In the Air Tonight
“In the Air Tonight” is a song written in 1979 and recorded in 1980 by English singer Phil Collins and popularized by the hit tv series Miami Vice. It first appeared on Collins’ 1981 solo album Face Value.
Released as a single in the United Kingdom in January 1981, the song was an instant hit, quickly climbing to No. 2 on the UK Singles chart. It was also an international hit peaking at No. 19 on the Billboard Hot 100 in mid-1981. It was later certified Gold by the RIAA representing 500,000 copies sold.
The track remains one of Collins’ best-known hits. The song’s music video directed by Stuart Orme received heavy play on MTV when the new cable music video channel launched in August 1981.
“Separate Lives” is a 1985 song recorded by Phil Collins and Marilyn Martin and featured on the soundtrack to the motion picture White Nights. It reached No. 1 in November, 1985 on the Billboard Hot 100 and Adult Contemporary charts as well as in Canada.[1] It reached No. 4 on the UK Singles Chart.

Models are valuable, and they help us make a lot of strategic decisions. But they don’t determine our destiny, and they aren’t a substitute for hard work.

A few months ago on The Arsenio Hall Show, former NFL running back Jim Brown offered a surprising critique of NBA star Kobe Bryant. Brown argued Bryant is “somewhat confused” about his culture because he was brought up in another country.
Jim Brown hails from a generation of legendary athlete-activists, like Muhammad Ali, Bill Russell, Kareem Abdul-Jabbar and Arthur Ashe, who stood up for social justice causes in their time. But his cultural critique of Kobe Bryant struck me as a bogus argument, reminiscent of the attacks on President Obama for attending school in Indonesia. Like Obama, Bryant spent several years of his youth overseas when his father played professional basketball in Italy. But this means nothing. There is no single Black experience and Kobe is just as much an African-American as a Black kid from the inner city.
Brown, however, didn’t stop his critique with Kobe’s international background. He also argued Bryant wouldn’t be welcome to join a group of socially conscious athletes today. “In the days when we had a summit and we called the top black athletes together to talk to Muhammad Ali about his status with the armed forces, there were some athletes we didn’t call,” Brown told Arsenio. “If I had to call that summit all over, there would be some athletes I wouldn’t call. Kobe would be one of them.”

You did not speak up to express sympathy to Sybrina Fulton and Tracy Martin for the loss of their son. You did not speak up when the jury acquitted Zimmerman while everyone from Shaquille O’Neal to Dwyane Wade to Chris Paul spoke out on Twitter. And you certainly have not spoken up about “Stand Your Ground” laws that enable people like Zimmerman and Michael Dunn to shoot and kill unarmed teenagers with impunity. Instead, the first time we hear from you about this case is to criticize your fellow athletes who were simply trying to express their solidarity with the loss of another human being.
Yes, I get it. You don’t think African-Americans should jump to someone’s defense just because the person is African-American. But that doesn’t mean you should go to the other extreme and purposefully avoid responding to a tragedy just because the person is African-American.

The Indictment Against Leland Yee Puts “The Wire’s” Clay Davis to Shame

If you thought the charges against Leland Yee would be bad, you had no idea. As in, he offered to set up an arms deal with Islamic rebels for $2 million in cash. Morning Plum: The battle over Obamacare is really a battle over Obama

In many ways, the political battle over Obamacare is really a battle over Obama.
The Wall Street Journal reports this morning that a number of red state Senate Democrats will propose a package of “fixes” to the Affordable Care Act. Two of these Dems — Mary Landrieu and Mark Begich — are under heavy fire over the health law and face grueling reelection campaigns:

Putting aside the policy impact such proposals would have — it’s unlikely they will get a Senate vote in any case — this is a reminder that, for both sides, the war over the health law in the 2014 elections is really a war over the president’s unpopularity.
The ads from the Koch-funded Americans for Prosperity are obviously attacks on Obamacare. But their larger goal is to use all those victimization anecdotes to turn folks against government as an agent of positive economic change and channel unhappiness with the sluggish economy (which itself has dragged down Obama’s approval) into anger at government and votes to oust those Dems. The health law is a convenient symbol of the ways these Dems are willing enablers of an Obama Big Government agenda that’s only deepening people’s economic misery.
Meanwhile, on the Democratic side, the response — proposing “fixes” to Obamacare — are also partly about achieving distance from its author and demonstrating a reasonable willingness to acknowledge the need for improvements where necessary. These embattled incumbent Dems maximize their chances of hanging on if they can stake out their independence from Obama. Landrieu will stand up for the Medicaid expansion but also cast herself as tough enough to defy the President to protect Louisiana’s interests. Begich is already up with an ad that’s emphasizing his Alaska roots and willingness to defy Washington Dems on energy. Today’s Obamacare “fixes” are of a piece with this.

GOP repeal stance runs into complications, in deep red West Virginia

Here’s a really interesting example of how the GOP Obamacare repeal stance is running into complications even in a deep red state like West Virginia. It also shows how Dems can seek to turn the Obamacare war of anecdotes to their advantage by dramatizing the local impact of repeal — though it still remains to be seen whether this strategy will be enough to offset the law’s (and Obama’s) deep unpopularity in regions such as this one.
A battle has erupted in West Virginia over an ad that Dems are running against state senator Evan Jenkins, the Republican candidate who is seeking to unseat Dem Rep. Nick Rahall, in a nationally watched “toss up” race.
The Dem-allied House Majority PAC is airing an emotional spot that hits Jenkins over Obamacare repeal by featuring a coal miner who fears losing his black lung benefits if the Republican is elected to Congress. The charge is that, if Obamacare is repealed, miners could lose expanded black lung protections that the late Senator Robert Byrd inserted into the Affordable Care Act. The ad says Jenkins ”vowed to repeal black lung benefits”:

Morning Plum: Is Obamacare repeal fatigue setting in?

Will Obamacare deliver Republicans the Senate in elections seven months away, or will the health law recede as an issue, while other factors (candidates, the economy, the terrible map for Dems) come to the fore?
Today’s new Kaiser Family Foundation tracking poll — the gold standard in health care polling — offers clues as to why the latter may be more likely. Key findings:
– Views of the ACA remain unfavorable, but the gap is narrowing. The new poll finds that in March, 38 percent viewed the law favorably, versus 46 percent who saw it unfavorably. That’s a substantial narrowing from the 34-50 spread during the dark days of January, and a return almost to where opinion was in September (39-43), before the rollout disaster began.
– Support for repeal continues to shrink. Only 18 percent want to repeal the law and not replace it, while all of 11 percent want to repeal and replace it with a GOP alternative — a grand total of 29 percent. Meanwhile, 49 percent want to keep the law and improve it, and another 10 percent want to keep it as is — a total of 59 percent.
Among indys, that keep/improve versus repeal/replace spread is 52-31. Republicans are all alone here, with their spread at 31-58.

Republicans losing it over new Obamacare data: Why their position is collapsing
Obamacare enrollment could hit 7 million before the midterms; meanwhile, GOP still has no answer for beneficiaries

It’s a complete accident of legislative and administrative history that the fourth anniversary of the Affordable Care Act should fall the week before the end of the law’s first ever, six-month-long open-enrollment period. But it’s a great coincidence for those of us in the business of cutting through all the hyperbole that accompanies each ACA anniversary, because, for the first time since the law passed, there are real data, and real beneficiaries, to hold up against the spin.
And as I’ve been arguing for months now, the GOP’s position on the law can’t actually withstand on-the-ground realities.
Case in point: Terri Lynn Land — Michigan’s one-time Republican secretary of state, turned Senate candidate — held a first-ever conference call with reporters to trash the ACA on its fourth birthday. But confronted with the question of what happens to people with preexisting medical conditions if the GOP repeals the law (and thus eliminates the individual mandate) — Land’s press aide, Heather Swift, commandeered the call, and tried to take the whole thing off the record.
I wasn’t on the line, but Michigan Information and Research Service posted the audio here. (The call starts at 19:20 and the preexisting conditions question at 39:15.) I think the biggest tell of all is that Land doesn’t seem remotely prepared to address the real human consequences of repealing the law herself in any meaningful way. But almost as big is that her staff can’t either. The aide who leapt to Land’s defense made a glaring error after attempting to take the call off the record.

Sanctions Will Work, All Right. Just Ask the Oligarchs

On the face of it, Western sanctions against Russia in the wake of the annexation of the Crimea look weak, ridiculous and possibly illegal.
President Barack Obama, who has supposedly taken the toughest line in condemning Russian President Vladimir Putin’s “aggression,” has merely declared banking sanctions on a dozen Russian businessmen personally close to Putin. The European Union’s list of sanctioned Russian officials has been shorter still, prompting an outcry against Europe’s—and particularly Britain’s—feeble response.
“London is Russia’s tawdry bitch,” tweeted British-born Columbia University history professor Simon Schama, furious at British politicians kowtowing to London financial district lawyers and bankers grown fat on Russian money.
But in truth, there’s some deep thinking behind Washington’s sanctions regime, and they could ultimately prove deadly to Putin’s future.
The key to the sanctions strategy is to drive a wedge between Putin’s shrinking inner circle and the wider Russian elite. That intimate circle is composed mostly of former KGB cronies “willing to sacrifice Russia’s newfound economic prosperity on the altar of imperial ambition,” says Brian Whitmore, author of The Power Vertical blog.
But most Russian businessmen are not. They have reaped the benefits of Russia’s engagement with the world economy over the past decade and are not ready to follow their leaders into economic isolation.

The Republican Party is a white identity organization. This week, the polling firm Gallup has released new data that confirms how the Republican Party–a shambling corpse of Whiteness–lurches onward in the Age of Obama:
The increasing racial polarization in party preferences is evident when comparing the data by presidential administration. Nonwhites’ average party preferences have been quite stable across the last three administrations, consistently showing a roughly 47-point Democratic advantage under Clinton, Bush, and Obama. On average, 69% of nonwhites have identified as Democrats or said they were independents who leaned Democratic, and 21% have identified as Republicans or leaned Republican.
Meanwhile, whites have become increasingly Republican, moving from an average 4.1-point Republican advantage under Clinton to an average 9.5-point advantage under Obama.
This polarization could ease by the time Obama’s term finishes, in three years. However, given the already large racial gap in party preferences in his first five years, unless there is a dramatic shift among whites toward the Democratic Party or among nonwhites toward the GOP in the next three years, party preferences will end up more racially polarized in Obama’s presidency than in his two predecessors’ administrations.
Political pundits have generated a narrative which concludes that changing racial demographics will continue to make the Republican Party noncompetitive on a national level. The election of Barack Obama was viewed by mainstream political analysts as a coronation for “the browning of America”, and the Republican Party’s near, if not, inevitable obsolescence as a competitive political party.
I have thought for some time that such a claim is premature because politics is a “push and pull” story.
The Republicans have aggressively reacted to the election of Barack Obama, the country’s first black president, with a strategy designed to use racial anxiety and overt racism to win the support of new white voters while simultaneously mobilizing its existing base.

In the March 31 edition of the New Yorker there’s a great profile of Kobe Bryant by Ben McGrath. In it, Bryant talks about aging out of his Hall of Fame career with the Los Angeles Lakers, and how he thinks his fame is “pretty fucking cool” for a kid who grew up in Italy and moved to suburban Philly as a teenager.
Throughout his career, Bryant’s been talking about as an outsider, specifically when it comes to being the most famous in the world in a sport that’s overwhelmingly black. It’s given him a politically moderate stance on things, which was on display when McGrath brought up the subject of LeBron James posting a photo online of the Heat players dressed in hoodies in solidarity with Trayvon Martin.
I won’t react to something just because I’m supposed to, because I’m an African-American,” he said. “That argument doesn’t make any sense to me. So we want to advance as a society and a culture, but, say, if something happens to an African-American we immediately come to his defense? Yet you want to talk about how far we’ve progressed as a society? Well, we’ve progressed as a society, then don’t jump to somebody’s defense just because they’re African-American. You sit and you listen to the facts just like you would in any other situation, right? So I won’t assert myself.”
The profile goes on to quote former NFL running back Jim Brown, who at one point said, “[Kobe] is somewhat confused about culture, because he was brought up in another country.” Bryant then defended himself on Twitter, writing, “A ‘Global’ African American is an inferior shade to ‘American’ African American?? #hmmm. that doesn’t sound very #Mandela or #DrKing sir.”
Setting aside a minute the fact that Bryant doesn’t seem know much about the Trayvon Martin case, what strikes me about this exchange is his insistence on questioning what it means to be black in America, particularly from the perspective of someone who grew up elsewhere. In this vein I think of Zade Smith and Chimimanda Ngozi Adichie’s recent discussion at the Schomburg, where Adichie talked at length about coming to the United States from Nigeria and learning how deeply embedded race is in American culture. What sets Bryant apart is his stingy insistence on clinging to a “post-racial” identity, this very old, conservative notion that black people should not be treated differently in this country — despite all of the evidence, like Martin’s death, that they are. People didn’t stand up for Trayvon Martin just because he was a black boy, they did it because his death so sharply illustrated the dangers of being a black boy in America.

One of the things we know from reading about President Obama’s life story is that while he was practicing law in Chicago, he taught classes on the topic of “power.” I’ve always wished that either he or someone who attended one would outline the content of what he taught. Perhaps the President will do that once his second term is over.
He doesn’t tend to speak directly about the topic, but from listening to him refer to it in other contexts, what I’ve deduced is that he embraces the power of partnership as the alternative to our more traditional concept of the power of domination. Today the President began his speech in Brussels with a history lesson on the power of partnership vs the power of domination.

Survivors Of Domestic Violence Now Have Better Access To Obamacare Benefits

Survivors of domestic violence who are living separately from an abusive spouse will now be able to claim tax credits to help them afford an Obamacare plan, thanks to new rules being developed by the federal government. Before the change, these individuals were locked out of federal assistance for health care unless they filed joint taxes with their abuser.
Obamacare’s tax credits are intended to ensure that insurance plans on the new marketplaces are affordable for the Americans who may otherwise struggle to pay for health care. Early estimates suggest that up to 80 percent of the people signing up for Obamacare will qualify for some type of federal assistance, allowing some Americans to pay less than $100 per month in premiums for their health insurance.
But in order for married people to qualify, the health law requires them to file their taxes jointly. If they file separately, they lose out on the federal assistance altogether. Domestic violence prevention advocates argue that policy ends up harming victims of abuse — particularly because domestic violence is more concentrated among low-income households, and the victims who are financially dependent on their abusers are less likely to be able to extricate themselves from the relationship.
Last week, a group of 79 lawmakers, led by Reps. Louise Slaughter (D-NY) and Lloyd Doggett (D-TX), urged the Treasury Department to change this policy and safeguard victims of domestic violence. It only took a few days for Treasury officials to agree.
“For victims of domestic abuse, contacting a spouse for purposes of filing a joint return may pose a risk of injury or trauma or, if the spouse is subject to a restraining order, may be legally prohibited. Your concerns are consistent to those expressed to us by numerous others in public comments and meetings,” the Treasury Department acknowledged on Wednesday in a written response to Slaughter and Doggett, explaining that the administration will work on finalizing a new rule on this issue.

Anti-Obamacare Governor Now Encouraging Residents To Enroll Under Health Law

Wisconsin Gov. Scott Walker (R), an ardent Affordable Care Act critic, is now encouraging residents to transition into new health plans under the very reform law that he once refused to help implement.
Walker told the Washington Examiner’s Philip A. Klein that he has instructed state agencies to work with individuals who are transitioning into plans offered on Wisconsin’s Obamacare marketplace. That includes both the previously uninsured and poor residents just above the poverty level who are being siphoned out of the state’s Medicaid program, BadgerCare, and into private ACA plans under Walker’s conservative alternative to Obamacare’s optional Medicaid expansion.
Just two years ago, Walker was singing a very different tune. He had refused to create a statewide ACA marketplace — thereby also forgoing significant federal funding for Obamacare outreach efforts — and said he wouldn’t lift a finger to help implement the law until the Supreme Court decided the law’s fate. In fact, Wisconsin’s spending on ACA outreach is the lowest in the nation at just 46 cents per capita.
Walker eventually went even further than that. He said that he wouldn’t do anything about the health law at all until after the 2012 November elections, in the hopes that Mitt Romney would win and repeal the law, making implementation efforts moot.
But now that Obama has been re-elected and the ACA is actually going into effect, Walker is admitting that it could provide a boost for many Wisconsinites. “I don’t want people to fall between the cracks,” said Walker in his Examiner interview. “[U]ntil we can change and come up with something better to replace the law, we still care about our constituents, we still want people to do well.”
It’s a tacit acknowledgment that Obamacare is actually a good deal for the more than half million uninsured state residents. Some of the poorer Wisconsin localities, such as Racine County, suffer from disproportionate numbers of early deaths and STDs and have higher rates of infant mortality.

An Enraged John Boehner Blows Up After Obama Thwarts His Plan To Screw the Uninsured

John Boehner flew into an angry rage after finding out that the next phase in his plan to keep millions uninsured had been derailed by President Obama.
What Speaker Boehner is so angry about is the fact that the Obama administration won’t screw over people who begin the enrollment process by March 31. According to the HHS blog, “We are ready for consumers. It’s now time for you to check out your options and signup by March 31. And don’t worry, for those consumers who are in line by the March 31st deadline to complete enrollment—either online or over the phone – we’ll make sure you get covered. Just like Election Day, if you are in line when the polls close, you get to vote. We won’t close the door on those who tried to get covered and were unable to do so through no fault of their own. So, those who were in line or had technical problems with the website can quickly come back and sign up as soon as possible.”
What is really ticking Republicans off is that Obama administration is allowing people weren’t able to sign up due to the website issues an extra few weeks to finish the enrollment process.
Boehner and his House Republicans thought that they had it all figured out. They were getting ready for another round of Obamacare “horror stories” based on the people who may have not been able to complete their ACA signups high consumer demand around the deadline, or the previous website issues in October of 2013.

Ruth Bader Ginsburg Is Irreplaceable
All you liberals trying to push her out, think about that.

… Over at the Atlantic, professor Garrett Epps has just written in defense of Ginsburg. You should read the whole piece, but two important points he makes are worth repeating: Ginsburg plays a crucially important role in the Roberts Court as the senior justice on the liberal bloc, not just in terms of assigning opinions but in terms of writing them. If anything, Ginsburg has been stronger in recent years than ever and has been a crisper, more urgent voice for women’s rights, minority rights, affirmative action, and the dignity of those who often go unseen at the high court than ever before. She has gone from rarely reading her dissents from the bench to doing so with great frequency, calling out the majority for what she sees as grave injustices and proving that her voice is both fiery and indispensible. Telling her that her work is awesome, but it’s time to move on is tantamount to saying that a liberal is a liberal and that Ginsburg brings nothing to the table that another Obama appointee will not replicate. That analysis suffers from exactly the same realpolitik flaw Ginsburg’s critics ascribe to her: that counting to four, or five, is more important that the justice herself. Ginsburg, like Antonin Scalia, is writing those dissents for law students, for the case books, and for Congress. Not all justices are created equal in that regard…
It strikes me as interesting that regular court-watchers tend to be affronted by suggestions that it’s time for Ginsburg to go, just as political scientists are astonished that it isn’t. Maybe Linda Greenhouse, Epps, Bazelon, and others are considered by the Ginsburg’s-got-to-go crowd as simply captive to the same “justices aren’t political” brainwashing as Ginsburg, but maybe they just see Ginsburg through a different lens…
Reproductive rights advocate and writer Jessica Mason Pieklo suggests that it’s not the legacy of Roe we should be obsessing about anyhow, but rather why it is that Democrats can’t seat progressives no matter which party is in power. I agree. I’m not naive enough to suppose that a bird in the hand is always the answer, but the fact that President Obama can’t get a civil rights lawyer confirmed to a civil rights position in this political climate or seat a surgeon general who believes gun deaths are connected to public health tells me that the argument that he could easily confirm a Ginsburg 2.0 is naive as well. Ginsburg herself often says that the chances of another Ginsburg being confirmed to the court today are negligible. It’s perverse in the extreme to seek to bench Ginsburg the fighter, simply because Senate Democrats are unwilling or unable to fight for the next Ginsburg.
