Open Thread | The Supreme Court on Presidential Immunity

Today’s decision is about as big a win for Trump as he could have possibly wanted for expected. The conservative supermajority creates a sweeping new kind of “presidential immunity” that will insulate MANY of his allegedly criminal acts from indictment or prosecution. Just huge.

I just want to take a step back and say that I think the Supreme Court just fundamentally altered the structure and nature of democracy in America. It awards the president the measure of power and immunity that is much, much closer to a king or emperor than an elected official.

The Supreme Court’s conservative supermajority establishes new principles—located nowhere in the text of the Constitution—that permanently shield the president from meaningful accountability when he weaponizes the tools of his office for criminal purposes. That is shocking.

Eric Holder (@EricHolder) posted at 10:11 AM on Mon, Jul 01, 2024:

Our democracy has been gravely wounded

The Trump immunity decision says: a president CAN VIOLATE THE CRIMINAL LAW if he acts within his broadly defined “constitutional authority”

Absurd and dangerous

There is no basis in the Constitution for this Court constructed monstrosity

From the dissenting Justice Sotomayor:

Today’s decision to grant former Presidents criminal immunity reshapes the institution of the Presidency. It makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law.
Relying on little more than its own misguided wisdom about the need for ‘ bold and unhesitating action’ by the President, ante, at 3, 13, the Court gives former President Trump all the immunity he asked for and more. Because, our Constitution does not shield a former President from answering for criminal and treasonous acts, I dissent.

………………………

More From Justice Sotomayor’s dissent:
Never in the history of our Republic has a President had reason to believe that he would be immune from criminal prosecution if he used the trappings of his office to violate the criminal law. Moving forward, however, all former Presidents will be cloaked in such immunity. If the occupant of that office misuses official power for personal gain, the criminal law that the resto f us must abide will not provide a backstop.

With fear for our democracy, I dissent.

Justice Brown Jackson dissenting:

Katie Phang (@KatiePhang) posted at 3:55 PM on Mon, Jul 01, 2024:
Justice Jackson’s dissent: “…the Court today transfers from the political branches to itself the power to decide when the President can be held accountable.”

“…while Congress (the branch of our Government most accountable to the People) is the entity our Constitution tasks with deciding, as a general matter, what conduct is on or off limits, the Court has now arrogated that power until itself when that question pertains to the President.”

It can never again be said that in America “no man is above the law.” The Supreme Court held today that the President of the United States — and the former president in particular — is above the law, and the only person in America who is above the law.

Snappy summary of the day: 1. The Supreme Court is thoroughly corrupt and has given a green light to a criminal running for president to commit more crimes in office. 2. This is the constitutional crisis of our time. 3. Biden should run nearly exclusively on this. On the crimes Trump did and would commit. 4. No one would be safe because he literally could order anyone’s execution as “commander in chief” 5. Run on “We will not be ruled by a king.” 6. On July 4 rededicate ourselves to independence from a monarch (trump) and his court jesters. 7. Rally the base and independents.

Among some of the cuts included in the GOP/Heritage Foundation Project 2025 proposals are eliminating disability compensation, ending medical enrollment in the VA for some veterans, and limiting disability claims to 10 years after service.

This is shameful for the GOP to even propose. An insult to our men and women who have served our country!

Reminder that John Roberts, Brett Kavanaugh, and Amy Coney Barrett were all on Bush’s Florida-recount team.

Reminder too of John Paul Stevens’s prophetic dissent in that infamous case:

Donald Trump needs to be careful what he wished for — the Supreme Court’s decision now means Judge Chutkan will hold proceedings on whether Trump’s actions were “official acts” of the presidency.

This could be a trial before the trial, potentially RUINING Trump politically.

The Supreme Court, in eviscerating decades of administrative law, running roughshod over women’s privacy rights and impeding the federal government’s power to regulate securities law, has aggrandized more power to itself than any court in history. However, in one tiny ray of sunshine, we saw on Friday in the Fischer case, that with the handiwork of Justice Ketanji Brown Jackson, the court’s avarice can be contained.

    1. No immunity for unofficial acts; pressuring state officials, fake electors scheme, public statements made as a candidate likely qualify;
    2. Immunity for official acts is only presumptive. Conduct must fall within “conclusive and preclusive constitutional authority.” Meetings with VP Pence still on the table.
