Mythe says Anthony Kennedy was forced out. She says republicans know what’s coming down the pike and forced him out because the fraud is going to prison and they wanted Kennedy out so the poser could appoint someone. Something sure is suspect. I wouldn’t put anything past them. They play hard & dirty.

As much time as I spend providing evidence-based political analysis, I’ve never been a fan of empty speculation based on nothing, and I detest empty conspiracy theories that are at odds with the facts. When Supreme Court Justice Antonin Scalia – an elderly obese man whose doctor had recently declared him to be in poor health – passed away, some conservatives floated conspiracy theories about his death that were utterly ridiculous.

When it comes to today’s stunning resignation of Justice Anthony Kennedy, I have no interest in floating empty conspiracy theories about what might have happened. I do, however, feel compelled to point out the ways in which this simply does not add up. It was weird enough yesterday, when Kennedy went against his own track record on these matters and voted that Donald Trump’s Muslim ban was constitutional. He even spelled out in his decision that he was morally opposed to it, as if he were apologizing for casting what he knew was an incorrect vote.

Anthony Kennedy was appointed by a Republican President, but he’s always been a moderate, which is why he’s usually the swing vote on 5-4 decisions. His opinions have always been very lacking when it comes to understanding the law and the Constitution. But what he’s lacked in smarts, he’s generally made up for with heart. If you’ve read his opinion on the gay marriage ruling, you know what I’m talking about. The idea that he would vote in favor of the Muslim ban was completely out of character for him.

Even as I was scratching my head today and trying to figure why Justice Kennedy was going off the rails, suddenly he announced today that he’s retiring. So in a period of twenty-four hours, Kennedy has cast a vote he didn’t even agree with in order to hand Donald Trump a major policy victory, and he’s decided to let Trump pick his successor. I don’t know why this is happening, but it sure as hell doesn’t add up. Kennedy owes us an explanation, and short of that, there needs to be a full scale investigation.

    I woke up in the middle of the night last night thinking about something that had been eating at me since Tuesday. Many of our assumptions about the course of the Mueller investigation are based on the premise or the backstop that Supreme Court will enforce the Nixon-era precedents about the rule of law and presidency. This seemed less clear to me after Tuesday’s decisions, though I didn’t return to that issue after yesterday’s news. I did last night at 3 a.m. The Mueller probe is the most immediate issue but it’s really just a proxy for our democratic institutions. I’ve said before that Trump is an autocrat without an autocracy. But he’s working on it and the question is whether there will be any check.

    Looking through my email I found this from a former federal public corruption prosecutor …

    I am deeply concerned that the Kennedy retirement will put the rule of law and our democratic institutions at graver risk than ever before. The President of the United States is the subject of a serious federal criminal investigation into (1) whether he conspired with a foreign adversary to help him win a narrow electoral college victory; and (2) whether he has obstructed that very investigation by, among things, firing the FBI director in charge of the investigation. The President will now be able to choose the person who, in a very real sense, may be the ultimate arbiter of whether or not he and others are ever held accountable.

    Consider that the Supreme Court may be called upon to decide, for example, whether the President can pardon himself or others to protect himself, whether a sitting President can be indicted, whether a sitting President can be compelled to testify before a federal grand jury, whether the appointment of the Special Counsel somehow violated the Appointments Clause (as some conservatives absurdly assert), and whether a President can ever obstruct justice. Even beyond the Mueller investigation, the Supreme Court may be called upon to decide whether the President’s acceptance of significant foreign funds through his businesses violates the Emoluments Clause. We have no idea how Justice Kennedy would have ruled on these questions (he hasn’t exactly distinguished himself in the last two days). But we have no doubt how a Trump appointee will. Never before has the selection of a Supreme Court nominee been so thoroughly compromised by the President’s profound personal interest in appointing a judge the President can count on to protect the President. This is DEFCON 1 for the rule of law in this country.

    Democrats in the Senate seem to have missed this point, or are too feeble to effectively prosecute the basic conflict of interest case. Instead, they have fallen back on the “McConnell rule” as a justification to delay a vote. Make no mistake, the treatment of Judge Garland and the theft of President Obama’s nomination power was an outrage and a terrible precedent. But Democrats should not endorse it. They should not let McConnell’s mendacity become the norm. It should stand on its own in history as the flagrant abuse of power that it was. In any event, Democrats have a much stronger case to make: no vote should be taken until after the Special Counsel has submitted a report to Congress, or closed the investigation of the President. A President under federal criminal investigation for stealing an election should not be able to nominate the person who may decide his fate. There will be a cloud over the legitimacy of this nomination unless and until the cloud of the Mueller investigation has been lifted.

    Before Trump could almost be funny, with his wild insults and accusations.

    Now, not so funny anymore.
    Before, at times it felt like they were winning.
    Now, it feels a little like they’ve won.
    Let that feeling settle, for a moment. Let it register. Then shake it off.
    Because these setbacks are also a fire bell in the night to those Democrats still fretting over public comity and how nice they should be. Whether they can attempt the tactics that have worked so well for so long for Republicans. This is smoke in the air. There is no room for indecision anymore. This is disaster that must be battled. The Right is coming to burn up your freedom your livelihood, everything. No one can pretend to be confused or uncertain any more.
    That is the bad news. The good news is the union faithful, the American patriots, have suffered worse defeats. Bruised, battered, humiliated, they never gave up. Neither can we. The battle isn’t over. It has just begun in earnest.

    No one., not a state, not a city, not a private adoption agency- NO ONE takes custody of someone else’s children and does not track them.

    The Trump Administration did. They don’t believe those children are human. They treated them as having less value than property. They had no system in place to protect those children and return them to their family – they didn’t bother to put one in. You can only do that if you believe the 8 month old is not really a human being.

    They knew NOTHING about those kids. Not a medical history, nothing. That 8 month old could have died in their custody. They don’t know anything about him. What if he had health problems, heart or lungs or an intolerance for baby formula? They didn’t care. They grabbed him anyway and shipped him hundreds of miles away.

    That may have struck some people as a bold, almost inflammatory, prediction. It wasn’t. This is simply a matter of being about to count to five.

    Clarence Thomas is the only sitting justice who has publicly declared opposition to the ruling, having joined the dissent in the court’s 1992 landmark ruling in Planned Parenthood v. Casey, which upheld much of Roe. That dissent explicitly argued that Roe was “plainly wrong.” […]

    But many advocates and some legal scholars nonetheless predicted that the three other conservatives on the court – Chief Justice John Roberts, Samuel Alito and Neil Gorsuch – would likely join the new Trump-appointed justice in rulings that would target abortion rights and chip away at the protections of Roe.

    Indeed, the likely scenario is already in sharp focus: Trump will keep his promise to nominate a justice who opposes abortion rights; Senate Republicans will confirm him or her; the Supreme Court will take up an abortion case; and Roe v. Wade will be overturned before the next presidential election.

    Keyshawn Johnson says ‘there’s something wrong mentally’ with Jameis Winston

    As the Court of Big Shield continues to ponder the fate of Buccaneers quarterback Jameis Winston, the court of public opinion continues to issue verdicts, one pundit and/or former player at a time.

    Enter Keyshawn Johnson, a former Buccaneers receiver who at one point was so disruptive he was sent home for the rest of the season with pay, has chimed in, aggressively.

    “When I saw [the Jameis report] I thought, ‘Man, you just can’t stay out of trouble,’” Johnson said on KSPN 710, via JoeBucsFan.com. “And there’s something, and I’m not a doctor, nor do I plan on being, but there’s something wrong with you. If this is in fact true, the fact that you keep coming up with some type of sexual behavioral problems towards women, there’s something wrong mentally. I don’t care what anyone says. There’s something wrong.”

    The Buccaneers have yet to say or do anything to suggest that their opinion about Winston has changed. That could change if/when the NFL issues a suspension letter to Winston listing the various things that the NFL has concluded that he did. If a local or national groundswell ever emerges against Winston, the Buccaneers will at least have to consider that factor when making decisions about Winston.

      I always thought the college rape allegation was suspicious and I also thought that the accuser’s lawyer didn’t seem quite right, like she was about to win the lottery.

      But this isn’t good. One would have hoped that Jameis Winston would be a model of good behavior after that.

      I think there are always potential problems for people who are singled out to be the BIG STARS in athletics and entertainment. They are treated as though they really are different from the rest of us and it’s not hard to see how some of them will believe that rules don’t apply to them. They think there will always be a fixer no matter what they do.

    Say what you wan about Right wing dingbats. But they vote. They fall in line. They don’t spend every waking moment of friendly presidencies trying to discredit the captain of their own team.

    Do you know why? This is why:

    Justice Anthony M. Kennedy announced Wednesday that he is retiring from the Supreme Court, a move that gives President Trump the chance to replace the court’s pivotal justice and dramatically shift the institution to the right, setting up a bitter partisan showdown on Kennedy’s successor.

    The Supreme Court is the single most pivotal institution in setting law that is not subject to popular will. It can broaden the scope of Constitutional rights, or it can outright sanction racism, misogyny, xenophobia, homophobia, and other forms of bigotry. The Supreme Court can prevent discrimination against working people, or it can codify an employer’s right to bust unions and dictate the type of health care its employees can receive.

    But all of that did not satisfy those on the Left who demanded that President Obama wave a magic wand and usher in liberal utopia. It did not satisfy those on the Left who wanted the banks to be nationalized. It caused the loudest supporters of single-payer health care to call President Obama a weak sellout and assert that the Affordable Care Act, by working within the existing system, would make it more difficult to make the case for a single-payer system (under the theory that one must burn down a village in order to build it). Some of them even went on Fox News to denounce President Obama.

    The efforts of President Obama and Congressional Democrats were ridiculed as too little and ineffective by the ideological Left as much as it was the radical Right. If President Obama’s historic efforts to expand the role of diplomacy was slammed by the Right, his commitment to orderly withdrawals of troops from wars begun by his predecessors earned him the title of warmonger from militant pacifists.

    No sooner had the Democratic party had gained uniform control of the elected branches of the federal government than the Left’s loudest ideologues began a fight against the team with the best possibility in decades to deliver on progressive priorities. Instead of confronting racist right wingers who challenged the citizenship of the country’s first black president, the predominantly-white ideologue Left found ways to pile on Obama using their own offensive language. Rather than fight the unified Republican opposition to President Obama, the hysterical Left found ways to trash Democrats. Instead of defending the president and the Democratic Congress, they focused on making the ideological case that no real difference existed between Republicans and Democrats. Heck, they even called for people to stay home and protest non-vote.

    The blocking of Merrick Garland should have been the equivalent of a thousand sirens for the Professional Left. McConnell made it clear that he was holding the vacant seat open for the possibility – however unlikely it may have seemed at the time – that Donald Trump would become president and nominate an archconservative to the bench with the backing of a Republican senate.

    No such sirens ensued. The Left’s clickbaiters not only used their own indignation to trash the Democratic nominee, Hillary Clinton, both before and after she had secured the nomination, they full-on subscribed to the Russian Trump-friendly propaganda machine in the form of Wikileaks. The overwhelmingly white Bernie Sanders ideologues not only papered over mounting evidence of Sanders’ ignorance – if not willful negligence – of race as a defining issue in America, they were so busy indignant about Clinton that they couldn’t be bothered to rally against Trump’s fast-moving racist election train. Some (I’m looking at you, Susan Sarandon) even equated Hillary Clinton with Donald Trump and claimed their conscience required abstinence in the 2016 election.
