The Standing Rock Sioux Tribe will keep fighting the controversial Dakota Access Pipeline after a federal court rejected its request to halt construction on the project, which the tribe says would destroy some of its sacred sites, the tribe’s chairman told NBC News on Sunday night.
In a two-page ruling, the U.S. Court of Appeals for the District of Columbia Circuit rejected the tribe’s request for a permanent injunction to block the $3.7 billion, 1,170-mile pipeline, which would transport 470,000 barrels of oil a day across four states. The pipeline would run within a half-mile of the tribe’s reservation, which straddles the North and South Dakota border.
The ruling allows Energy Transfer Partners — the Dallas-based company funding the project — to move forward with construction of the pipeline on all privately owned land up to the Missouri River. Construction had been halted by a temporary injunction issued in late August, which prohibited construction 20 miles east and west of the river, the tribe’s main water source.
Tribal Chairman Dave Archambault II called the ruling “disappointing,” but he told NBC News: “We aren’t done with this fight.”
For months, thousands have joined more than 300 federally recognized American Indian tribes at Cannon Ball, N.D. — the site of the Oceti Sakowin Camp — to protest the pipeline.
The protests forced a halt in construction in late August after the Standing Rock Sioux sued the U.S. Army Corps of Engineers, which has jurisdiction over the land, arguing that it did not adequately consult with them before granting Energy Transfer Partners fast-track approval in July, as required under the National Historic Preservation Act.

Haiti: Hurricane Death Toll Tops 1,000 as Cholera Spreads

In Haiti, the death toll from Hurricane Matthew has topped 1,000 as the country battles a growing cholera epidemic and authorities dig mass graves for those killed by the Category 4 storm. U.N. officials said nearly 1 million people are in urgent need of humanitarian assistance, with up to 80 percent of Haiti’s food crops destroyed in some areas. Aid agencies say at least 60,000 people are staying in temporary shelters. Survivors reported drinking well water contaminated by dead livestock. At least 13 people have died of cholera, after floodwaters mixed with sewage. Haiti’s ambassador to the U.S., Paul Altidor, said there are fears of a growing epidemic.
Paul Altidor: “Cholera was an issue that Haiti was dealing with, has been dealing with in the past few years. So, in light of what just took place over the past few days, yes, cholera and other health issues may be on the rise.”

Pro-Kirk super PAC shows how mega-donors avoid spending caps
WASHINGTON – A super PAC created specifically to bolster Sen. Mark Kirk’s GOP re-election bid is a stark example of how mega-donors legally skirt federal caps on individual contributions.
Fueled by jumbo donations, the Independent Voice for Illinois super PAC has spent more than $1 million in negative television ads attacking Kirk’s Democratic opponent, Rep. Tammy Duckworth.
Independent Expenditure committees, also known as super PACs, are allowed to legally advocate for the election or defeat of a candidate as long as there is no cooperation or consultation with the campaign itself.
Individuals giving to House, Senate and presidential campaigns are capped at $5,400 per cycle — $2,700 for the primary, $2,700 for the general election contest. Super PACs can take in unlimited amounts of cash.
To get around these donation caps, Kirk allies, planning ahead, founded the Independent Voice for Illinois, filing a statement of organization with the Federal Election Commission on Feb. 12, 2015.
As of June 30, the latest FEC report, the largest donors to Independent Voice are two of the biggest Republican donors in the nation.
Chicago’s Ken Griffin, the founder of the Citadel financial services firm, pumped $350,000 into Independent Voice.
Paul Singer, the New York hedge fund mogul who in the last week made the Washington Post’s list of the 10 mega-donors of the 2016 cycle, sent $250,000 to the fund.
The GOP wing of the Cubs-owning Ricketts family sent $50,000 through one of their super PACs, too.

I watched the entire “presidential debate” last night” and even listened to some of the media gasbags afterwards.
Trump’s hatred for President Obama was on full display but no one is talking about that as usual.
And no one asked Trump about his recent comments about the Central Park Five despite his self-appointed role in that travesty. Is there a better example of Trump showing us who he is?
I can say unequivocally now that an unbiased person watching this debate would conclude that neither of these individuals should be the POTUS. But, yes, one of them is much worse than the other, assuming that individual does not do a complete about-face once elected.
I think I know how we got to this point, but it still feels unreal, like a nightmare.

I was writing my comment before I read this, Ametia. Interesting that we both compared what is happening to a nightmare which is the only word that I could think of.
I was reflecting on the absence of questions about the policing crisis. Trump, of course, has been endorsed by the Fraternal Order of Police and I would really have liked to hear him talk about it. Hillary would be in a tough position as well given all the baggage she carries and her fear of losing white voters.
But I believe that the focus on Trump’s “lewd comments” was designed to bring on the inevitable response, Bill Clinton’s reputation as a sexual predator, and give the media gasbags something to talk about for the next news cycle. God knows they don’t want to talk about the police killings and beatings of innocent, non-threatening black children and adults.
Nothing comes of this, absolutely nothing. Trump will lose, for sure. Then we’ve got President Hillary and who knows what is next?
