BREAKING: MSNBC now reporting that the full grand jury never actually reviewed the indictment against James Comey.

Prosecutors say when the grand jury refused to approve one of the counts, Halligan allegedly altered the indictment and had only the foreperson sign it.

If true, that isn’t procedure. That’s manufacturing charges.

Judge Nachmanoff shut Halligan down after she tried to defend it, and Comey’s attorney declared, “There is no indictment.” With the statute of limitations now expired, the entire case may have just collapsed.

In the Comey 2nd indictment, it was an indictment by a single juror – the grand jury foreperson. One of the problems is that the foreperson signs on behalf of the other grand jurors. How can the foreperson sign on behalf of jurors who never saw the 2nd indictment? Also, how can the foreperson sign the new indictment without being re-instructed on the law? Simply because one was previously instructed for a previous indictment did not relieve the govt of the obligation to instruct the grand jurors on the law before they vote on the new indictment.

DOJ Prosecutors just admitted to a judge that instead of presenting a new indictment to the grand jury after it declined to approve one of the counts, Halligan simply brought an altered version to the magistrate’s courtroom for the grand jury’s foreperson to sign.

Meiselas this past Monday: The issue with the missing transcript involves the fact that the grand jury rejected the indictment when it had three counts. And according to Lindsay Halligan, she had to go back, print out another document because the grand jury was confused about what it looked like. And then she brought back a two count indictment, and she said the grand jury then agreed to this two count indictment.

That’s the part that’s missing in the transcript. That’s what Judge Currie in the disqualification hearing was referring to. The idea that she may have just presented a document as the grand jury indicting James Comey that they never even saw or they weren’t aware of, because that’s not captured on the transcript.

That goes beyond disbarment. I want to be very careful with my language, because we don’t know yet. But if that’s what took place, that’s criminal. That’s literally a criminal act that in normal times would put somebody away for 20 or 30 years in prison…
