Thursday Open Thread | The Justice Department Threatening Lawyers That Challenge the Trump Administration

I think Rachel Maddow is the one person in the media who has been on the beginning story about the pregnant women in detention centers, being blocked from having the abortions that they want.

Having lost the case to force this young woman to carry her pregnancy to term, the Justice Department is lashing out.

From Slate:

The Justice Department Declares War on Attorneys Who Dare to Oppose the Trump Administration
By Dahlia Lithwick and Mark Joseph Stern

On Friday, the Department of Justice filed an astonishing appeal with the Supreme Court, urging the justices to intervene in the Jane Doe case that seemed to have ended last week. Doe, an undocumented 17-year-old in a federally funded Texas shelter, was denied abortion access by the Trump administration, which argues that it can force undocumented minors to carry unwanted pregnancies to term. On Oct. 24, the U.S. Court of Appeals for the District of Columbia Circuit ruled that Doe must be allowed to terminate her pregnancy, which she did the next day. Now the DOJ is urging the Supreme Court to vacate that decision—and punish the ACLU attorneys who represented Doe.

Make no mistake: With this filing, Attorney General Jeff Sessions’ Justice Department has declared war on attorneys and groups who dare to oppose it in court.

Because Doe obtained her abortion, Friday’s appeal might seem pointless, presenting no live controversy for the justices to adjudicate. But the DOJ has three goals here. First, it wants the Supreme Court to punish the D.C. Circuit for issuing a decision that it believes to be egregiously wrong by wiping the entire ruling off the books. Second, the DOJ wants to eradicate a decision that sets a legal precedent it despises. Doe’s lawsuit was initially brought as part of a class action, and the ACLU will continue to litigate its broader claim against the Trump administration’s absolute bar on abortion access for undocumented minors. As long as the D.C. Circuit’s decision remains on the books, those lawsuits are almost guaranteed to succeed. The Justice Department wants it gone so that it can litigate this issue anew.

Third, and most importantly, Friday’s appeal is a flagrant effort to crucify the individual attorneys who represented Doe, and to terrify likeminded lawyers into acquiescence. The DOJ thus asks the Supreme Court to force Doe’s lawyers to “show cause why disciplinary action should not be taken” against the ACLU—either by the court itself or by state bars—for “material misrepresentations and omissions” designed to thwart an appeal.

In other words, the DOJ is using the full weight of a government agency to threaten professional ruin upon the lawyers who defended Jane Doe’s constitutional right to abortion access.
……………………………………………………..

What really seems to enrage the DOJ, however, is that Doe didn’t attend a second counseling session—which would have been duplicative and wasteful, and caused her yet more needless delay—because the physician who counseled her the first time later agreed to perform the procedure. If ever there were an indicator of the un-distilled bad faith at work here, it’s government lawyers insisting that a non-person with no rights undergo a second round of the same counseling, not for the purposes of medical advice, but so that they would have more time to thwart her choice.

These allegations of wrongdoing are laughably flimsy and outwardly vindictive. Even under the DOJ’s contorted narrative, it’s obvious that the ACLU simply acted efficiently, and the Trump administration is bitter and embarrassed that it lost. The government argues that the ACLU “at least arguably had an obligation to notify the government” that Doe would terminate on Oct. 25—an “incredibly significant development.” But that’s just not how this works. The government had sufficient time to ask the Supreme Court to stay the D.C. Circuit’s decision before Doe terminated. In fact, Texas was already prepared with its own amicus brief backing the DOJ. But the government didn’t act in time. And it’s not the ACLU’s fault that its client secured her constitutional rights while the government dallied in its efforts to exert control of her reproductive capacities. This week-late effort to blame the ACLU for its “arguable” responsibility to ensure that the government could continue to harm their client is not just an effort to save face, but also an attempt to warn attorneys that zealous effectuation of their duties to the clients will now be punished.

The young woman who was successful, wasn’t the only pregnant girl in custody. What about the others?
And, the nerve of the Justice Department trying to strong arm the ACLU.

To show you just how ridiculous this whole madness is, this crooked, racist, mediocre idiot who wouldn’t normally even make it as a low-level personal assistant in a legitimate administration, is trotted out as a high-level senior person representing this country …

It’s offensive to have the People’s House and Air Force One infested with White Supremacists… it’s even more insulting to have them be of the hollowest, shallowest, dumbest, infinitely less than mediocre variety..

Oh, for the days when White Supremacists in our government hated Russia, and were at least half-smart…and men and women of some marginal intellectual heft.. And not of the treasonous variety either…

It’s really quite amusing and unbelievable what has been playing out before our eyes…

How everyone pretends that stretching out what should be a 7 day trip tops – including flight time on the tricked-out Air Force One, …is shamelessly and misleadingly touted as an ‘important historic 12 day Asia trip’ on behalf of America..

The entirely pointless, self-serving, pocket-lining, ego-stroking, preen and be seen …and be flattered and puffed-up, massively expensive tax-payer funded 12 day luxury jaunt – with absolutely no returns for the American taxpayers footing the bill, is broken up and spread out…

To accommodate the extensive psychological, physiological, behavioral needs of an unstable buffoon…Multiple legs for a trip AirForce One could typically complete in one swoop..

A 7 day vanity trip leisurely stretched out over 12 days of bite-size hops, to acclimatize a buffoon… in part to mitigate some resulting serious psychological and behavioral issues… only heightened by time zone changes …and also, since he isn’t paying, a chance to really live it up on OPM..

D.C to Hawaii…A leisurely day and night and full day sleepover at the Ritz Carlton…on the taxpayer dime..

Hawaii to Tokyo…for yet another leisurely 3 day vacation/hang-out …golf, browsing mikimoto pearls and munching on wagyu beef burgers on the tax payer dime ..

Tokyo to Beijing …for yet another 3 day Sun Tzu-inspired distract, humor, lavish with false praise, and stroke the silly, ignorant megalomaniac’s ego while pulling the rug from right under his feet..

    Beijing to Vietnam…3 more days…

Vietnam to the Philippines …3 days with another despicable despot ..together, taking comfort in their numbers… offering reinforcement and boosting each other in their cowardice masquerading as some faux-strongman caricature..

And in the end, at the end of it all…and having run up tens of millions of tax payer dollars for parades and multiple ego boosts courtesy of foreign heads of state, for a sad, incurious, uncultured, treasonous megalomaniac buffoon and his chosen favorite cohort of enablers, America gets absolutely nothing…

And only loses even more face, respect and clout in the world…

      This is too funny..

God has a sense of humor… And by the time this is all over, even more of these bullshitters will be swept right out with this divine wave doing some long overdue cleaning..

Folks are falling off their high horses left, right and center…

One minute, you’re the man, and everyone’s singing your praises, cheesing with you in pictures, and men are falling all over you, while fawning women are draped all over you…

And next thing you know, you’re right under the bus, stuck under one of the tires…smashed flat with endless repetitive skid marks …your rubbished name leading every news network, and in the blazing ledes of every newspaper and blog post.. your former most raucous and biggest cheerleaders now some of your loudest accusers cum alleged victims…

One minute you’re riding high …all invincible …wealth, power, fawning audiences, notoriety, endless possibilities …Next your name is muck, and you watch as you and it are erased from the society that created, actively abetted and cheered on the monster you became..

On Monday, as the Department of Homeland Security prepared to extend the residency permitsof tens of thousands of Honduran immigrants living in the United States, White House Chief of Staff John F. Kelly called Acting Secretary Elaine Duke to pressure her to expel them, according to current and former administration officials.

Duke refused to reverse her decision and was angered by what she felt was a politically driven intrusion by Kelly and Tom Bossert, the White House homeland security adviser, who also called her about the matter, according to officials with knowledge of Monday’s events, who spoke on the condition of anonymity to discuss internal deliberations.

    [….]

Duke, who was confirmed by the Senate in April, has informed Kelly she plans to resign, said the officials.

Kelly’s now calling the shots …and helping re-frame the Alt-Right agenda …doling out White Supremacy at its worst, but trying to refine how buffoon publicly postures …less bark, more dog whistles …training him in the uphill task of how to do racism with ‘respectability’…complete with droopy eyes, sniffing deniability of 4 stars and ‘distinguished general’..

New leptospirosis deaths recorded in Puerto Rico
    11/08/17 07:06 PM—UPDATED 11/08/17 07:09 PM

The federal disaster response in Puerto Rico is now in its eighth week, and reporters have continued to question the official count of people who died as a result of Hurricane Maria. The official count has been under intense scrutiny since Buzzfeed reported last month that government officials, in the immediate aftermath of the storm, approved the cremation of 911 bodies, none of which were reflected in the official death toll. Those people were all judged to have died of natural causes having nothing to do with the storm, despite the fact that Puerto Rico’s medical examiner reviewed only medical records, not the bodies themselves.

Now the Associated Press reports that the average number of deaths each day in Puerto Rico rose sharply after the storm. From AP’s report:

The pace of deaths quickened on Puerto Rico immediately after Hurricane Maria — well beyond the numbers officially attributed to the storm.

The U.S. territory reported an average of 82 deaths a day in the two weeks before Maria hit. That average increased to 117 from Sept. 20 to 30, though the rate has declined since then.

Paul Ryan makes it plain: ‘We’re with Trump’
    11/09/17 09:20 AM
    By Steve Benen

    …………………………………………….

“We already made that choice,” he said. “We’re with Trump.”

And a thousand Democratic campaign ads were born.

“We already made that choice,” Ryan repeated. “That’s a choice we made at the beginning of the year. That’s a choice we made during the campaign, which is we merged our agendas. We ran on a joint agenda with Donald Trump. We got together with Donald Trump when he was President-elect Trump and walked through what is it we want to accomplish in the next two years. We all agreed on that agenda. We’re processing that agenda.”

My concerns about Paul Ryan notwithstanding, he isn’t necessarily wrong.

The “We’re with Trump” line makes for a handy soundbite, but the phrase that stood out for me in the interview was, “We already made that choice.” Whether the Speaker meant it this way or not, Ryan seemed to effectively be conceding, “It’s a little late to change course now.”

And if that is what Ryan meant, he has a credible point. It’s been a year since Trump’s election, and in that time, the Speaker of the House – like the overwhelming majority of congressional Republicans – has gone along with the GOP president’s wishes. Republicans have supported him, defended him, and enabled him at every turn.

The Democratic attack ads, highlighting just how often various GOP members have voted with the Trump White House, are already in the works. Republicans already climbed into the pigpen, and whether they scramble to get out or not, they won’t be able to easily wash off the mud.

White House’s Cohn touts ‘trickle-down’ benefits in GOP tax plan
    11/09/17 10:12 AM
    By Steve Benen

Gary Cohn, director of the National Economic Council in Donald Trump’s White House, sat down for a very interesting chat with CNBC’s John Harwood this week, and it looks like the president’s top economic adviser ended up saying a few things he probably didn’t intend to say.

As recently as late September, for example, Cohn argued that in the Republican tax plan, which he’s helped write, “Wealthy Americans are not getting a tax cut.” With Harwood, Cohn said something very different.

“When you take a corporate tax rate at 35 percent and move it to 20 percent, and you see what’s happened over the last two decades to businesses migrating out of the United States, migrating profits out of the United States, migrating domicile out of the United States, and hiring workers out of the United States, it’s hard for me to not imagine that they’re not going to bring businesses back to the United States.

“We create wage inflation, which means the workers get paid more; the workers have more disposable income, the workers spend more. And we see the whole trickle-down through the economy, and that’s good for the economy.”

It’s worth appreciating, just as a matter of political rhetoric, that there are certain phrases that the right has learned to avoid. Advocates of privatizing public education, for example, steer clear of the word “vouchers,” for example, because they’re not popular – so they use pleasant sounding euphemisms such as “school choice” instead.

Similarly, advocates of massive tax breaks for the wealthy and corporations tend to avoid references to “trickle-down” tax policies because most of the public is repulsed by the idea of giving more money to those at the very top and waiting for prosperity to eventually work its way to everyone else.

In Beijing, Trump abandons years of tough talk towards China
    11/09/17 08:40 AM—UPDATED 11/09/17 08:52 AM
    By Steve Benen

At a bilateral meeting in Beijing this morning, Donald Trump lamented the U.S.-China trade imbalance, but said he blames “past administrations.” In other words, in the American president’s mind, the trade gap is the United States’ fault.

He reiterated the point at a question-free press briefing soon after.

President Donald Trump said Thursday that he does not blame China for its economic success at the expense of the United States, what he called a “one sided” trade relationship.

“I don’t blame China,” he said at a business event joined by Chinese President Xi Jinping. “After all, who can blame a country for being able to take advantage of another country for the benefit of its citizens? I give China great credit.”

It’s hard to overstate just how dramatic a departure this is from the American president’s previous posturing. ABC News did a nice job rounding up some of Trump’s most notable quotes on China from the campaign, during which he insisted, among other things, that China is “ripping us off,” is an “enemy” of the United States, has perpetrated “the greatest theft in the history of the world,” and prefers to “lie, cheat, and steal in all international dealings.”

At one campaign event in May 2016, Trump went so far as to say, “We can’t continue to allow China to rape our country and that’s what they’re doing.”

Keisha for Mayor: Ethnic names no obstacle for candidates with 2nd generation of black leaders on the ballot.

Atlanta’s next mayor could be a woman named Keisha, and observers are abuzz at the prospect. Atlanta mayoral candidate Keisha Lance Bottoms is the latest in a list of candidates whose ethnic-sounding names aren’t holding them back from seeking office.

Research has shown that black-sounding names could prove an obstacle for candidates applying for jobs or college, but such bias may be less of an issue at the polls. Such names are a striking contrast from those of black political leaders a generation ago, but could carry less of a stigma with black voters with friends and family who are similarly named.

The 1970s era of the “black is beautiful” movement led to a boom in Afrocentric names, and many of those children are now adults working across American society, including politics.

Johnstown, Pennsylvania, Is All out of Hope
by Martin Longman November 8, 2017

A lot of people are talking today about Michael Kruse’s piece in Politico Magazine in which he traveled back to Johnstown, Pennsylvania to check in with Trump supporters he’d talked to last year. The basic takeaway is a bit different from the headline suggesting the president’s supporters never believed his promises. In fact, it’d be more accurate to say that they were actually quite hopeful when he was elected, but prudently skeptical. What’s changed is that they don’t really have much hope at all anymore, but their devotion to Trump is surprisingly undiminished nonetheless.

Some of the people Kruse profiles are sympathetic, others the farthest thing from it. It’s easy to find yourself cursing their pretzel logic and their curdled views on life. Who among us doesn’t want to self-apply a staple gun after reading something like this?

Next to Bala was a gray-haired man who told me he voted for Trump and was happy so far because “he’s kept his promises.”

    I asked which ones.

“Border security.” But there’s no wall yet. “No fault of his,” the man said.

What else? “Getting rid of Obamacare.” But he hasn’t. “Well, he’s tried to.”

What else? “Defunding Planned Parenthood.” But he didn’t. “Not his fault again,” the man said.

I asked for his name. “Bill K.,” he said. He wouldn’t give me his last name. “I don’t trust you,” he said.

This area was represented for thirty-six years by Rep. John Murtha, an anti-choice Democrat who served as a Marine in the Vietnam War and received two Purple Hearts, the Vietnamese Cross of Gallantry, a Bronze Star, and the Navy Distinguished Service Medal. He was famous as an appropriator who brought home the bacon to his district by mastering the earmarking process.

The current representative, Republican Keith Rothfus is comparatively useless. His only committee assignment is to the Financial Services Committee, which has about as much direct relevancy to the working class people of Johnstown as the Indian Affairs Committee. But he couldn’t replicate Murtha’s effectiveness even if he wanted to because the Republicans did away with earmarks in the misguided belief that they were more invitations to corruption and waste than the lubricant that allowed the two parties to compromise and make deals.

It used to be that a very powerful congressman did a lot for the struggling people of Johnstown. Murtha certainly accomplished more for them than any president ever did. And they knew he was a Democrat and they voted for him eighteen times in a row.

Virginia Governor’s Race Isn’t Just About the Candidates
Bernie Sanders and Steve Bannon aren’t running, but they’re shadow-campaigning.
    By Albert R. Hunt
    October 29, 2017, 9:00 AM CDT

Senator Bernie Sanders, the Vermont socialist, and Steve Bannon, the nationalist provocateur, are playing roles in the most important election this year, the Virginia governor’s race.

Sanders, who gained his national following by running for the 2016 Democratic presidential nomination, has refused to endorse the Democratic candidate, Ralph Northam, a mainstream progressive. This signals the left-winger’s determination to set ideological litmus tests for Democrats.

Bannon, the former top strategist for President Donald Trump, is on a mission to destroy the Republican Party establishment. In Virginia, he’s helped pressure Republican Ed Gillespie, a quintessential establishment figure, to embrace immigrant-bashing and race-baiting.

The significance of the Nov. 7 contest extends beyond the state’s borders. A Northam victory would be welcomed by Obama-Clinton Democrats and would diminish Trump, a frequent target of the Democrat’s speeches and commercials.

    ……………………….
Democratic strategists hope that disdain for Trump will matter more to Virginia liberals than the Sanders snub. But they worry about the national effect of a rule-or-ruin Sanders strategy of insisting that Democratic candidates next year and in 2020 toe his line or face opposition from his energetic base.

  22. rikyrah says:

    The Real Democratic Base

Here’s how much real Democratic candidates don’t need Trump voters.
Why did Ralph Northam win Virginia’s gubernatorial last night by nearly ten points? Black, Asian, and Latin voters, and especially black women.

The lesson is when black voters show up, Democrats win and win BIG. We know this. What I don’t know why we’re trying to worry about winning back white men who voted for Republicans by a 27 point margin. Get more black votes out. Fight voter suppression. Jesus, it’s not multi-variable calculus, guys.

Republicans know this lesson well and have been trying to disenfranchise black voters for decades exactly because they know black voters win election for Dems because we vote for Dems. Duh.

Why some Democrats still yet don’t understand this, I’ll never know.

Mayhew at BJ answering a question about the mandate:

The individual mandate and its effects
    by David Anderson
    at 8:33 am on November 9, 2017

I was asked a couple of questions about the new Congressional Budget Office estimate of the impacts of repealing the individual mandate. I’ll walk through them as best I can:

    ■ Federal budget deficits would be reduced by about
    $338 billion between 2018 and 2027 (see Table 1).
    ■ The number of people with health insurance would
decrease by 4 million in 2019 and 13 million in 2027

The 13 million people without insurance in 2027 are broken down as about 5 million fewer people with Medicaid, 5 million fewer people in the individual market and about 2 million people losing their insurance through work.

    So what’s happening?

The deficit reduction is straightforward. As fewer people are covered, the federal government spends less on healthcare. It spends less on Medicaid, it spends less on advanced premium tax credits and it receives slightly higher income taxes as more compensation is being paid in cash instead of health insurance.

I’ve taken three lessons from Tuesday: (1) Brazile and Bernie are history; right wingers may prop them up but their time has passed. (2) we need to compete in every race from local sheriff to US Senator. (3) Frum warned, and I agree, that the GOP will now try turbo-charged voter suppression so the DNC or some organization has to sponsor a nationwide voter registration effort; I’m all ready to spend a week in Milwaukee doing this.

WATCH: Fox host melts down as DNC chairman gloats over Tuesday’s big election wins

Bartiromo attacked Perez for not talking with Sen. Bernie Sanders (I-VT) after Brazile claimed that the Clinton campaign had undue influence over the DNC before the 2016 Democratic primary even started.

Perez, however, refused to take the bait.

“Maria, we are focused on winning elections, focused on the future here,” he said.

“Right, unfortunately Bernie Sanders’s hopes were dashed because it was rigged,” Bartiromo interrupted.

Perez pointed out that, whatever problems the DNC had with its ties to the Clinton campaign, Hillary Clinton still won the Democratic nomination fairly by getting 4 million more votes than Sanders did.

“But now we know it was rigged!” she shouted back.

“Maria, I understand that, when the Democrats win, as they did last night, that you’d like focus on other things,” Perez retorted.

Later in the interview, Bartiromo bashed the DNC for not giving over its computers to the FBI in the wake of the Russian hacks — and implied that there was some damaging information on those computers “that you didn’t want anyone to see.”

“Maria, you are in a fictional wonderland right now,” Perez replied, with a grin on his face.
