Open Thread | What the Colorado Supreme Court Did With Regards to Trump

The Colorado Supreme Court barred Donald Trump from being on the ballot there, and they used the 14th Amendment as the reason.

The part of the 14th Amendment that is relevant:

Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

And, since, he was the one inciting 1/6…the Colorado Supreme Court thought that this section of the 14th Amendment was applicable.

Make no mistake, this opinion was written with deliberate intentions. The intention of getting it to the Supreme Court, and getting them to take it, and to make a decision on it.

Here are several of the key findings the court issued in its decision:

Colorado state law allows voters to challenge Trump’s eligibility under the federal constitution’s “insurrectionist ban.”

Colorado courts can enforce the ban without any action from Congress.

The insurrectionist ban applies to the presidency.

The January 6, 2021, attack on the US Capitol was an insurrection.

Trump “engaged in” the insurrection.

Trump’s speech “inciting the crowd” on January 6 was “not protected by the First Amendment.”

They thought seriously about it, and applied the law.

Not only is it bad for Trump, but he might be barred from running in so many states by November that he couldn’t get enough electoral college voted to win the 2024 election anyway.

It’s also a wake up call for the GOP to nominate another candidate who isn’t legally barred from appearing on the ballot or serving in office. If Trump loses the GOP nomination, he’ll take his ball and Republican voters and go home but if he wins the nomination and isn’t illegible to serve as president, what good is a voter?

The media is going to wishcast this into increasing support for Trump because they need 2024 to be close or they’ll go broke. Republicans will wishcast this into increasing support for Trump because the only thing keeping him afloat is that conservative voters still think he has a chance to win.

The SECOND they realize he’s doomed, his support will collapse. Whether that comes with the D.C. trial or with being barred in half the states, his polll numbers will implode and Trump 2024 is over.

The case was filed by six Republicans, and the Colorado Supreme Court cited a previous ruling by Justice Gorsuch in their decision.

Trump’s own party did this, not Democrats 😂
