V.A. Begins Drive to Put Some Homeless Veterans Into Guardianship
The Trump administration will expand the power of government attorneys to initiate court proceedings for veterans “unable to make their own health care decisions.”

The Trump administration on Wednesday announced a new effort to initiate legal guardianships for hundreds of veterans, including some who are homeless or “at risk of homelessness,” that could be used to force more of them into involuntary or institutional care.
Under the new arrangement, the Justice Department would give officials at the Veterans Affairs Department authority they currently lack to initiate guardianship proceedings in state courts for veterans who have no family and are “unable to make their own health care decisions.”
If a state court determines that a veteran is incapable of making health care decisions, it would appoint a third-party guardian not employed by the V.A., who would be charged to act in the veterans’ best interests, said Pete Kasperowicz, the V.A. press secretary.
The initiative comes amid a push by the Trump administration to compel more homeless people into institutional treatment for mental illness and drug addiction.
President Trump identified homelessness as a priority during the 2024 presidential campaign and promoted it last July in an executive order that called on agencies to use civil commitment to move homeless people into “long-term institutional settings.”
Critics say the policy shift raises significant civil liberties concerns, noting that in earlier generations, people with severe mental illness were routinely stripped of their legal rights and confined to state hospitals.
Mr. Kasperowicz said the primary focus of the current effort was not homeless veterans, but a group of around 700 veterans who are currently in V.A. facilities and have no family or legal representation to help them transition to a new setting.
“These veterans are literally already stuck in institutions that may not be the most appropriate setting for them,” he said.
He said court determinations “would be made with full due process and process rights for the veterans involved, and continuous court supervision of the guardian.”

Guardianship powers are broader and longer lasting than civil commitment, which is used to compel someone to accept medical treatment.Guardianship proceedings are typically initiated by family members, friends or health care providers, and are argued before state or probate judges, with the subject entitled to legal representation. If a court finds that the person is not able to make basic decisions about health and safety, a guardian is appointed.
Guardians can control a person’s assets, where the person lives and whom he or she sees. They can also require the person to accept medical treatment. Unlike civil commitment rulings, which expire after a specific time period, guardianships are intended to be durable, though they are revisited periodically and can be terminated or dissolved.

That threat is angering Senate GOP critics of the bill, who think it’s poorly drafted and has no chance of passing. They say threats to punish them for not rallying behind the bill will only backfire as the party heads into a midterm election facing strong political headwinds, such as Trump’s low approval ratings and voter dissatisfaction over inflation and the economy.
“Circular firing squads never end well,” said Sen. Thom Tillis (R-N.C.), who says the bill needs more work and has questioned the endgame for passing the bill when Democrats are vowing to block it with a filibuster.
Tillis and several other Republican senators were outraged by Sen. Mike Lee’s (R-Utah) post on social media this week suggesting that Republican colleagues who don’t support forcing a talking filibuster to help pass the SAVE America Act should be replaced.
“To me, it’s disingenuous to say we’re going to go out here and we’re going to bring the bill, make [its virtues] apparent to the American people, and then he’s out there the night before we’re about to go on the bill and threatening primaries for people who don’t get on board for something he knows he doesn’t have support for,” Tillis said.
Trump added to the pressure Tuesday when he declared on Truth Social that the SAVE America Act is “one of the most IMPORTANT & CONSEQUENTIAL pieces of legislation in the history of Congress and America itself” and vowed to withhold support from any Republican who opposes it…

Lt. Governor Stratton won the Democratic Party Primary yesterday.
Even though I voted for her, I didn’t think that she was going to win. Because the polls didn’t have the race close between her and Raja. Raja spent a ton of money and had been doing ads FOR MONTHS before I saw any ads from Stratton.
I admit, I was apprehensive because I thought that Stratton and Congresswoman Robin Kelly were going to split the Black vote and allow Raja to slide on through.
FYI,
Every 2 out of 3 voters in Illinois lives in Cook County and the attached Counties. So, the Northeast corner of the state is where the voters are. The rest of the state is corn and cows for the most part.
I went ‘ oh’ the moment that I saw the results coming in from Suburban Cook County, which is Raja’s wheelhouse. When Stratton and Raja were separated by half a percentage point, I thought that the race could be going a way I hadn’t imagined.
Even in the counties that he won, she kept it close. Close enough so that her dominance in CHICAGO is what put her over the edge to victory.
She dominated Election Day Voting.
Now, about Illinois 9.
Daniel Biss was a known quantity in a district where he’s been elected Mayor of one of the more actively constituent involved Townships in Suburban Cook County.
And, I’m glad that Suburban Cook County, and the other counties where the district touched, didn’t fall for the bright shiny new object that was the Cosplay Revolutionary Carpetbagger.
