Before Friday, no court had *ever* revoked the FDA's approval of a drug, or claimed the power to do so. Kacsmaryk's assertion of power here is unprecedented. If he's right, courts across the country will start to pull various drugs of the market at the behest of angry doctors.

Or take a life-saving drug with known side effects. Hell, take chemotherapy.
Dr. A gives a patient a course of chemotherapy. The patient suffers side effects and goes to Dr. B for treatment.
Per Kacsmaryk, Dr. B can now sue for a nationwide block on that form of chemo.

Folks keep asking why I think the Supreme Court is more likely than not to stay Kacsmaryk's decision. Standing is the #1 reason. The legal term of Kacsmaryk's standing analysis is "batshit insane." It basically abolishes standing requirements when a judge doesn't like a drug.

First, Matthew Kacsmaryk donated to Hawley’s campaign. Then, Hawley voted to make Kacsmaryk a federal judge. Now, Kacsmaryk just ruled in favor of a suit led by Hawley’s wife to ban abortion meds.
Hawley’s name is all over a nationwide effort to ban abortion without exceptions.

I had to 😂😂 at this. My parents were “attentive” , but when I think about what I was able to do.
I was 11 years old going downtown on the CTA, by myself. When I say by myself, it was with other kids…no adults.
