Is Shellie Zimmerman Guilty of Negligence?

On July 13, 2013, the Brady Campaign issued a statement on the verdict of the George Zimmerman trial.  The Brady Campaign has been one of the leaders in fighting against “Stand Your Ground” or so-called, “shoot first” laws like the one in Florida.  In their most recent statement, the Brady Campaign wrote:

“The Brady Center, the legal arm of the Brady Campaign, has been at the forefront in fighting concealed weapons laws.  They recently filed an amicus brief along with the parents of Trayvon Martin, asking the entire United States Court of Appeals for the Seventh Circuit Court of Appeals to review and reverse a 2-1 decision that held Illinois law restricting the public carrying of firearms unconstitutional.” 

The Brady Campaign filed the brief on behalf of the Brady Center to Prevent Gun Violence; Tracy Martin and Sybrina Fulton, parents of Trayvon Martin; Ron Davis and Lucia McBath, parents of Jordan Davis; Major Cities Chiefs Association; and International Brotherhood of Police Officers by attorneys with the Brady Center’s Legal Action Project and the firm Hogan Lovells US LLP.

Dan Gross is president of the Brady Center to Prevent Gun Violence and The Brady Campaign.  The public has not heard enough about this organization, but hopefully that will change with the posting of this article.  Their Twitter is Brady Campaign @bradybuzz and they are also on Facebook. Dan Gross took on the role of President in February 2012, and they have been busy.   It was while reading cases in their Legal Action Center that a light bulb moment occurred about Shellie Zimmerman.

There is a possibility that Tracy Martin and Sybrina Fulton will file a civil suit against George Zimmerman for wrongful death.  On December 4, 2012, Click Orlando reported that the Florida Department of Law Enforcement (FDLE) obtained ATF records on Zimmerman’s gun, which was used to kill Martin.  It was purchased Nov. 11, 2009 by Shellie Zimmerman at Shoot Straight II in Casselberry.

George Zimmerman told detective Chris Serino that he is ADHD, and was diagnosed when a child.  According to George Zimmerman’s medical records of February 27, 2012, he was taking Adderall, Temazepam, and Omeprazole.

Zimmerman's medical record - largerAdderall is used in the treatment of ADHD, is habit-forming, and contains a combination of amphetamine and dextroamphetamine.  It is a central nervous system stimulant that affects chemicals in the brain and nerves that contribute to hyperactivity and impulse control.

Temazepam affects chemicals in the brain that may become unbalanced and cause sleep problems and is used to treat insomnia symptoms.  Temazepam can cause side effects that may impair thinking or reactions.  (Source: PDR.net)

George and ShellieShellie Zimmerman knew, or had good reason to know, that George was taking prescription medications that stimulate chemicals in the brain and nerves that contribute to impulse control, and that may also have a side effect of impaired thinking or reactions.  In spite of this knowledge, Shellie allowed George to carry the gun that she purchased.

Shellie Zimmerman’s actions might be negligent contributory in the killing of Trayvon Martin.

    Interesting – GZ was on Rt 80 in Forney, TX, when stopped for speeding. Midland (site of NRA event) is directly west of there, and not that far. Could he have been heading to Midland for scheduled NRA event on August 2?

    George Zimmerman is still armed and theoretically dangerous … he was stopped by cops for speeding and revealed he had a gun in his glove compartment.

    Zimmerman was speeding in Forney, Texas on Sunday, just after noon, when he was stopped by police. Zimmerman told cops he was headed “nowhere in particular,” and informed them he had a firearm in his glove compartment.

    Zimmerman was given a warning, after cops determined he was free of warrants. He was sent on his way with a polite goodbye, “Have a safe trip.”

    The stop lasted around 5 minutes.

    BTW … law enforcement tells TMZ … he was NOT wearing a disguise … it was full blown George Zimmerman.

          My wife came home from work today and related a story of a patient of theirs who bought a 2nd home in FL and he stated everyone he knows carries a gun. He said the state doesn’t really ck anything during a CCW application and his neighbor shot & killed someone a few years ago and the cops just went…..”eh, hell….what are ya gonna do……here’s your gun back, just be a little more careful next time”

          He said the shooter had no CCW permit & the gun was unregistered……Hmmmm, looks like NJ ain’t that bad after all.

    Democrats in Congress hope the Travyon Martin tragedy can help them accomplish something they have worked on for years to no avail: an end to racial profiling.

    “Trayvon is one of too many individuals across the country who have been victimized by a perception of criminality simply because of their race, ethnicity, religion or national origin. These individuals are denied the basic respect and equal treatment that is the right of every American,” says Rep. John Conyers, D-Mich., who is sponsoring the End Racial Profiling Act.

    Congress is using the lessons of the Martin case to push for legislation that would make it illegal for law enforcement agencies to profile individuals as criminals on a basis of the skin color or religious practice. Law enforcement agencies that rely on federal government funding would be required to show they did not use racial profiling in their agency.

    Conyers introduced the End Racial Profiling Act Tuesday alongside longtime supporter Sen. Ben Cardin, D-Md., who is sponsoring the Senate version of the bill.

    Aside from banning racial profiling, the bill seeks to strengthen law enforcement training to ensure officers are basing their patrols and apprehensions based on behavior not skin color.

    @SG2. You mentioned Adam Pollock being on Dr. Drew. I caught the replay. When people believe that others believe their lies, they don’t pay attention to how they contradict themselves. This is what I mean ….

    Adam Pollock said that all he did was put GZ on a diet and exercise program. Then, he said the morning after GZ killed Trayvon, he contacted him the next morning to thank him for saving his life. Adam asked how and GZ replied that he taught him shrimping, saying that he was able to move his head off the concrete.

    So in one breath, Adam says he didn’t teach GZ anything and on the other hand, he takes credit for teaching GZ shrimping. Also at trial, Pollock testified that GZ had not progressed in any self-defense classes.

    Then too, GZ showed up for work the next morning and was told he needed a doctor’s statement and police report. GZ was seen by the physician’s assistance and approved to return to work. So, when did he have time to call Adam?

You might remember that I’ve consistently mentioned that Zimmerman moved out of his residence after leaving the police station when Trayvon had not been identified and the media had not reported anything. Who was he really afraid of? I’ve pondered it is whomever opened up a can of whup azz on him the Friday or Saturday before 2/26/12. Whomever that is, is still out there. That is why Zimmerman is afraid.

There are times when I reread some of Lonnies theories, what you’ve posted and what I observe and add a bit of logic and try to think about what they have let loose with the Freudian slips. “…shot someone else…” I firmly believe he targeted someone he had issue with that who not known to anyone but he, SheLie, the actual target and possibly one or 2 of the targets friends, and I’ll venture a wild guess they weren’t involved in any rollover accident.

          None of them will ever come forward and say anything……..shit, if he stays away, they win.

            @racerrodig. I followed much of Lonnie’s theory about the 3 stooges and that they matched the descriptions of the guys with Emmanuel Burgess when he was arrested. There is reasonable consideration that they had been watching Trayvon during his stay at Brandy’s and saw when he left the house and walked to the 7-Eleven. For all they knew, he was a new kid on the block to “befriend” and recruit to the burglary ring.

            And I still say that the state had reason to enter that M&I Bank video into discovery. It disappointed me that they failed to bring it out during trial, because along with myself, there are many others who believe the guy at the drive-through at 6:38 p.m. is Osterman. That would be around the time that Trayvon was walking back home.

            Why does Taaffe rant so much ?? What on God’s green earth is really going on ??

            Taaffe embraces sovereign citizenship ideologies. They love having an audience and don’t know how to keep their mouths shut.

        Racer, on Larry O’Donnell’s show back in April 2012 Oliver made an odd statement. He said that whenever there’s a family function George was the only one who didn’t drink.

        Xena, IIRC Oliver also stated that George contacted him a week before the shooting because he had fallen off the wagon.

        I wonder if that is when the crap hit the fan and Osterman and his family found out that didn’t graduate after all and he allowed them to throw him the granduation party anyway.

        Plus he was scheduled to be evicted three days after he murdered Trayvon.

        I still believe that George had mixed booze with his prescription meds the night he murdered Trayvon and that’s why he was in such an aggressive and foul mood that night.

        What better way to boost his sagging ego, become the neighborhood hero and secure a place to stay a few more months than to catch ‘one of those who always get away’?

    Idealistic’s argument fails the same way a drunk drivers does. The nicest guy on the planet may be the biggest, most violent jerk on the planet when drunk. Nobody said drugs made Fogen do a damn thing. SheLie however should have made sure her gun never fell into the hands of ANYONE who is impaired in any way. That’s the law. In many states if a gun is stolen and used in a crime the actual owner may be liable and sued civilly.

  12. Let me clearly declare that I think Zimmerman is guilty. His wife is not responsicle for his actions. He is a grown man and my be responsible tor his words and actions. When was the last time you even thought of telling your spouse what to do. Besides, there are many people who take prescription drugs. They all have side effects and work on various areas of the brain. Drugs didn’t make Zimmerman shoot Travyon. It was his own choice.

The concept introduced in the article however, is likened to that for ownership of property that holds the owner accountable when they give others authority to use it. For instance, the owner of a car might give a licensed driver authority to use the car. If an accident occurs that damages the property of others or causes physical injury and/or death, the owner of the vehicle becomes a likely party in any civil action.

      Now, consider that the owner of the vehicle allowed the licensed driver to use the car while under the influence of alcohol or drugs.

      That is why the word “might” is used in the article. Based on legal action filed by the Brady Campaign, Shellie “might” be negligent.

          @Ametia. When I listen to GZ on his NEN call, I hear a person who is under the influence — maybe alcohol. There was a reason why GZ did not want to go to the hospital after claiming his injuries were life-threatening.

          You know, most victims alleging rape are required to agree to procedures that test for forced intercourse. Yet, victims using deadly force, purportedly in self-defense, whose injuries are alleged to be caused by the person they killed, are not required to agree and submit to medical tests such as urinalysis and blood.

          Do you think Shellie set GZ up to stalk the negroes at the Twins?

          Well, that’s a classic thought for White Supremacists and sovereign citizens — to protect White women from black men. Effectively, that is what GZ said he promised to Shellie when the neighbor’s house was broken into.
