Israel faces airport closure, strikes as rage mounts over courts overhaul

Updated March 27, 2023 at 8:13 a.m. EDT|Published March 27, 2023 at 4:13 a.m. EDTJERUSALEM — Prime Minister Benjamin Netanyahu faced mounting pressure Monday to halt his government’s drive to remake Israel’s judicial system as the backlash against the plan engulfed the country and strikes threatened national paralysis.
Israeli universities, workers’ unions, hospitals, malls and Israel’s national carrier, El Al, announced a general strike, and the international airport indefinitely terminated outgoing flights. Tens of thousands of protesters from around the country flooded into Jerusalem to express their opposition to the plan.
As calls for Netanyahu to stand down came from across the government, business community and opposition, including from Israeli President Isaac Herzog and Netanyahu’s own longtime lawyer, local media reported he would make a public statement Monday morning.
An official in Netanyahu’s Likud party who spoke on the condition of anonymity due to ongoing negotiations said that earlier Monday morning, the prime minister was ready to bow to pressure and halt the overhaul. Other Likud officials suggested that the move might be frozen at least until the Passover holiday and parliamentary recess next month, Israeli media reported. But the announcement was postponed amid reports that the prime minister had entered emergency consultations with his coalition partners.

In the United States, if a small majority of the House of Representatives aimed to pass legislation to curtail minority rights, the bill would still have to pass the Senate (with its filibuster), the presidential veto, and federal courts. Each of these institutions answers to different constraints and constituencies. They all operate under a defined Bill of Rights that is extremely hard to change. Many legal matters are also within the purview of the states, not the federal government. Abuse of minority rights still happens, but it requires the consent of many different institutions and constituencies.
In Israel, if a small majority of the sole chamber of the legislature, 61 of the 120-member Knesset, supported a bill to curtail individual or minority rights, it would face precisely one formal constraint: the Supreme Court, acting as a “High Court of Justice.” This is what the Netanyahu-Levin legislation would effectively abolish.
The Netanyahu coalition is proposing that only a unanimous decision of all 15 justices could strike down legislation. It is also proposing to politicize the process of judicial appointments, making unanimous decisions against a coalition even more remote a possibility. Most dramatically, if the court struck down legislation, a bare majority of 61 could simply override judicial review. The proposals would also downgrade legal advisors in the Israeli government from interpreters of the law at present to mere political advisers.
In short, in Netanyahu’s new Israel, the slimmest of majorities could decide anything. Pure, unbridled majoritarianism.

Governor Glenn Youngkin just gave himself a lot more power to pick and choose Virginia voters. The Republican governor’s administration told state lawmakers in a letter last week that he was rescinding his predecessors’ policy of automatically restoring the voting rights of people with felony convictions.
Going forward, Virginians will no longer regain their rights when released from prison—the most recent policy announced by Virginia officials in 2021—nor at any later point, unless Youngkin deems them to be worthy on an individual basis.
His decision, which a future governor could alter, sidelines many residents who expected they would get to vote in Virginia elections.
“I’ve never voted in my life. I was looking forward to voting this year,” Sincere Allah, who was released from prison the week Youngkin was inaugurated in 2022 and who has since waited to learn if his rights will be restored, told Bolts, in reference to the state’s upcoming legislative and prosecutorial elections. “I can pay taxes, I can be held to the same standard as everyone else when it comes to laws and rules and regulations, but I have no say-so or representation.”
Youngkin’s announcement also puts Virginia in a category all its own: It is the only state where someone who is convicted today over any felony is presumed to be barred from voting for life, with no remedy other than receiving a discretionary act of clemency from the governor.
