Wednesday Open Thread | Federal judge orders CBP to let doctors into migrant children detention centers

A federal judge has ordered U.S. Customs and Border Protection to allow medical professionals into detention facilities holding migrant children, CNN reported Sunday.

U.S. District Judge Dolly Gee ordered that health professionals be allowed in the facilities to ensure the conditions are “safe and sanitary” for children being detained there and to assess the children’s medical needs.

The order pertains to all of CBP’s facilities in the El Paso and Rio Grande Valley sectors, CNN reported. The centers are the subject of a lawsuit regarding the 1997 Flores Agreement and reports of unsafe and reported unsanitary conditions at detention centers.

Prosecutors had requested immediate action to address conditions they said threaten the wellbeing of children.

The Hill has reached out to CBP for comment.

Last week prosecutors asked the court to hold the Trump administration in contempt and take immediate action to remedy unsafe conditions at border facilities.

“The children, including infants and expectant mothers, are dirty, cold, hungry and sleep-deprived,” prosecutors said, referring to conditions at detention centers including one in Clint, Texas.

Gee, an Obama appointee, ruled late Friday that an independent monitor must ensure conditions in detention centers are promptly addressed, setting a July 12 deadline, according to The New York Times.

At a recent hearing, Department of Justice senior litigation counsel Sarah Fabian testified that the department is compliant with the law, arguing a toothbrush and soap were not necessary to fulfill safe and sanitary conditions for detained children.

Beto O’Rourke is scheduled to visit the Border Patrol facility in Clint, Texas, on Sunday. Democratic presidential candidates visited a detention facility in Homestead, Fla., last week and commented on the horrific conditions they witnessed.

    It happens to lots and lots of regular people. They don’t, actually, have limitless choices. Sometimes they close a door. They fail in a job or an area or a profession and people tell them “nope, no further in this area. That’s about as far as you’re going”. It has to happen to powerful people too or accountability and merit doesn’t mean anything and it will start to show. It already shows. There are tens of thousands of things he can do for work with his resources and connections and the rest. This is not one of them

    An Alabama district attorney will not pursue manslaughter charges against a 27-year-old whose fetus died after she was shot during a December 2018 fight.

    The decision comes after days of public outcry sparked by Marshae Jones’ arrest on June 26. A Jefferson County grand jury had indicted Jones for manslaughter after another woman, Ebony Jemison, shot Jones in December 2018, killing her fetus.

    District Attorney Lynneice Washington announced her decision at a Wednesday press conference in Bessemer, Alabama.

    GREENVILLE, S.C. — Some people whisper it, some apologize for it, and some are very careful to mention their neighbors — their neighbors would be the ones to ask.

    “Do you really think a woman could be elected president?”

    In ways subtle and overt, Democrats keep hearing that same question, even days after debates where Senator Kamala Harris commanded the stage and Senator Elizabeth Warren dominated the policy discussion.

    It’s the anxiety of a party still carrying the scars of its 2016 defeat.

    “My colleagues, some have said that to me, and I just have to push back and say, ‘Wait just a minute,’” said Representative Barbara Lee, a California congresswoman, who worked as a young organizer for former Representative Shirley Chisholm’s 1972 presidential bid. “I’m just quite frankly shocked to still hear them in 2019.”

    Privately, Democratic strategists, candidates and officials say they’ve been alarmed by how deeply doubts about female electability have taken hold. In polling, interviews and focus groups, a portion of the party’s voters suggest they’re eager to see a woman on the ticket but fear that putting her in the top slot could cost them the White House — again. The question comes up frequently in early primary states, including at events organized for female voters.

    Much of the concern centers not on what Democratic voters themselves say they want but a prediction of what they believe others will support.

    In the early months of the contest to choose a candidate to unseat Mr. Trump, Joseph R. Biden Jr.’s argument that he could woo white men in the Midwest seemed to hold considerable appeal.

    “There are people who are not necessarily strong Biden people, but they think he’s the strongest candidate,” said Sara Riley, a 59-year-old lawyer from Cedar Rapids, Iowa, who is a longtime supporter of Mr. Biden. “They love Senator Harris or Senator Warren, but they are concerned about whether they can win.”

    “Honestly, I love Elizabeth Warren, I just worry that we as a society are not ready for that,” said Ann Mason, 44, from Cedar Rapids, after hearing Ms. Warren and other candidates speak at a state party event last month. “This election is far too important. We just have to get Donald Trump out. From there on, I think the door is open to whoever.”

    Senator Mazie Hirono of Hawaii had a message for voters like Ms. Mason: “We should not do it to ourselves that a woman cannot be a president.”

    To some voters, her ability to break barriers in the past may not be enough to dispel concerns about her future.
    “I don’t think she can win. And I’m sorry to have to say that. She is a woman and she is black,” said Shantell Smith, 32, from Greenville, S.C., who is supporting Ms. Harris. “As a black woman myself, I think that as much as we would like to believe there’s been this huge shift in this country, we have seen the reality that people will fight back against change.”

    In Nashville this past weekend, at a convention of the Alpha Kappa Alpha sorority, which Ms. Harris joined as a student at Howard, some of the attendees spoke of their pride in her run so far, praising her debate performance, but also of their concerns about electability.

    “It’s just — is she going to be able to do it?” said Kayla Wilson, who works at a nonprofit in Dallas. “I’ve been in America long enough to know that we’ve come a long way, but maybe not that far.”

      A woman won the popular vote in 2016. In the electoral vote, three blue states were lost by narrow margins, Michigan, Pennsylvania, and Wisconsin.

      I think a woman can win.
