Tuesday Open Thread | The real reason Robert Mueller is sitting on a sealed indictment of Donald Trump

Over the weekend, Palmer Report spelled out the evidence which strongly suggests that Special Counsel Robert Mueller is sitting on at least one sealed indictment against Donald Trump, even as he openly pursues Trump’s various underlings. I’ve since been chewing on why Mueller would take this particular path. It’s now become more clear: it’s all about blocking Trump from being able to pardon anyone.

As I laid out earlier, court records list the indictment against Paul Manafort and Rick Gates as “Indictment (B)” means there’s also an “Indictment (A)” floating around out there, still under seal (link). By definition, Indictment (A) has to be against someone of higher value in the investigation than Manafort, which shortens the list to Donald Trump, Jeff Sessions, and maybe Jared Kushner. The target of the sealed indictment also has to be someone whose crimes relate to the crimes that Manafort and Gates are charged with, which essentially narrows it down to just Donald Trump himself. In other words, Mueller is sitting on a sealed indictment against Trump. But why?

It was a Palmer Report reader who helped me put the pieces together, as I’m once again reminded that I’m fortunate to have the smartest audience in all of politics. Various respected legal experts are of the belief that if Donald Trump tries to pardon his own alleged co-conspirators in the Trump Russia scandal, the courts will rule that those pardons are unconstitutional. Of course that puts the legal burden on Mueller to demonstrate that Trump’s underlings truly are his co-conspirators.

The shortest route to get there: each time Robert Mueller gets a grand jury to indict one of Donald Trump’s underlings (Manafort, Gates, Michael Flynn, etc) for any given crime, he’s having that grand jury indict Donald Trump as part of that same criminal conspiracy. That way, if Trump does try to pardon any of these people, Mueller can immediately unseal the indictment against Trump, thus blocking that pardon. This is almost surely why Mueller has a sealed “Indictment (A)” against Trump in the Manafort-Gates case.

  1. Hey, Chicas! I am so tired. Feet hurt. Just exhausted. And I haven’t started cooking yet. Poor me tomorrow. I want to cook my turkey necks and gizzards and make potato salad, cornbread tonight. I really need to get those things out of the way. Jonne called and she picked up the honey baked ham. I picked up my Brownie cake today too. I’ll be cooking all day tomorrow.

This American comfort food leads a double life – but only some of us know the secret. Do you?
    BY KATHLEEN PURVIS
    NOVEMBER 15, 2017 06:48 PM

It was one of those volunteer duties, the one where you agree to talk to your kid’s class about your job. I figured it would be easy: I’d ask the kids what their family eats at Thanksgiving and we’d do a middle-school version of Brillat-Savarin’s old saw, “Tell me what you eat and I’ll tell you who you are.”

I stood at the wipe-off board and wrote down what the kids called out: Turkey, dressing, pumpkin pie.

Then it happened: One child called out, “Macaroni & cheese.”

Across the room, every white child said a version of “Say what?” And every black child said a version of “Well, sure.”

The person who really got educated that day wasn’t the kids. I’d learned that America’s beloved comfort food leads a double life.

In black culture, for the most part, macaroni & cheese is the pinnacle, the highest culinary accolade. Who makes it, how it’s made and who’s allowed to bring it to a gathering involves negotiation, tradition and tacit understanding. It’s made from scratch and usually involves multiple kinds of cheese, secret touches (eggs and evaporated milk may be involved) and debates over toppings. It’s baked, and it’s a side dish, but it’s the side dish of honor, present at every important occasion.

Just rip the top off a blue box? It would be like ripping through your grandmother’s heart.

    ………………………………….

Mimi Beal, 52, sums up macaroni & cheese simply: “It’s EVERYTHING.”

    …………………………….

In her family, macaroni & cheese was “a sacred thing.” It wasn’t until she went to an integrated high school that she learned that her white friends did it differently.

“I never knew it’s a cultural thing,” she says. “I never knew that people ate macaroni & cheese for dinner, not as a side item, until I got into high school. The white kids were having it just for dinner. No, it’s a side dish!”

    A side dish, but special.

“I associate mac & cheese with every holiday. Winter and summer. If there’s a barbecue, somebody has mac & cheese. Easter. July the Fourth. In black families, you associate macaroni & cheese with comfort, with your mother, your aunts. Not just anybody is allowed to make the mac & cheese. If you’re invited to someone’s house, especially for a holiday, you can’t just bring the mac & cheese, you know. You have to be assigned.

“You have to be a tested, tried-and-true, mac-&-cheese maker.”

    ………………..

“I hate to brag, but people really love my cooking,” she says. “I do everything – I’ll do any sides, the meat, I plan the menu, I am my mother’s assistant. We’re in charge of the meal.”

She’s the cook, with one exception: Her sister Lauren makes the macaroni & cheese. She’s the only one in the family who has perfected their mother’s version. Beal doesn’t even have the recipe.

Alabama ex-cop says she was tasked with keeping Roy Moore away from cheerleaders at high school games

A retired Alabama police officer told MSNBC’s Andrea Mitchell on Tuesday that she had to keep an eye on Alabama Republican Senate candidate Roy Moore in the 1980s at local high school football games because he would regularly harass the team’s teenage cheerleaders.

Faye Gary, who for 37 years was an officer at the Gadsden Police Department, explained to Mitchell that Moore’s reputation for pursuing underage girls was widely known throughout the community.

“We were also told to watch him at the ballgames, and make sure that he didn’t, you know, hang around with the cheerleaders,” said Gary.

Gary also said she learned that Moore had been barred from entering the local shopping mall because he had been “harassing” young women who worked there.

Moore faces multiple allegations that he inappropriately pursued teenage girls when he was in his 30s, including allegations from two women that Moore tried to force them to have sexual contact with him when they were both under the age of consent

I feel like maybe I can take some interest in what the sainted White Working Class™ thinks about shit when the press begins to tell us about what the Black working class, or indeed, any Black people think about anything. This is the same old shit as the shit we heard some years back when people in the press were telling us that, “Yeah, but if it weren’t for Black voters, Democrats would never win another election again!” They seemed obsessed with this, and left unspoken in all that was what they really meant, which was, “Yeah, but Black voters aren’t real voters. They aren’t the voters who count, you know? Democratic wins don’t really count, because they don’t depend on white voters. White voters are the real voters.”

They just can’t get beyond this, even though the wording is a little new. They all obsess about Tяump voters like they’re the only ones worth worrying about. Democrats need to stop worrying about these people. Too many of them are beyond help. They’re never going to pull the lever for Democrats, even though Republicans are fucking them over; shit, they vote for Republicans even when they know Republicans are fucking them over, or molesting 14 year olds or… You finish it.

Democrats are going to keep on trying to help these people because that’s what Democrats do. And it doesn’t hurt to tell the White Working Class™ how we’re trying to help them. But we need to stop fretting about it. We aren’t going to get these people. We never will. And we don’t need them. There are enough people who do care about what Democrats are doing, and will vote for us that we don’t need to obsess about these people. I know that’s going to upset Nicholas Kristoff and E.J. Dionne and the ghost of David Broder, and I know that too many Democratic politicians still care what these zeroes think, but I hope there are enough Democrats who understand what the hell is going on that we can make some headway. For fuck’s sake, we saw two weeks ago today just how fucking little we need the White Working Class™. Ralph Northam didn’t spend his time in Wise County or Patrick County, begging poor white ignoramuses for votes he was never going to get. He went to Norfolk and Richmond and Northern Virginia and told us all what was at stake and what he was going to do for us if we gave him the chance, and, boy, howdy, it worked.

I know, it doesn’t “count” because it was all because of The Blacks and The Hispanics and The Women who put him 10 points over the top, but the thing is, it does count. He doesn’t have to hand the governor’s seat over to Chinless Ed because too few White Working Class™ voters voted for him. He still gets to be governor for four years, and he now may even have the House of Delegates with him, too. I don’t really care what Mark Shields thinks about all of this. All I care about is that Democrats in office and running for office care

    ………………………….

Why Democrats Must Regain the Trust of Religious Voters

If the party wants to win back votes in the Trump era, it will need to stop ignoring people of faith.

Democrats ignored broad swaths of religious America in the 2016 election campaign and the nation has suffered because of it. Yet calls for a recommitment to faith outreach—particularly to white and other conservative or moderate religious voters—have been met in some corners of liberal punditry with a response as common as it is unwarranted. Some quarters of the Democratic party would rather maintain rhetorical and ideological purity than win with a more inclusive coalition. For the sake of the country, the party must turn back to people of faith

We know faith outreach works, because it has worked before. In 2005, after the reelection of a president many Democrats believed was clearly unfit for leadership, a concerted decision was made to close the “God Gap” that the GOP had so effectively exploited. Yes, the Democratic Party was losing among white religious people, but there was also an understanding in the party that its margins among black and Hispanic voters were limited by the perception that the party was antagonistic toward religion. Democrats took back Congress in the 2006 midterms, through a combination of direct engagement, district-based flexibility on policy, and rhetorical adjustments. The majority gained in 2006 is the majority that delivered all of the legislative-policy wins progressives hail from the first two years of the Obama administration, including the Affordable Care Act.

A few weeks ago, California requested $7.4 billion in disaster aid following the massive series of wildfires in the northern part of the state that killed 43 people and destroyed nearly 9,000 structures. Actually, let’s back up. That’s not quite accurate. California’s Democratic governor, its two Democratic senators, and its 39 Democratic members of Congress asked for $7.4 billion. With only one exception, California’s Republican delegation boycotted a request for disaster funding for their own state.

Yesterday the Trump administration responded to California’s request:

While the request includes anemic supplemental funding for states ravaged by hurricanes, it contains no funding whatsoever for rebuilding the communities in California devastated by the recent wildfires…. “For the Administration to not request even a single additional penny to help rebuild the communities devastated by the worst fires in California’s history is mind-boggling,” [said the two congressmen who led the disaster relief effort].

F.C.C. Is Said to Plan Repeal of Net Neutrality Rules
    By CECILIA KANG
    NOV. 21, 2017

WASHINGTON — The Federal Communications Commission is preparing a full repeal of net neutrality rules that require broadband providers to give consumers equal access to all content on the internet, putting more power in the hands of those companies to dictate people’s online experiences.

Ajit Pai, the chairman of the F.C.C., plans to reveal a sweeping proposal to scrap the net neutrality rules on Tuesday, according to two people familiar with the plan, who spoke on the condition of anonymity because the details are not public. The rules, created during the Obama administration, prohibit broadband providers from blocking, slowing down or charging more for the delivery of certain internet content. The proposal will be presented in a December meeting of F.C.C. commissioners and is expected to pass in a 3-to-2 vote along party lines.

A rollback of net neutrality regulations would represent a significant victory for broadband and telecom companies like AT&T and Comcast and would amount to a strike against consumers. When the rules were passed in 2015, they underlined the importance of high-speed internet to the lives of Americans and the need to more strongly regulate the communications service like a utility, as essential as electricity and the telephone.

A confidential State Department “dissent” memo not previously reported said Tillerson breached the Child Soldiers Prevention Act when he decided in June to exclude Iraq, Myanmar, and Afghanistan from a U.S. list of offenders in the use of child soldiers. This was despite the department publicly acknowledging that children were being conscripted in those countries.[tmsnrt.rs/2jJ7pav]

Keeping the countries off the annual list makes it easier to provide them with U.S. military assistance. Iraq and Afghanistan are close allies in the fight against Islamist militants, while Myanmar is an emerging ally to offset China’s influence in Southeast Asia.

Documents reviewed by Reuters also show Tillerson’s decision was at odds with a unanimous recommendation by the heads of the State Department’s regional bureaus overseeing embassies in the Middle East and Asia, the U.S. envoy on Afghanistan and Pakistan, the department’s human rights office and its own in-house lawyers. “Beyond contravening U.S. law, this decision risks marring the credibility of a broad range of State Department reports and analyses and has weakened one of the U.S. government’s primary diplomatic tools to deter governmental armed forces and government-supported armed groups from recruiting and using children in combat and support roles around the world,” said the July 28 memo.

    The Nationalist’s Delusion
Trump’s supporters backed a time-honored American political tradition, disavowing racism while promising to enact a broad agenda of discrimination.
    ADAM SERWER NOV 20, 2017

    …………………………

Trump’s great political insight was that Obama’s time in office inflicted a profound psychological wound on many white Americans, one that he could remedy by adopting the false narrative that placed the first black president outside the bounds of American citizenship. He intuited that Obama’s presence in the White House decreased the value of what W. E. B. Du Bois described as the “psychological wage” of whiteness across all classes of white Americans, and that the path to their hearts lay in invoking a bygone past when this affront had not, and could not, take place.

    …………………………………….

One measure of the allure of Trump’s white identity politics is the extent to which it has overridden other concerns as his administration has faltered. The president’s supporters have stood by him even as he has evinced every quality they described as a deal breaker under Obama. Conservatives attacked Obama’s lack of faith; Trump is a thrice-married libertine who has never asked God for forgiveness. They accused Obama of being under malign foreign influence; Trump eagerly accepted the aid of a foreign adversary during the election. They accused Obama of genuflecting before Russian President Vladimir Putin; Trump has refused to even criticize Putin publicly. They attacked Obama for his ties to Tony Rezko, the crooked realtor; Trump’s ties to organized crime are too numerous to name. Conservatives said Obama was lazy; Trump “gets bored and likes to watch TV.” They said Obama’s golfing was excessive; as of August Trump had spent nearly a fifth of his presidency golfing. They attributed Obama’s intellectual prowess to his teleprompter; Trump seems unable to describe the basics of any of his own policies. They said Obama was a self-obsessed egomaniac; Trump is unable to broach topics of public concern without boasting. Conservatives said Obama quietly used the power of the state to attack his enemies; Trump has publicly attempted to use the power of the state to attack his enemies. Republicans said Obama was racially divisive; Trump has called Nazis “very fine people.” Conservatives portrayed Obama as a vapid celebrity; Trump is a vapid celebrity.

There is virtually no personality defect that conservatives accused Obama of possessing that Trump himself does not actually possess. This, not some uncanny oracular talent, is the reason that Trump’s years-old tweets channeling conservative anger at Obama apply so perfectly to his own present conduct.

Leading Trump Census pick causes alarm
The 2020 count might be put in the hands of an inexperienced professor who wrote that ‘Competitive Elections are Bad for America.’

The Trump administration is leaning toward naming Thomas Brunell, a Texas professor with no government experience, to the top operational job at the U.S. Census Bureau, according to two people who have been briefed on the Bureau’s plans.

Brunell, a political science professor, has testified more than half a dozen times on behalf of Republican efforts to redraw congressional districts, and is the author of a 2008 book titled “Redistricting and Representation: Why Competitive Elections Are Bad for America.”

The choice would mark the administration’s first major effort to shape the 2020 Census, the nationwide count that determines which states lose and gain electoral votes and seats in the House of Representatives.

The fate of the Census under Trump has been closely watched by voting-rights advocates worried that the administration — which has already made unsupported claims about voter fraud — might nudge it in directions that over- or under-count some Americans. Subtle bureaucratic choices in the wording and administration of the Census can have huge consequences for who is counted, and how it shifts American voting districts.

Chris Matthews doesn’t remember the show very well when he thinks that Archie Bunker was made fun of because Archie was a White working class individual. Chris Matthews said in the video above:
“You know, ever since we started this Archie Bunker thing in the early ’70s, making fun of white working people, we kissed them goodbye,” ”

The Show “made fun of” Archie Bunker because of his racism and sense of White superiority.
