    So, Attorney Todd Rutherford, who is representing Shakara, the girl who was assaulted at Spring Valley High, said her mother and grandmother are ALIVE. He said he has personally spoken to them. He wouldn’t say whether or not Shakara is in foster care.

    Attorney Rutherford said she’s charged criminally “with disturbing schools”. He says the school allows cell phones, but that the issue was whether or not Shakara “moved fast enough” to put her cell phone away.

    He also said that he’s working to get a GoFundMe page up, but because people have been creating fraudulent pages, it’s been difficult. He’s working with GoFundMe and should have a page set up today.

    BTW, Attorney Rutherford is the Minority Leader in the S.C. State Legislature and is also representing the other girl who was arrested AND the young man who took the video of the Walter Scott shooting.

    After watching the video of Deputy Ben Fields assaulting a teen girl in her classroom, and following the national coverage of the fallout from this incident, I had no doubt Fields would eventually be publicly reprimanded, suspended, and eventually fired. Which he was, today. His superiors had no choice but to do so; the footage was too brutal, Fields’s history was too volatile, the difference in physical size between Fields — seen here bench-pressing 600 freaking pounds — and the girl was too stark, and the racial context was too thick.

    I guess this — Fields’s firing — is supposed to be vindicating. And perhaps it is for the students and others directly impacted by his employment. He will no longer have carte blanche to terrorize students at Spring Valley High School, and this is a good thing. But, I don’t know. I just don’t feel any type of victory when a Ben Fields or a George Zimmerman or a Darren Wilson or a Ray Tensing or a Napa Valley Wine Train is forced to apologize or is reprimanded or is fired or is arrested. Because the damage the acts done by these people cause have more of a psychic, emotional, and physical cost than any type of acknowledgement of the wrongdoing can cover. The Black body isn’t a department store where busted shoplifters can apologize for and replace boosted items. There’s no storewide insurance policy to fix the damage done to a human body and a human spirit. The shit that happened to that girl at Spring Valley High School will never be fixed. Will never unhappen. The scars she was given that day will stay with her until she dies. Perhaps they’ll get better with time. And perhaps they’ll eventually just exist in the recesses of her mind. But they will never not be there.

      The adults involved in this are completely devoid of compassion in addition to being incompetent and cruel. I feel so bad for this kid. She must feel as though she is completely alone with no one on her side. But it sounds like her foster mother is trying. And she has a good lawyer. Hopefully she will sue the school district and get enough for college and law school.

        Yeah, I know. And who knows how much that the phone meant to her. Maybe it had pictures of her mother and grandmother. Maybe it was a gift from one of them. Maybe she is hyper-sensitive from all of her recent trauma, all of that loss and being put in foster care, and she just couldn’t handle the injustice, being treated with such meanness. Then they bring in a cop who they know will assault her. They are damn lucky he didn’t break her neck or leave her mutilated in some way, because it certainly looks like that was a possibility.

    Our kids, who already face enormous pressure in life, should never be subjected to state-sponsored violence while in school. For this young girl, Spring Valley High School should’ve been a refuge.

    Instead, it was something far worse.

    Mr. Long made no connection with the student to begin with

    Mr. Long had no desire to make a connection with this student

    Mr. Long had zero empathy for the student after being assaulted in the class

    Mr. Long had zero concern for the other students in the class who witnessed the situation

    Under no circumstances should this girl ever return to Mr. Long’s class.

    I like to look for what’s behind the scenes, not what’s on stage. Let’s pull the curtains back on Mr. Long, shall we?

      According to Sheriff Lott both the teacher and principal approved of Ofc. Fields’ action and do not believe that Ofc. Fields used excessive force.

      If that is true, neither the teacher or principal should be kept on staff at that school.

    Officer Ben Fields has been fired. Sheriff Lott says he was terminated because Fields “threw the student” after getting her out of the chair. (Sounds as if it was not because he dumped her out of her desk.)

      Wow, Lott said that training says you are not to lose control of unarmed subject and that by throwing the student, Ofc. Fields lost control of student. Also, should not use pain compliance technique against subject and Ofc. Fields broke training techniques by throwing student.

        Now is the time to demand that the county prosecutor charges Ofc. Fields with assault and excessive force.

      I think that Sheriff Lott had no choice but to fire Ben Fields given nationwide public outrage and the officer’s prior record with using excessive force. And, of course, the students are going to talk about “Officer Slam.” So, the cat is out of the bag, and Sheriff Lott is doing damage control. The reason for termination is what he thinks is best for himself and his department.

    STOCKBRIDGE, Ga. — To hear Mikia Hutchings speak, one must lean in close, as her voice barely rises above a whisper. In report cards, her teachers describe her as “very focused,” someone who follows the rules and stays on task. So it was a surprise for her grandmother when Mikia, 12, and a friend got into trouble for writing graffiti on the walls of a gym bathroom at Dutchtown Middle School in Henry County last year.

    Even more of a surprise was the penalty after her family disputed the role she was accused of playing in the vandalism and said it could not pay about $100 in restitution. While both students were suspended from school for a few days, Mikia had to face a school disciplinary hearing and, a few weeks later, a visit by a uniformed officer from the local Sheriff’s Department, who served her grandmother with papers accusing Mikia of a trespassing misdemeanor and, potentially, a felony.

    Sakinah White, a teacher, said her 17-year-old daughter tried to hurt herself after an incident at school led to criminal charges
    As part of an agreement with the state to have the charges dismissed in juvenile court, Mikia admitted to the allegations of criminal trespassing. Mikia, who is African-American, spent her summer on probation, under a 7 p.m. curfew, and had to complete 16 hours of community service in addition to writing an apology letter to a student whose sneakers were defaced in the incident.

    This girl’s BRUTAL and FRIGHTENING treatment by Ofc. Ben Fields over the very minor infraction of having her cellphone out for a brief moment during class is a PRIMARY example of how members of the Black community are treated in our society.

    I personally do not believe that this would have happened to a White student because officers know that White parents and the White community have the clout in this White-controlled society to have their complaints heard and acted upon immediately by the powers that be. This advantage/privilege is not afforded to Black parents and the Black community as things stand now in our society.

    I am disgusted that we still have to push for and demand equality and justice for Blacks in today’s society. Societal conditions should have changed for the better long ago.

    Ha! Just as I thought. The teacher made something of nothing, and this was more about the teacher than the child. Which is why the little girl refused to leave, she felt she was being unjustly punished, and she was.

    On Monday afternoon, during an otherwise routine math class at Spring Valley High School in Columbia, South Carolina, a peaceful, non-threatening teenage girl who was sitting quietly at her desk, was mauled by an adult bodybuilder. Picked up while in this desk, and tossed to and fro by the muscle-bound man, the teenager was not just humiliated, but injured. Many of her fellow students were frozen in fear and others busted out in audible sobs.

    These are facts, but because the bodybuilder was a police officer, Ben Fields, he has been given a level of deference that no man who assaults a young girl should ever be given. This young girl, who classmates claimed was only in trouble with her teacher because she had her cell phone out in class, should’ve never been manhandled like this. She was not a physical threat. She was not armed. She was not dangerous. Students stated that she was actually so quiet that the bigger disruption was the teacher insisting she go to the front office over having a cell phone.

    Few incidents better communicate just how over-policed America, particularly Black America, is in 2015 than a teenage girl being thrown around like a rag doll over having a cell phone in class. Whether this was a violation of a school rule or not, it wasn’t a crime, and is among the most minor violations of school rules. For such horrendous force to be used by an intimidating officer on a young girl should’ve resulted in the immediate termination of Officer Ben Fields.

    When justice is delayed, in this instance or others, it sends a complicated message to every stakeholder in the community that the behavior isn’t quite as severe as our eyes, heart, and mind tell us it is. What’s to be investigated in this case?

    The student did nothing to warrant such an extreme reaction from the officer and it was so violent, so severe, that he will never be trusted by students in that school, or any school, again. Within hours of this incident going public, students from previous years began speaking of numerous other instances in which Officer Ben Fields was brutal. He was the subject of a police brutality lawsuit previously and is currently being sued for racial profiling from another black student in the school.

    It’s hard enough that American students live under the constant fear of school shootings from random gunmen, they should never, ever have to suffer from police brutality in their place of learning.

        This is clearly a case of the “responsible” adults having lost all perspective. This was a small infraction by any measure, and the series of overreactions that led to the brutal beating of a little girl are unpardonable. The bully cop has been around for awhile, they knew what he would do to that kid, or they had a pretty good idea what would happen. They are complicit. We can safely bet there are some longstanding problems in that school and this is just the pus bursting from the cyst because there was a video that went viral.

          I was so impressed with the other young girl Niya Kenny – I saw her on the Chris Hayes show and she absolutely put all of the adults I’ve heard thus far to shame…She was so clear and so wise…She even said she knew by the way the ‘300 pound male adult’ responded to the 16 year old girl, that the situation was going to get out of hand.

The teacher is the adult and is supposed to have a clear head, so why did such a small infraction by a student escalate into the teacher demanding that the child be removed from class and summoning the bully cop?

      “Put that cell phone away and do not let me see it again” might have worked.

    I do not know what happened in that classroom at Spring Valley High School before Deputy Ben Fields violently assaulted a teen girl who was, apparently, “resisting arrest.” I’m quite sure, however, that information will find its way into the public sphere very soon. We will also know more about Deputy Fields — his work history, his relationship with the students, his personal life — and we will definitely know more about the girl who was the victim of assault. Perhaps her name won’t be made public, but her academic record and behavioral history will likely be. There will also be conversations about the need to have actual police officers in schools, and whether their presence helps control or helps contribute to an adverse environment.

    All of this context will congeal to cloud and color how this case will be deconstructed, assessed, and, ultimately, decided. And this will be the wrongest thing to do, because none of that matters here. At least not in a macro sense. The only thing that matters when deciding how to think about and discuss this story is race. Specifically, the race of the officer (White) and the race of the student who was assaulted (Black). This is where the conversation about this — any conversation about this — needs to start. And then, once you acknowledge that the most meaningful conversation to have about this story needs to start with race, you’ll be more prepared for the next conversation, which is a bit more complex.

    I have no doubt that if the student who was assaulted happened to be a Black boy instead of a Black girl, the assault still would have occurred. I also don’t have much doubt that if the student who was assaulted happened to be a White boy, the assault still might have occurred. Maybe it wouldn’t have. But I’m not confident in saying that. I can still see it happening.

    Teachers have the right to teach class without disruption of any kind.

    Students have the right to attend school without being bodyslammed by the police for non-physical fights.

    Both of these things are true and are not in opposition to one another. People seem to feel nothing should’ve been done to the girl at all OR the cop had the right to bodyslam & toss up the girl.

    The girl should’ve gotten up and gone to the principal’s office when told to. Period, end of story.

    The teacher should’ve told the girl “once” to put the cell phone up; when she resisted issue her an automatic detention & continued teaching the class. The end.

    Another way he could’ve handled it is ignore the cell phone use during class time but pull the girl to the side after class & told her don’t do it again.

    The school administrator/principal should’ve instructed the class to go to the library for the rest of class time while he & the teacher dealt with the girl. After the class is gone, call the girl’s momma and tell her to come to school ASAP and collect her child. If momma says she ain’t/can’t come, tell momma if girl is still in the classroom after school hours, they will call the police and charge her with trespassing. If momma still doesn’t come to school & girl is still there, call the police and have her taken off the premises & charged with trespassing. If momma does come to the school, tell momma what happened & to keep girl at home for the rest of the week because she’s suspended.

    Unless the girl was physically fighting the teacher, physically fighting somebody else, throwing chairs/books/sharp objects, yelling/screaming at the top of her lungs etc or refusing to leave the classroom/school after school hours……no SRO should’ve been called.

    But all of this occurred because the white teacher didn’t like his authority being challenged. One of the kids asked the teacher if he felt bad that happened to the girl and he said Nope, she should’ve complied. Under no circumstances should that girl ever go back to that teacher’s class.

      If I had been the classroom teacher, I would have simply said to the student, “I want to talk with you after class”… and, if necessary, I would have set up a parent conference where I would have encouraged the student to be attentive during class and not be distracted by her cellphone so that she could live up to her potential in the subject matter being taught.

    COLUMBIA, S.C. — A South Carolina school district banned a school resource officer pending an investigation after a video surfaced Monday showing him tossing a student across a classroom floor.

    The video has since gone viral.

    The incident, captured on cellphones of at least two students, occurred at Spring Valley High School in Columbia. School officials and sheriff’s deputies said they are investigating what happened.

    Richland County Sheriff’s Department spokesperson Lt. Curtis Wilson says Sheriff Leon Lott has asked the FBI and U.S, Department of Justice to investigate the incident.

    An FBI source confirmed to CBS News Tuesday that the agency had spoken to Lott, adding that the FBI is looking into any possible federal avenues of investigation.

    Richland County (school) District Two Superintendent Debbie Hamm said in a prepared statement that, “Pending the outcome of the [local] investigation, the district has directed that the school resource officer not return to any school in the district,”

    In a statement to CBS affiliate WLTX-TV in Columbia, spokesperson Libby Roof said on Hamm’s behalf that the district is “deeply concerned” about the incident.

      I appreciate and applaud Marc Lamont Hill’s unrelenting focus on today’s violent attack on the little black schoolgirl in South Carolina, but if we are to be honest, much of this disparaging and violence against black women we could deal with and fight back so much easier if our black men didn’t treat black women just as horridly and didn’t propagate and perpetuate the ugly stereotypes that in many ways excuse and exacerbate the violent mistreatment of black girls and black women by society…

      Sandra Bland gets hurled off to jail and murdered – but there’s no real sympathy or outrage because it’s ‘her fault’ for being ‘mouthy’ and ‘hot-headed’ for refusing to put out her cigarette in her own car after being stopped for a bogus traffic infraction… One wonders how many Chris Rock, Kevin Hart and other black ‘comedians’ routines denigrating and negatively stereotyping black women these officers must have seen or heard of – that in so many ways help along their lack of respect for black women – and validate their violent mistreatment of black women in general… It’s not unusual these days to find racist whites mocking black people with played out negative stereotypes – complete with their mocking interpretations in ‘ebonics’ ..

      I’ve seen the many ways black women’s contributions to and standing in their marriage and society is subtly, if not outrightly diminished or dismissed…

      It’s evident in seemingly harmless routines by white comedian Gary Owens who thinks being married to a black woman gives him a pass to disrespect and passive-aggressively diminish and dismiss the first black First Lady – even as Mr. Owens insists that the Princeton and Harvard educated young black woman who met her then future husband (older than her by 3 years by the way), when he was a first year law student intern at the Law firm where she was already working after having graduating and being recruited from said Harvard Law school – and had access to Law partners, other fully-fleshed out and ambitious attorneys, was somehow just so calculating, she instead hitched her gold-digging professional self to the broke intern’s wagon …

      Or the British asshole Milo Yiannopoulos here on a work visa working for Breitbart – whose targeted and unbelievably malicious and denigratory attacks on our first black First Lady have not only been permitted, but has been allowed to continue… As someone pointed out, there’s no way an American living in England would have the nerve to brazenly insult or attack any member of the royal family – or even David Cameron’s wife…Nor could this asshole get away with denigrating Laura Bush or Hillary Clinton…

    This reminds me of the assault by that cop in Texas of the young black girl at the pool party.

    This assault is totally unprovoked. The girl is just sitting in the desk when the cop forcefully yanks her out of the desk and then slams her on to the floor. And why are students being arrested for being “verbally disruptive,” assuming that is even true? WTF is going on?

    The girl is so small and the cop is thrashing her around as though she is an animal and he is someone who tortures animals. He doesn’t even treat her like a human. But I suspect he does this a lot, you can tell by his actions.

    This cop needs his a$$ fired before he kills someone, if he hasn’t already.

      I might add that the next time the DOJ writes one of their reports, they should make a point of this. That the time to fire a cop is BEFORE he kills someone, when he shows a willingness to viciously and brutally assault a person for absolutely no reason. This assault is particularly egregious because the victim is a young girl, a child.

        All this while at home, racist white police officers and a few wannabe non-white ones desperate to belong, are murdering innocent black kids and adults in cold blood..

        Ditto. And I am very serious. THIS really is the time to fire a cop, when the cop has shown that he is incapable of sound judgement and becomes violent. You can’t “train” this out of a person. He has no business “upholding the law” on behalf of the citizens who pay him. He’s a thug in uniform and he needs to be relieved of his duties.

        As a black woman in this country, lynch should be outraged, but alas I feel she’s more interested in keeping the lily white structure of perceived justice that this country has perpetuated. A structure meant to keep black and brown populations in slavery. The doj can miss me with their reports and Mrs. Lynch should find a way to remember that without her job and title she still black as fuck and that will always be what racists see first when they see her.
