims that he has relieved Daesh of the labor involved in making recruiting videos.
